Has anyone ever mentioned how you yourself are avoiding copyright strikes on these videos? I love how you break things down. And go further into it by giving us detailed information with your own short clips of others even if they are violating rules. Your critiques, evaluations, explanations and opinions protects you from strikes 🤙
First? Other than Ian’s comment? 😝[edit] jokes aside, I think the commentary of drake’s video works because of the overlay of commentary over the original video. The problem is that a lot of people use too much unedited footage from the original work, then get claimed, and then think they’re access to fair use has been impeded. The essential criteria I consumer is whether or not the use will drive traffic towards, or ssyphon traffic from, the original work. If it is the former, OK. If it is the latter, no no no. ✌️
Yea I made this mistake in terms of the lack of editing the clips in some respects. no matter how you do it you're siphoning traffic from the original work because you likely chose to base the subject matter of your video on that particular piece of original work because it was trending and drawing traffic.

Anna and others pointed out that the scene portrayed Classic Villain Behavior. Several of these videos were either taken down or blocked. But restored after the content creator's protests.

What about thumbnails tho? Is it fair use when you use like a movie poster or screenshot a scene from a show and then you do some photoshop activity with it? I’ve seen some podcasters and TH-camrs of the reviewer/reactor types have thumbnails with some images (surely copyrighted) or at least edited versions of the images of the topic, whether they put together images into one thumbnail or use a copyrighted image and just paste their faces (usually their reactions) next to it, and these same people are monetized. I’m planning to do reviews myself and I wanna make something off my channel, and I’m just wondering if I can just photoshop images together for the thumbnail or if I’m better off drawing from scratch.

How does this pertain to doing analysis of let's say, golf swing technique? It might only be 5-10 seconds of a video clip, but it is the main focus of the video and played back several times and different speeds and with pauses while critiquing the player's technique and also marking up the video and/or doing a side by side analysis with another player or same player before/after.
Can you answer a question about the jurisdiction on Fair Use? I'm a UK creator and upload content to TH-cam, so which laws apply? Because the content was created in the UK do UK Fair Dealing laws apply? Or do the American Fair Use laws apply? I appreciate TH-cam is an American company but it also has servers and offices worldwide. It, therefore, is subject to the laws wherever it is based. So, how should non-US Creators interpret Fair Use?

Example: I wanted my audience to listen to a very short clip of a song to listen to the point that I was making about it. I have specific questions not addressed in your video above, with the objective of avoiding claims, strikes, and being successful in disputing any that arise. 1) There may be segments of video in which I am not speaking but allowing the audience to view and listen to any relevant commentary on the segments. I will then critique or comment. How can any issues be avoided with this scenario? Is it essential to be speaking within small increments of time to avoid hassles? 2) Related to this, can commentary be accomplished by text or annimations? 3) I would prefer to speak and not have an image of myself payed over the videos for the commentary and critique. If someone appropriately uses fair use to transform a copyrighted work does that new work become an independent copyrighted work entirely removed from the original? Imagine someone transforming a copyrighted work, then, at that point, can someone transform that new work under fair use? That is essentially what you are doing when you are using examples in this video about other's who've transformed work. But I noticed that you didn't touch on directly the work that was previously transformed--you didn't critique Drakes song. You critiqued the person who transformed Drakes song. 2. If this is the case that the new transformed work is a completely new work, couldn't you argue that I could then transform Todd in the Shadows work by removing his critique of Drakes song leaving me with Drake's original song and call it transformative from the original work? My new work, essentially, would be Drake's song, and if I found enough clips of people critiquing this song, I could theoretically reconstruct Drakes song in its entirety and original state. But I would have a brand new transformative work...
Hi NickelNation!! You need to make sure your clips are only 2-5 seconds long (10 secs max) and then you MUST comment and/or react or criticize directly the clip you just showed. The concept of Fair Use and copyright is a tricky topic. If you are interested in learning more, I have done several more recent videos that teach about these ideas. See. Maulers example is exactly what I wanted to refer to. If you observe, Mauler never uses latest movie clips and does screenshots instead. For older movies he uses a few seconds footage and sometimes even random stuff while commentary is still on the actual movie. Makes it feel like this whole Copyright thing is a damn Russian Roulette 😑
If l download a non creative common video, extract the audio and use pictures to create another video, hope am still within fair use and will not get a YT strike?

@Ian Corzine, I had a channel for education ot traffic lows and use a software as tools for showing different situations, on which I comment and add addiional meaning. Is that a fair use? What are the rules for using software in a video, a software which is legally bought, of course. By the way, I had not 1 but 21 DMC strikes.

i know of some channels that have clips way longer than 2-5 sec. for example check out the TH-cam channel Dorian Group82. his channel is based on the music industry and he uses so many copyrighted material. could you make a video on how he is getting away with this?
@Ian Corzine, I had a channel for education ot traffic lows and use a software as tools for showing different situations, on which I comment and add addiional meaning. Is that a fair use? What are the rules for using software in a video, a software which is legally bought, of course. By the way, I had not 1 but 21 DMC strikes.
