How does that work? Was the reason not valid for the Defence/s Request? Was her reason to stay on the case, more valid? If a judge can refuse, what is the actual point of being able to ask? The Commonwealth Of Massachusetts has NEVER evolved since the 1600's. Large groups of frat boys and sorority girls that are permanently soused and reckless do seriously nasty $hit to isolated individuals and the law enforcement and the judicial system is linked to these $hitty people by blood and gifts in the form of lifetime appointments to various jobs, all of which come with incomparable financial and medical benefits.
Ted Kennedy murdered Mary Jo Kopeckne by driving drunk and plowing her into a salt pond on Martha's Vineyard, Chappaquiddick Island - until his death from a brain tumor in 2009, he NEVER had to pay in any fashion for this crime - look up the timelines and obstructions of justice revealed in that case.
Old, old 17th century Irish blood that became the dominant political and social forces throughout Boston, Dorchester, Charlestown, the West End, Allston-Brighton, and then south and out to the suburbs of Quincy, Randolph, Canton, Dedham, Walpole, Norwood......and endless line of incestuous relationships at work, at home and most significantly, at play - reckless, cowardly, pathologically dishonest drunkards with the world's most dangerous weapons (guns, vehicles, their immediate and extended families).

Based on this, you can murder someone (not saying the Alberts did it) and leave their body on your lawn because a dead body on a lawn does not constitute probable cause for a search because it creates a perfect grey area situation. You wont even get a knock for questioning under reasonable suspicion.
Even if that person was confirmed to be heading into that house (which the officers knew on arrival as confirmed by Gallagher and Lank). This case is setting a dangerous precedent for police procedure being ignored and people genuinely think its okay and are ready to send a woman to prison for murder over it.

I do know over time memory can change, trauma can mess with your memory but to testify and say i dont really remember the next day . 🤔

I know when you would deep breathe and or sigh the way the judge has even in a basic customer service job the boss would want to slap you on the back of the head, tell you get it together or go down the road some place else. So with a higher up job your suppose to set a example in that court room.

I don't know what happened to John O'Keefe. That being said, getting all these folks to frame someone doesn't seem plausible. Maybe someone got into a fight with O'Keefe outside, and no one else (or very few people) knew about it. Or maybe Karen Read hit him with her SUV. Higgins definitely wasn't involved. You could tell he was being honest.
The fact that these guys (who are cops and Feds) ditched their phones is easy to explain as well. If they had anything on them that's inappropriate (racist, sexist, homophobic etc etc), it could ruin their lives. I'm not saying I have stuff like that on my phone, but I wouldn't want the world to have access to my personal messages or photos.
Let's be honest, if the defense had access to their phone records, they would have entered everything that shed a negative light on them into evidence. Higgins would lose his job, and Brian Albert could lose his pension.
