    Hi im single, and claim my mother as a dependent. My sister and her husband do their taxes together and i file separately with my mom. One tax place told me only one party in under the same home can file HOH and now another tax person told me i can file HOH because i claim my mom as a dependent.     great video sir! i need your help, I am recent sub of yours, and I am itemzing deductions for 2020 , but I want to carryover 2020 , 2021 margin interest from previous years, which took the standard, so i never used it, and margin interest , plus 2022 taking margin deduction( i had more investment income to surpass my margine for each years , so for example I made 50k in capital gains each year and had margin interest 15k each year), will the IRS audit me? they dont say nothing on form 4952, askign if i took the standard in previous years, i feel like i am double dipping, please help, thank you!!!

    We are still legally married but have lived apart in two separate houses for the whole year. Our college age children on paper live with me (school address is mine, doctors' bills, drivers license etc) but in reality spend most of their off days with the other parent. I pay for most of their bills for school, medical, food etc. Can I file HOH? Could we possibly split children and both file HOH?       It depends on whether they already claimed themselves on a return or were claimed on a return by someone else. If so, you will have to to prove you deserve the dependency deduction more than them. If they were not claimed by themselves or someone else you can claim them by filing an amended return.

    Do I file HOH if my adult child lives with me? She works part time but I pay all the rent, the electric bill and pay for all the groceries. She wants to claim herself on her taxes.

      You can file HOH if you provided over 50% of the cost of maintaining your own home, she lives with you more than 1/2 the year, and she can be claimed as a dependent. If you claim her as a dependent she will not be able to claim herself. If she only works part time, the dependency exemption may not help her anyway. I advise you to file HOH, if you can, and make up any difference to her, if any, for her increased tax burden.

    Hello, how do I report the sale of a house that was the primary residence for 6 years and then was turned into a rental for 19 years ? Specifically, how do I prorate the 6 years as primary residence ? Is an exclusion possible for the years as primary residence ? Thank you

      Joe, if it was rented the last 19 years you will have to report it as the sale of a rental. No exclusion is possible as a primary residence and no proration can be done. Sorry for the bad news.

    What if I’m allowed to claim one child in the divorce decree but they live with custodial more time out of the year? I’m 5 months she’s 7 and I was audited. I claimed HoH but was audited should I amend it or did I file incorrectly in your opinion? So far it’s stopped me from getting taxes for 2020 and for this most recent tax year 2021 it’s been rejected because I need to file form 8332. Hopefully you could point me in the right direction as I can’t get in touch with the IRS and TurboTax isn’t any help. I’m really at a loss as what I should do because it’s a bit of money owed for 2020 and 2021

      Sorry for the delay. I have been out of town for two weeks. The IRS may respect your right to claim a child as your dependent as stipulated by the divorce decree but will not approve head of household status if the child was only with you for 5 months of the year. You do need to file form 8332 to help with your claiming the dependent but will not help with filing head of household. You need to contact your auditor and see where the case stands. I would not file an amended return at this point. If the audit resulted in you owing money you should pay it as soon as possible to avoid more interest and penalty. I would also ask them to abate the penalty. They will not abate interest.

    Nice video. I like the cash method because I feel like it gives me some control of how much income I show in the year. If I need to show more income I can carry a credit card balance and pay it off in the next year. If I want to show less income I will try to create more expenses in the current year by buying stuff I will use quickly in the next year.

    We are passive investors in a real estate deal (100k) and received a K-1. There was a loss of 58k because of accelerated depreciation. Our accountant put the K-1 form in and now we owe more money on our taxes because it reduced our income, so we have less to deduct from the QBID. This doesn't seem correct. I've done significant research, but it is a bit confusing. Even though the enterprise that we invested in qualifies for QBID, we are passive and limited partners, so I don't think it should go against our active income.

      Holly, I can answer only very broadly the questions you ask as I do NOT have enough information from your personal tax situation. The items I would have you consider are: 1. Is the accelerated depreciation from bonus or Section 179? There are limits for the S179 deduction based on total income. 2. If the real estate entity has a loss, there is no QBID to be calculated. QBID is calculated on income only. 3. QBID is calculated first at the entity level. It would be wise to ask your tax preparer about their reasoning for applying it to your tax return. Again, QBID is Qualified Business INCOME Deduction. In a loss year, the QBID loss is carried over annually until the entity has income to offset the QBID loss calculation. 4. Real estate professionals may be in a situation to qualify for QBID in a passive situation. 5. Talk to your preparer for clarity. Your name is the one on the tax return so it's important you understand how it has been prepared. I hope I have explained this clearly. Let me know if I may assist further.

    I am still married (not yet divorced), but I meet all the qualifications for HoH. I assume my spouse must file as "Married Filing Separately". We lived apart the entire year, both of us residing in California, a community property state. Her wages and my pension are considered community income, but we did not comingle our finances at all; I took no part of her wages, and she took no part of my pension. Must we still combine our community incomes the same as we would if I was filing "Married Filing Separately"?

      Chris, to be considered unmarried for HOH you must meet the following criteria: You won't be filing jointly with your spouse Your spouse didn't live in your home after June (temporary absences due to illness, school, vacation, business, or military service don't count) Your home was your child's, stepchild's, or foster child's main home for more than half the year (non-child dependents in your home don't qualify) You paid more than half the costs of keeping up your home during the tax year You meet the qualifications to claim the child as your dependent, even if the other (noncustodial) parent is actually claiming the child as a dependent on their return If this is the case, you should be unmarried for any other laws under the IRS. That means you do not fall under community property rules and do not have to follow them for federal tax purposes. I can't advise you on how the State of California might look at it.

    Hello - Thank you for the informative video. I have one question regarding standard vs itemized and the carry forward of margin interest in brokerage accounts. If my Standard deduction is higher than my interest expenses, can I carry forward those interest expenses to a year when I chose to do itemized deductions or do I lose the option to carry forward those interest expenses if I chose Standard deductions in the year that those interest expenses were created?

      Unfortunately you lose the deduction for that year and are not allowed to carry it forward. By taking the standard deduction the IRS feels that you have already taken the equivalent of the deduction so you cannot carry anything forward from that year.

      @@TheVideoCPA sure glad I saw this video, but I called 5 diff. turbo tax reps, 4/5 said if you didn't use the margin interest for previous years, where you filed a standard ded., you can use for the current year you itemize as long as your investment income exceeds the margin expense for those years, is that true? i totally feel like i am double dipping, but why wouldn't the irs form 4952 say in neon lights ' IF U TOOK A STANDARD PREVIOUS YEARS, you cannot use it for this year or future years when doing itemized?" very grey area, any other proof? thank you!

    Thank you very much for posting the video. I watched it a couple of times and now I have a much better understanding of the various depreciation methods. I have a question on Section 179 deduction and Bonus Depreciation. We purchased a 5-unit apartment complex in December 2020. In 2021 we replaced the roof and water pipings with copper. We would like to write off 100% of the costs of those two items in 2021 (~20K for the roof and ~15K for the copper piping). Since we do not have a profit (we have a net operating loss in 2021), can we use the Bonus Depreciation to deduct 100% of those costs in 2021? I am using TurboTax to do our tax and I could not get it to work that way. Thank you.

      Section 179 is not applicable to residential real estate structures. Your roof and plumbing improvements therefore do not qualify for Section 179. Unfortunately I have bad news for bonus deprecation as well. Bonus deprecation is not available for properties with a useful life over 20 years. Residential real estate, like your apartment building, has a useful life of 27.5 years. That means that bonus depreciation cannot be used for items that are considered part of the structure. Your new roof and your piping are considered part of the structure and are therefore not eligible for bonus depreciation. Sorry to be the bearer of bad news.

    Looking for clarification on head of household in a situation of 50/50 custody. All 3 criteria are met - not married, 50% of maintaining a household, qualifying dependent. The question mark is on which years the HOH can be claimed. The divorce agreement states to alternate claiming the dependent every other year. Do you claim HOH every year, only on “off” years when not claiming the dependent, or only for “on” years in which the dependent is claimed?

    I went the stupid route and didn't get a small business license when I started mining a year ago, and to be honest I'm sort of stuck now. Can I still claim all my electric, hardware, etc if I'm not officially a business? What would I even file as? I have a job also so employed? Self employed?

      Steven, you don't need a business license. The IRS can care less. File as self employed by attaching Schedule C to your Form 1040. You can claim any legitimate business related expenses on Schedule C. That includes utilities and hardware. You may have to depreciate your mining machines over time but can most likely expense any you purchased during the year against your income.

      No, not a good idea. File a joint return it gives you more benefits than HOH anyway.

    im unmarried but living with my fiance and infant. i can claim hoh and she can claim the child as a dependent correct? or does HOH have to claim child as well?

      Ethan, is the infant yours or your fiancé's by another father? You have to meet the following qualifications to be able to claim both your fiancé and the child as qualifying dependents. You provided more than half of their total support for the year. They lived with you legally as members of your household for the entire year. Neither had a gross income that exceeds $4,300. The child should qualify you for head of household as long as he or she lived with you in your home for most of the year and you provided more than half of the support. The support requirement would negate your fiancé from claiming the child as a dependent.
