    Termination of employment cannot take place for any reason which is as per the whims of the employer. There has to be a fair, logical and sensible reason because of which there is termination of employment, otherwise such termination will be termed as illegal termination.
    There are a number of grounds of termination of employment which have been laid down by the law. Other than these grounds, termination of employment can also take place for reasons which are fair, logical and sensible in nature. Termination of employment which takes place for other reasons tends to be termed as illegal termination and if this can be proved in a court of law, it is most likely that compensation will have to be paid by the employer.
    If termination of employment takes place because the employer does not like a particular employee whose performance is sufficiently good, this will be considered as illegal termination of employment. This is because such reason does not come among the various grounds for termination of employment which have been laid down or is otherwise fair, logical and sensible in nature.
    Suppose employment of a person is terminated illegally and such person is able to prove this in a court of law. The employer will now be made to pay monetary compensation over and above the salary due which has to be paid to the employee in question.
    The terms of the employment contract have to be clearly kept in mind, however, when a claim for illegal termination is being made, since this is considered to be the final authority in case of private companies when it comes to any debate about the conditions of employment. The legal recourse starts by sending a legal notice to the company for the illegal termination and to recover any dues as per the terms of your employment with the company.
    In case of no reply to the legal notice one may choose to file a civil suit for recovery of legitimate dues like unpaid salary, salary in lieu of notice period not allowed to serve, PF, gratuity and so on. The labour and service laws have made a number of strict compliances that are to be adhered to when it comes to conditions of employment of labourers as well as employees.
    The conditions of employment are hence, regulated very strictly in India and the strictness of the laws ensures that there is no scope of the hire and fire philosophy anywhere in the country anymore.

    I had joined Bajaj Capital Insurance Broking Ltd on 5th November from collage placement as a Sr Client Relationship Officer and suddenly on 11th December our HR came from Bhopal and told that the branch is going to be suspended for next 4 months due to less business and that the branch has been suffering losses from the last 1-2 year and took a resignation letter from all employees and told there is no need to come to office from tomorrow and your salary of 11 days will be processed. We didn't had any prior notice and not any single intimation regarding this. So in such case what action can I take aginst the company

    Sir, My uncle is a permanent govt employee.. He was absent from duty more than 5 years due to seriously faced a road accident. he was under coma for a period of 8 months.. He joined in his duty after getting medical fitness certificate but due to non regularisation of the above period he is deprived from getting 6th and 7th pay.. He is continuing his serve now..     Sir I was working in private UN recognized school in Delhi and after the Delhi govt passed order in Delhi that all unrecognized school need to register themselves . Our school is run by some trust .Owner of our school has denied our request to get her school registered. We have worked in this school since 2014 July. Our last day in school was March 20 - 2020 . Now the owner of school is forcing all 40 employees of school to resign and sign some paper . As per her she will only pay salary for March . What can we do in this case. Please suggest how we can proceed. Thanks

    We(5) were terminated because we requested 50% of salary for the month April 2020 carona period which work from home.. There is no use in complaining in labor court they just send notice to the organization and got reply from organization and DCL just pass to us. Without any intimation they terminated us.

    1.Myfather was working
    at Grameen Bank as a cashier cum clerk since 1982.
    2. Deceased employee
    removed from service from 09.07.2003 on account of his conviction in criminal
    case instituted by state on the allegation of misappropriation of bank funds.
    3.Hence the deceased
    employee had been suspended from bank service on 12.05.1998 and removed on
    09.07.2003. 4.Removal order was passed by the Head Office passing a judgment
    date 05.07.2003 delivered by CJM Malkangiri,and rule 3A para 29 of chapter 4 of
    Bank service regulation.
    5.The said
    convictional judgment was set aside by the Addl. Session judge Malkangiri and
    declares him innocent on 25.02.2005. After that the bank preferred an appeal
    before the Honble Highcourt of Odisha CRL REV 400/2005 against the acquittal
    judgment of Addl. Session judge Malkangiri. And On 24.09.2008 he died .
    5.That the Honble High
    court Of Odisha has demised the Criminal Review Petition & granting liberty
    to decease employee order date 11.04.2019.Hence I would like to inform to you
    that, If misappropriation on fraud, justified dismissal, but misappropriation
    if not proved, dismissal from service not Justified. After all Deceased
    Employee had qualified and he was fully cleared of the charges. He was falsely
    implicated and in view of acquittals in all there remains no criminal case
    against him. The decease employee to have been continuing in service till his
    death .so how i can claim entire the benefit or have any circular please
    advice.

    I have one query sir... I was hired as a software developer by pvt company and deployed at govt client... Client asked me to do support work for few months as there were some urgent need.. As I was very new, so started doing that.. But later when I asked them to assign me back my software work they said please support for another 6months and we will then surely assign u.. In doing so I wasted my 2 years.. Now I have lost my skills, I requested them multiple times they refused to assign me my technical work... as per market and my experience it's hard to find another job.. they know it very well so they are tossing me in non profile work.. Can I take legal action..? कंपनी is saying its only client who assign work.

    Hi I know a person
    He has worked joined a MNC organisation and was in training period
    He gave resignation to the HR through a Email stating medical dad's accident court hearings
    Post which he dint like the behaviour of the employer because they dint accept his medical reasons to be unacceptable and to report to office
    Based on which he gave a resignation
    After some time they sent a letter that he is terminated and needs to pay amount for relieving
    Is this fair from the employer!

    Is it mandatory that one have to send this notice via any labour union?
    I was under trainee train driver in Delhi Metro rail corporation under the name of a 3rd party firm JMD consultants.
    I neither signed any kind of documents nor I got any contract letter. I got terminated from the services because I asked the manager about the salary differences among the personnel posted on same designation. I signed form D from 18/01-15/02/21.
    My question is: can I sue them as an employee of the company or I'm not an employee of the said company at all?
    I went to police also they said that it is a civil matter, go to court/labour court.
    In a dilemma how to proceed, what'd be the limitation period for such a matter.

    Six months back i joined a company but i was frequently feeling sickness. I was notify them about my illness but they asked me to either take care of your health or a job. They asked me to resign and i resigned to but i never turned to office bcoz i feel its partiality. I took more than my capacity personal loans from bank on the basis of this job and without a job i unable to pay them back. Please guide me or anyone else reading this comment.

    I am instrumentation engineer, pass in 2017 batch, I worked in automation field for 1 year as programmer , company fired me as I didn't complete task on time .
    Now I am searching job but in every interview interviewer asked me "why you left your previous job?? "
    Maine 1 jagah par bola _"Due to my personal reason_ "
    Aur 1 jagah par bola ki " _due to no salary increment"_

    Yes. Company can so easily prove that we r not performing good. I m going through this now. As bcz one employee was verbally insulting me. I shared this to another colleague few times n recently that employee crossed her limits i lost temper n shared this to friendly colleague on wats app msgs . N ya i scolded with bad words in msg. Nd this friendly colleague betrayed me n showed that msgs to all to manager . Thou in those msgs i didn't mention that employee name bt as only 4 females in company it indirectly understood about whom i msgd badly. Now my manager without discussing anything started torchering me. Thou i have exceeded target achievement. For small things n for right things also she telling infront of all that i m doing wrong. Nd mailing so many times simply mention that bcz of me others get confuse. N mail format is wrong n all. I don't know wat to do now . Shud i resign . Bcz i dont know what is termination. N i have no strength n no money for court cases. No support. N wat will happen if get terminated in next jobs. Will it affect next jobs. Will it b like black mark to career

    Hello sir, Mera capgemini me selection hua 13 oct 2021 ko offer letter released hua and maine wo digital website pr accept kiya. 14 oct ko meri joining date thi but usse pehle onboarding documents verification hota hai. Mujhe onboarding se koi proper contact nhi hua ki unko konsa documents chahiye bcoz mera joining waiting pr aa gaya insufficient documents ki wajah se. maine 7 month experience base pr apply kiya tha 2 companies ka working experience tha total 7 months. 5 months 1st company ka and 2nd company me 2 month work kiya tha. Onboarding team se mujhe koi proper contact nhi hua ki unko exactly konse company ka experience letter chahiye tha. 15 & 16oct ko holiday meri joining delay ho gayi fr mujhe 17 ko hr ka call aya usne mujhe bola ki 2nd company ka exp letter chhaiye nhi toh hum aapko joining nhi karwa sakte… maine bht request ki unse ki offer letter or salary slip hai mere paas usse mera 2nd company ka employment proof ho jayenga but wo nhi mane maine bola ki 2 months ka exp letter company nhi dengi . Fr hr ne bola sorry hum kych nhi kr sakte or call cut kr diya. Next day maine meri 2nd company se baat kiya ki mujhe relieving letter chahiye toh mujhe wo dene ke liye ready hue uske liya thoda time lagta hai 2 3 din 19 oct ko maine hr ko call kiya ki mai aapko relieving letter few days me de dunga toh hr boli ki humne aapka process close kr diya aap late ho sab kych close ho gaya and call cut kr diya……… but issue ye hai ki offer letter me mention tha clauses me ki joining ke baad 15 days tak exp letter provide kr sakte or dusra clauses ye ki current company ka offer letter bhi de sakte exp letter ki zarurat nhi …. Lekin fr bhi hr ne mera employment close kr diya…. Please help me in this case how can i get my employment back in legal way??????? I have nothing done wrong…. Hr didn’t follow their own company policies????? What can i do now???

I dropped a official mail about my problem then i went to my village. After some days they send me termination letter. They cut my yearly bonus, I have 6 working day those they hold my salary & 10 paid leave. Now they tell me you are terminated & no clearance for you. Now what I do? Please sir help me

Public employment me contractual employees ko agar 10% waitage(10 extra marks) diya Gaya hai aur candidate obc category se hi aur uska selection 10% ka benefit ka use Krke obc category se Hua hai toh yeh legal hai? ya o bass kaunse bhi ek benefits le skta hai ya toh obc category or ya 10% waitage?
    Kya ye article 16 ko/fundamentals right ko violate krta hai?

    Sir LIC terminated me after completion of of my 1 year probation period due to non fulfilment of business target.
    But I was terminated on 17th Feb 2021 where the termination letter was backdated on 02nd February 2021.
    I have worked in these 15 days from 02nd Feb to 17th Feb but I have not received any salary for those days. Also I didn't receive any compensation for 12 CL that I didn't take over the year.

    It is not Masters In Business Administration, it is Man Behind (Your ) Ass.
    The poor employee has to either look somewhere else or accept whatever is given in the name of increment
    These Ass Licking Souls will then go their Senior Pimps ( MD's & CEO's ) boasting about the COST SAVINGS done.
    It is not only these Senior Pimps who do the Ass Licking, there are plenty of Lower Level Employees (Junior Pimps) who do this YES SIR OK SIR RIGHT SIR (ASS LICKING ) and run their families at the cost of Talented, Skilled & Honest ones.
    Moreover this will be done using power point & excel presentations in the boardroom.
    They will boast how they have achieved their targets and how the organisation has been saved a big chunk of money.
    These pimps will in return expect and prove why they deserve promotion.
    These pimps will go back to their wives proudly , Darling I have been promoted to the next Management Level with higher perks.
    They will plan their Family vacation abroad with all enjoyment
    They wil resume work boasting and showing snaps and will update their facebook and other social media boasting of their achievements.
    All these at the cost of innocent and poor lower and junior employees
    And these employees continue with their daily struggle of catching overcrowded public transport , reaching Office and continue listening to the daily insults and mental harassment..........
    Some not able to withstand and take the step of KILLING these PROFESSIONALLY QUALIFIED
    MANAGEMENT PIMPS

    Sir Maine bank of India mai 30/03/2011 se 13/08/2018 tak as daily wager/casual worker kaam kiya main jis bank branch mai kaam krta tha wahi mera savings account open tha mere account mai krishi bank khandwa madhya pardesh se wrongly 147400 credit ho gai the jo maine net banking through debit kr use kr liye mujhe branch manger ne terminate kr diya terminate krne se pehle koi enquiry nhi ki koi one month notice nhi diya koi retrenchment compensation nhi di sir yeh case mera illegall termination ka hai ya loss of confidence ka ya misconduct ka please explain me about my case

    सर मुझे कंपनी ने नोटिस पीरियड पूरा करने के ३४ दिन बाद टर्मिनेट किया। 😭 क्या ये सही है?????
    और मुझे २ महीने ८ दिन की सैलरी भी नही दी। कंपनी ने डॉक्यूमेंट्री देने के कारण मुझे terminat किया ।
    डॉक्यूमेंट कंपनी ज्वाइन करने के पहिले ही लिए जाते है। और ना लिए तो १ महीने के अंदर कंपनी डॉक्यूमेंट मांग लेती है। लेकिन मेरे कंपनी ने ऐसा नहीं किया। और मुझे ये कारण deke निकल दिया। कंपनी ने मुझे २४ घंटे का समय दिया था। लेकिन मेरे document पीछले कंपनी के यह pending थे। और उन्होंने इस कंपनी को बताया था । मैं document १-३ din के अंदर आपके भेजने वाला हु। लेकिन फिर भी कंपनी मानी नही और टर्मिनेट किया।
    पहिले तो नोटिस पीरियड पूरा होने के बाद कोई टर्मिनेट कैसे कर सकता है। ???????
    मैं अभी क्या कर सकता हु ???

    Could you suggest me if employer says that I am not emplpyee of the company and denied to give joing letter, appointment letter, they issued one experience certificate in which they didn' mentioned my designation. Three years after my sudden termination I filed case against company in labour court. Company said I am not employee and shows earned monthly 16,000 permonth. Is third party payment legal in corporate companies.

    Sir a CBSE affiliated private school teacher has been illegally terminated in February last year. Legal notice for damages against illegal termination has not been replied by the school. Sir kindly suggest the court I should move and also order/section of CPC . Is any problem under limitation act? Thank you sir

    Hi, In my company they say the work hours is for 8.5 hrs daliy but they ask us to update as 8 hrs daily for the past 2 yrs. They even ask to work on extended shift and saturday working with out pay stating as company requirement and they dont update it as worked hours. Please suggest any idea

    IT company terminate the employee by putting false allegation for bad performance & behavior issue but reality is company not having the project for employee in which Employee can work, only employee speaks truth marked as behavior issue cannot be proofed in court. After termination employee not given experience letter by IT Company saying If they will issue Experience letter then company can be punished in Court at the same time putting allegation & giving experience letter cannot be possible. IT company employee hardly survive with one month salary gone to Police to take immediate response but Police Constable started to ask Jobs for their children from culprit company Police officer not understood the matter saying victim should approach to Labor court. When IT Employee victim reached to Police Inspector for getting experience letter from company to get new job then Police Inspector told these big IT Company has hot line can throw me from Police station there is no law on which I can force the IT company to issue Experience letter. IT Company forcing the employee to accept the allegation If victim employee want to get experience letter then company management can decide to give experience letter or not . Question arise how can victim from IT company employee accept false allegation against IT sector employee. Labor commissioner office takes very long time to send notice to get response from IT Company. Police not having clear direction to force the IT Company to issue experience letter & Court takes more then year to give judgment then still question arise how IT Employee can survive with family without Job cannot get new job unless gets experience letter from IT company. If family of the IT employee face issue without money who will be responsible. Need the law to punish IT Company.
    How can IT Company denied for experience letter even terminated the IT Employee . Termination is right or wrong can be decide later in court but immediately IT employee need new Job for their family survival cannot be denied . Why IT employee should accept false allegation mention in Termination letter to get experience letter. IT Company need to punish for wrong termination. IT Company not given severance charges till IT employee not get new Job or ask for one year severance charges to get new Job no one can say when IT employee will get new Job.
    We need answer from Government of India what is solution for IT employee in this condition how IT employee will get justice. Why Law not passed against IT Company for wrong termination become trend in IT Company need to stop only possible by punishing the responsible officer need to send in Jail or company should faced huge penalty for wrong termination. If Law maker not giving justice by making law against wrong termination then Supreme Court must give judgment against them. Police not updated with their right and hot line getting misused against them cannot punish IT company need to clear Police right only Police can help in emergency , immediate help can be given by police need more power but found now days they are scared feeling without any power against IT Company not clear what action they can take against IT Company in case when IT Employee facing survival issue along with family not getting experience letter to get new Job.
