    If the owner decided to use or sell the property the builder has to return the property into its original condition. Especially if the builder asked permission after building a building.!

      For as long as there is stipulation in the contract is clear that upon the arrival of the stipulated period, the builder has to return the property into its original condition notwithstanding that the builder had the permission from the owner for its construction.

    Hi Attorney! I always learn from you. I have a situation for your comment: We opened a dirt road access to our farm. Parts of it just used to be a footpath and only motorcycles can pass with some difficulty. After the dirt road was made, many vehicles have started using it too without our consent. It's been this way for about a year. We don't want this road kept open for security and due to the threat of ASF. What steps or legal processed should we do to make this road exclusive again? Can historical use or estoppel be used as arguments to keep the road open? I hope to get your views on this attorney. Maraming salamat.

      As owner of the land you have the right to regulate the access to your property including prohibiting anyone from using it. As the dirt and access road is considered as Discontinues and apparent easement, as its use is dependent on the acts of men, the same can only be acquired by Title, meaning by juridical act, such as sale, donation, grants, etc. and cannot be acquired by as right of way by prescription. As the owner of the subject dirt road, just close it and put a “ NO TRESPASSING SIGN” and with a warming that any violator will be prosecuted under the law.

      Hi Atty! I'd like to add more scenarios to the original question and ask your opinion. This dirt road that I mentioned connects to an existing sitio road. (Btw, we're not sure if this sitio road have been formally donated yet to the barangay.) However, we recently found out that a neighbouring lot (part and parcel of a 10-hectare plus farm) built an access road that connected to our private road and have been using ours despite verbal notice not to. The 10-hectare farm borders the sitio road and they can build an access without using ours if they want to by talking to other lot owners within the 10 hectare lot. There are several heirs claiming to own portions of this 10 hectare farm. My question is: given these facts, can the various owners of this adjoining farm (including the one who built a connecting road,) successfully sue us for compulsory right of way and use our dirt road? Note that they haven't offered us compensation for use of our land and there are alternative lots that may connect them to the national highway directly ( 500 meters away) instead of the sitio road. Hoping this gets your attention and opinion. Thank you so much.

      Kung ang lupa na sinasabi ay classified as Timberland ang ibig sabihin nito ito ay pag mamay-ari ng gobyerno. Ang timblerland ay classified as inalienable and indisposable land of public domain. Maari na ung nakapossession nito ay maituturing at base sa Stewardship agreement lamang sa pagitan ng DENR at ang Steward lease agreement for a period of 25 years and renewable for another 25 years. Hindi maari ding i-subleased ito na kung saan ay naniningil ng upa. Bawal yan dahil hindi naman nag mamay-ari ng steward sa nasabing lupa. Hindi hindi nag mamay-ari ng lupa ang steward ay wala siyang obligation na mag bayad ng tax sa lupa. Although kung may bahay at mga improvement ang naisagawa ang steward ang babayaran na property or amilyar sa munisipyo ay bahay at mga improvement na naisagawa ng steward doon sa lupa.

      Kung ang nasabing “papeles” na binigay ng may-ari sa nag alaga ay ung mga titulo sa lupa, tax declaration certificate at mayroon ding kasulatan na pinagkaloob sa nag alaga sa kanya ang mga naiwang ari-arian kasama na ang lupa, ay okay ito at maging basihan sa pag palipat sa pangalan ng nag alaga ang mga ari-arian ng namatay.

      Kung ang dike na tinayo ay doon sa inyong lupa at ito at NIA project, ay subject ito sa legal or public easement na kahit kayo ang nagmamay-ari ng lupa at ibinabayad ito ng buwis. Bilang may-ari pa rin may karapatan pa rin kayong paalisin ang mga informal settlers. Magkaganoon pa man, kahit na na-expropriate ang portion ng inyong lupa ng NIA o pamahalaan at binayaran kayo ng pamalaan, ay hindi paring tirihan ang area na nakapaligid sa dike para protection ang dike at ang immdiate environment.       Kung wala kayong kasulatan sa bintahan at walang perang binayad sa inyo sa inyong bilihan ay walang bilihan ang nangyari. Dahil walang bilihan ang nangyari, kayo pa rin ang may-ari ng nasabing lupa. Bilang may-ari maari pa rin ninyong paalisin ang naka tira sa inyong lupa.

      Legally at the time na nagkaroon at nag pirmahan ng deed of sale sa pagitan ng may-ari at ng inyong biyanan ang may-ari ng nasabing lupa ay ang biyanan mo. Kaya at the time of the death of the seller or dating may-ari ay hindi na siya ang may-ari at hindi na dapat kasama ito sa estate ng seller. Kaya lang as consequence sa hindi pagpaparehistro ng deed of sale sa register of deeds, ay hindi nailipat ang ownershhip ng lupa sa buyer , Kaya sa pananaw ng anak ng dating may-ari ay sa bahagi pa rin ng estate ang nabiling property. Magkaganoon pa man the fact na nagkaroon na ng bilihan ay wala ng karapatan ang anak na mag claim sa property. Furthermore, kung 30 years na ang nakalipas after the sale, ay PRESCRIBED na rin ang karaptan ng anak na mag habol pa sa property. Papasok na rin ang laches laban sa anak dahil tinulugan niya ang ano mang karapatan na mayroon siya doon sa lupa. Makipag ugnayan kayo sa lawyer for assistance upang maisagawa ang kaakibat na hakbang na pangalagaan ang karapatan ng asawa mo bilang tagapagmana. Bilang tagapagmana ang asawa mo na ang may-ari ng lupang nabili. Maaring makasuhan ang anak for Usurpation of real property sa ilalim ng Revised Penal Code and/or kung danyos. Dapat mag pagawa din ang asawa mo ng settlement of estate sa lawyer. Bayaran ang mga taxes sa BIR, tulad ng estate tax, documentary stamp tax, at kung hindi pa bayad ang capital gains tax sa ginawang bilihan 30 years ago ay dapat mabayaran din ito, kasama na ang penalty at interest charges. Mag avail kayo sa estate tax amnesty para iwas sa penalty at interest charges. Pag na fully paid na ang mga taxes at nasunod ang publication requirements, ay mabibigyan kayo ng certificate authorizing registration(eCAR) ng BIR na kailangan ninyo sa pag paparehistro sa Register of deeds at mapalitan ang titulo sa pangalan ng inyong asawa.

      Kung inurong ninyo ang demand dahil sa affidavit of desistance ay maaring magamit nito sa pag pa dismissed the same case na ma ifle ninyo in the future. Maaring i-dismiss ang kaso with PREJUDICE sa loob ng 6 months to one year na kung saan ay maari kayong mag file ng kaso kung nilabag ng defendant ang inyong kasunduan, na dapat ay nandoon din ang usaping "Right of way" na kikilalanin nila ang inyong right of way.

      kung may issue sa tamang sukat ang inyong lupa at nagkaroon ng overlapping or conflicing boundary lines, ay mag pa RELOCATION/VERIFICATION survey kayo sa geodetic engineer. Dito malalaman kung sino ang naka encroached sa lupang karatig na mga owners. At kung hindi kayo magkakasundo at naka rating sa korte ang inyong usapin, ang pagbabasihan ng korte ay ang results ng RELOCATION/VERIFICATION survey.

    Hello Atty. magandang buhay po. Anu po ang dapat namin gawin kasi po may nakatayo nang Barangay Hall yung lupa namin at may hawak po kaming documento na kami yung nagmamay-ari ng lote. Kinausap po namin yung incumbent Barangay Chairman na pag usapan yung lote pero pinagpipilitang sa Barangay yung lupa subalit wala po silang documento maipakita na yun pong dati may-ari ng lupa (Deceased) ay dinonate sa Barangay yung kinatatayuang lote ng Barangay Hall.     Nagmana ng lupa sa kapatid na namatay pero may 4 na familyang nakatira o 4 na maliliit na bahay nandoon. Sabi ng nakatira sila nagpagawa ng bahay pero naguupa sila at nang mamatay na ate ko. Yong isang kapatid ko ang kumukuha na ng pera sa kanila. Nasa name ng namatay kong ate ang lupa. Ano gagawin pra mapaalis mga nakatira doon.

      Bilang mga co-owners ang sino man sa inyo ay maaring paalisin ang naka tira sa inyong lupa kung wala namang existing lease contract. Kung pinayagan ng may-ari ang pagpapagawa ng bahay inyong lupa, at maituturing na builder in good faith, ay may-optiong ang landowner na either bayaran ang mga bahay or ibenta ang lupang tinitirikan kung ang nahalga ng bahay ay masa malaki pa sa halaga ng lupa. Kasama rin sa mana ay ang encumbrances at obligation na naka tatak sa titulo tulad ng sangla. Kung hindi bayad ng sangla, ay manatiling nasa titulo ito.     There are three co- owners on the title. Two of them passed away. My 2 siblings and I is the heir to our father the 1/3 portion of the property. The other co-owner (father sister) that passed away was unmarried and no children. Her 1/3 portion of the property will subdivided among to brother, sister, nephew and niece. The 3rd co-owner (father brother) still alive.
    We want to partition the property into 3 titles. Do we need all heirs to sign a partition agreement? And can we first partition the property before settling the estate of the decease?

      Yes. You may have the property surveyed first and partition based on the agreement of the heirs. Thereafter, based on the partitiion agreement, confer with your lawyer to prepare the corresponding Extrajudicial Settlement of the Estate and Partition documents for the signatures by the concerned parties and for its implementation. This include the payment of taxes and compliance of the publication requirements as prerequisites in the issuance of the certificate authorizing registration(eCAR) by the BIR for registration purposes with the Register of deeds.

      1. Will we still able to submit partition if for some reason we are unable to obtain one or two signatory agreement from father sister heirs as I mentioned above? One heir (co-owner sister) is near 100 years old and bed ridden, another heir (co-owner sister) is living in my fathers house that may refuse to sign, the 3rd heir (co-owner sister) will sign the agreement but wants us to waive our rights to our father sister portion.
      2. Does the partition agreement requires notarization? This will be more difficult as I mentioned one heir is bed ridden and may not be able to sign.
      3. Can the remaining co-owner (father’s brother) and us only sign a partition agreement and not include the sister heirs? As mentioned the decease co-owner sister was unmarried and doesn’t have children. Therefore there are approximately 10 heirs including us on my father side. (3 sister, 1 brother, 4 nephews, & 2 nieces). This a lot of signature agreement.
