As a judge, do you think a defendant’s skin color should be a variable in ruling their guilt or innocence? For example, if a black man and a white man committed the exact same crime, should the white man have a lower bar to clear than the black man-in proving his innocence?
Oh, okay. So the law should be blind to skin color- a judge’s rulings should be based on the preponderance of evidence without prejudice for or against biologic incidentals like skin pigmentation. Is that correct?
So you would agree then… that the similarity or dissimilarity between the judge’s race and the defendant’s race has no bearing on how rulings should be made? In other words, it would be prejudicial for a white judge to issue lighter sentences to white defendants because they have the same skin color. Is that correct?
And would it also be prejudicial for a white judge to issue lighter sentences to white defendant’s because they have similar life experiences-due to their similar skin color?
And what about the balance of rulings based on skin color? If a judge recently tried five cases in which three whites were found guilty but only two blacks were found guilty… should the next case involving a black defendant end with a finding of guilty-so as to balance out the judge’s rulings based on skin color?
Oh, okay. So again… the law should be blind to skin color- a judge’s rulings should be based on the preponderance of evidence without prejudice for or against biologic incidentals like skin pigmentation or shared life experiences.
Well, I ask these questions because the president didn’t make it a secret-- he wanted a black female supreme court justice. He felt such a choice would better balance the court along racial and gender lines… and it would be good to have a justice on the bench who has lived the black female experience.
But based on your previous answers… skin color and/or common lived experiences based on skin color should have no bearing on how a judge rules. And so, do you not feel as if the stated reasoning behind your selection is prejudicial? How can you accept a position when the appointment there-of is based largely on an unjust and flawed decision-making methodology that you yourself wouldnt stand for in the courtroom?

Blacks comprise approximately 12% to 13% of the US population. This ratio has remained fairly constant for decades. In judicial circles, Blacks comprise less than 5% of the population of all of the racial demographics in the arena that is the legal profession. Amongst qualified judges who are black, the number is in the single digits, to include both men and women. By his blatantly and overt racist and sexist selection criteria, Biden has excluded over 97% of the qualified candidate pool, thus essentially guaranteeing that we are not getting the absolutely best judge that can be chosen for the supreme court. His selection criteria automatically excludes all Whites, Hispanics, Native Americans, Koreans, Cambodians, Vietnamese, Hawaiians, Alaskan Natives, Puerto Ricans, Filipinos, Indians, Chinese, Taiwanese, Laotians, Samoans, etc, etc, not to mention Black Men. This is how a sexist and racist choice, which runs counter to American values and current federal laws, diminishes our supreme court and/or any other institution for which it is the basis of selection. Case in point: see current VP. If this nominee had honor and integrity, she would decline for being chosen based on her sex (sexism) and skin color (racism).
