Unfortunately, Blackburn is completely wrong. SCJ cannot implement policy. If Congress enact laws that enable gender neutrality then the Justice does not get to change that regardless of whether it goes against common sense. Law is about law not common sense. It’s up to Congress to enact common sense legislation not the judges.
