    Hi im single, and claim my mother as a dependent. My sister and her husband do their taxes together and i file separately with my mom. One tax place told me only one party in under the same home can file HOH and now another tax person told me i can file HOH because i claim my mom as a dependent. So confused, thank you for your video and and and your willingness to clarify my confusion. 😊

    I am a single mom of twins (12yr old) that live with me, but for the past 5 years my ex claims one, even if I have given a IP pin through IRS, eventually I get my tax income credit but it's just a hassle, takes 8 months sometimes. So my question is, should I ask for two pin numbers?

    We are still legally married but have lived apart in two separate houses for the whole year. Our college age children on paper live with me (school address is mine, doctors' bills, drivers license etc) but in reality spend most of their off days with the other parent. I pay for most of their bills for school, medical, food etc. Can I file HOH? Could we possibly split children and both file HOH? If only one can file HOH, does the other have to be married filing separately? Thank you much

    Since I’m still legally married but broken up for a year now, can I still claim my kids for EITC? We don’t live together, my 2 kids live with me for the whole year, it’s my 2 children’s and none are his.
    And should I file my taxes as married filing separately or head of household?

    Looking for clarification on head of household in a situation of 50/50 custody. All 3 criteria are met - not married, 50% of maintaining a household, qualifying dependent. The question mark is on which years the HOH can be claimed. The divorce agreement states to alternate claiming the dependent every other year. Do you claim HOH every year, only on “off” years when not claiming the dependent, or only for “on” years in which the dependent is claimed?

    I am still married (not yet divorced), but I meet all the qualifications for HoH. I assume my spouse must file as "Married Filing Separately". We lived apart the entire year, both of us residing in California, a community property state. Her wages and my pension are considered community income, but we did not comingle our finances at all; I took no part of her wages, and she took no part of my pension. Must we still combine our community incomes the same as we would if I was filing "Married Filing Separately"?

      Chris, to be considered unmarried for HOH you must meet the following criteria:
      You won't be filing jointly with your spouse
      Your spouse didn't live in your home after June (temporary absences due to illness, school, vacation, business, or military service don't count)
      Your home was your child's, stepchild's, or foster child's main home for more than half the year (non-child dependents in your home don't qualify)
      You paid more than half the costs of keeping up your home during the tax year
      You meet the qualifications to claim the child as your dependent, even if the other (noncustodial) parent is actually claiming the child as a dependent on their return
      If this is the case, you should be unmarried for any other laws under the IRS. That means you do not fall under community property rules and do not have to follow them for federal tax purposes. I can't advise you on how the State of California might look at it.

      It depends on whether they already claimed themselves on a return or were claimed on a return by someone else. If so, you will have to to prove you deserve the dependency deduction more than them. If they were not claimed by themselves or someone else you can claim them by filing an amended return.

    What if I’m allowed to claim one child in the divorce decree but they live with custodial more time out of the year? I’m 5 months she’s 7 and I was audited. I claimed HoH but was audited should I amend it or did I file incorrectly in your opinion? So far it’s stopped me from getting taxes for 2020 and for this most recent tax year 2021 it’s been rejected because I need to file form 8332. Hopefully you could point me in the right direction as I can’t get in touch with the IRS and TurboTax isn’t any help. I’m really at a loss as what I should do because it’s a bit of money owed for 2020 and 2021

      Sorry for the delay. I have been out of town for two weeks. The IRS may respect your right to claim a child as your dependent as stipulated by the divorce decree but will not approve head of household status if the child was only with you for 5 months of the year. You do need to file form 8332 to help with your claiming the dependent but will not help with filing head of household. You need to contact your auditor and see where the case stands. I would not file an amended return at this point. If the audit resulted in you owing money you should pay it as soon as possible to avoid more interest and penalty. I would also ask them to abate the penalty. They will not abate interest.

    Can I file head of household (unmarried 72yo) if my 22 yo grandson lives with me full time while working part time and going to college full time? He makes more than $4500 yearly 2020. I pay more than half our rent, all utilities and some of his food. He could not be a dependent (bc of his income, correct?) and he would file single. True or false?... . He needs financial aid. Neither parent claims him as dependent.

      In order to file HOH you need to be able to claim your son as a dependent. If he needs financial aid, it is best for him to file single and claim himself, but that will preclude you from filing HOH.

      Rina, you face two problems. One is that one of you needs to show that he or she provided over 50% of the cost to maintain the home. The parent making the most money usually wins that decision. The second problem is that to file head of household you must be unmarried on the last day of the year. You did not mention your marital status, but if you lived with your spouse or ex-spouse during the last 6 months of the year you are considered married. You also need to be filing separate returns for the tax year. The first item is going to be the most difficult to meet. I suggest that only one of you file HOH.

      Ethan, is the infant yours or your fiancé's by another father? You have to meet the following qualifications to be able to claim both your fiancé and the child as qualifying dependents.
      You provided more than half of their total support for the year.
      They lived with you legally as members of your household for the entire year.
      Neither had a gross income that exceeds $4,300.
      The child should qualify you for head of household as long as he or she lived with you in your home for most of the year and you provided more than half of the support. The support requirement would negate your fiancé from claiming the child as a dependent.

    My daughter was so excited she did her own taxes she lives with me but she’s 18 her birthday in July so she was still under 18 most of last year I can I claim head of household or even claim her. She said she put no one can claim her on her taxes

      I understand how she was able to find her taxes or not, and she had insurance through the year or with that paper that we got that little tax free I’m getting money that has to be claimed plus she used our living address and I always used my mailing address

      Jane, if you are married you cannot file as HOH but you may be able to file a joint return with your husband. Do you or your husband have an ITIN that allows you to report income for tax purposes in the United States?

    someone help me out.
    I live with 3 others. My retired father, my sister and niece.
    I can't claim either of them but I do pay house expense like utilities. those being electricity and internet.
    Neither of us are married, the only thing owed on the house are property taxes every year.
    Can I be head of household?

      Pierre, did you pay over half the cost of maintaining the home for the year? Maintenance costs include:
      Rent, mortgage interest, real estate taxes, insurance on the home, repairs, utilities, and food eaten in the home. If all you paid was electricity and internet you may not have paid over half the cost of maintaining the home.

      @@TheVideoCPA yea I understand the rules. The property taxes he expects me to pay or help out at least. Not to mention he can’t even drive without insurance. He’s over 80 years of age. He pays for his own food and gas. I’ll be the one taking care of him.

      Ana, sorry for the delay. The rules unfortunately say that a child must be under 19 or if a full time student, under 24 to be a qualifying child. They may meet the qualifying relative test if their income was under $4,300 for the year. If this is the case, head of household might be the right filing status for you.

      No, if your dad filed jointly with your mom you cannot use her as a dependent for HOH purposes, sorry.

    Do I file HOH if my adult child lives with me? She works part time but I pay all the rent, the electric bill and pay for all the groceries. She wants to claim herself on her taxes.

      You can file HOH if you provided over 50% of the cost of maintaining your own home, she lives with you more than 1/2 the year, and she can be claimed as a dependent. If you claim her as a dependent she will not be able to claim herself. If she only works part time, the dependency exemption may not help her anyway. I advise you to file HOH, if you can, and make up any difference to her, if any, for her increased tax burden.

      Edward, can you give me a bit more information about this? The qualifier is usually the individual that enables a taxpayer to qualify to file as head of household.

      No, not a good idea. File a joint return it gives you more benefits than HOH anyway.
