- The plaintiff says the defendant is a former employee who attacked her and her truck. She’s suing for the cost of the vehicle damage. The defendant says the plaintiff dragged her out of her day care business and hit her with a chair, so she fought back. She denies damaging anything.

Yeah I don’t believe that plaintiff either. Either way why would you go to the room to speak with her? She should have pulled her to the side or an office and talked about it. Not automatically assume she was being rude about the late comment.

In the beginning of the case the plaintiff said her kids were the ones that told her the defendant was scratching her car. So technically the plaintiff never saw the defendant scratching her car and she was going by with her kids were saying while she was on the phone with the police. I don't doubt that the defendant was probably outside having a fit, and who knows maybe she did throw a few things at the lady's car. Which is also kind of strange because the plaintiff never told the judge anything about the defendant throwing things at her car she only spoke of her scratching it. But as Judge Judy often says when you come into court you have to come in with clean hands. Which means you can't do something bad and then point the finger at someone else and say they did something bad too now give me money.
Anyone who's worked in HR or any forum of Labor law can tell you that you NEVER escalate by touching the employee; an unwanted touch is assault.
Fair, and I completely agree, but in your own home? I know that if I asked someone to leave my home then I'd want them to leave immediately. However, she has converted her home into a work space as well. I feel like there's a very fine line there... I think contracts should be written up for this exact situation :p
@@k0chana6 Small business labor laws still apply regardless of where the business is operated. If she's too unprofessional to separate personal from business, then she shouldn't try to infuse a professional environment within her home, b/c that did not sound like a professional environment. They didn't arrest the young lady for a valid reason; even if she'd caught it on camera showing her trying to physically remove the young lady - just by making physical contact most judges would consider that escalating the situation and told her she should've called the police then to have her removed for trespassing, but touching her provoked a fight - whether workplace or not that could be used against her.
People have to stop thinking the law no longer applies in their homes, especially when it's not an intruder and someone they initially invited in. This is why a lot of people are in prison now for what transpired in their homes.

She's basically saying that is all she has since she is lacking smarts. That's why she's saying just stand there and br beautiful because what she is saying and her way of thinking is dumb. Though in other cases I do think she may be a bit jealous of their looks. She's pretty old but looks good for her age.

She was texting her the schedule, which is something you cant just tell verbally. The judge was stating the text back, “oh well, I’m just going to be late,” should have been said in person to avoid miscommunication. Through text it sounded very condescending, that she didn’t care, but perhaps in person, it would have sounded better like how she stated it in court, “it’s difficult for me to find transportation short notice, so I apologize if I am late” something to that nature. It’s as if people aren’t even understand the 15 minute video they are watching on here.

I believe the young lady scratched her car but I also think the plaintiff was more wrong. First off, don’t put your hands on an employee. EVER! Secondly, when she called 911, she conveniently left that part out about her initiating contact. Then, she expects you to be at work when she wants, but can’t even be professional enough to give you a weekly schedule. She’s an unprofessional passive aggressive employer. That’s why she works her kids for free. Who would want to work for someone like her? Ugh. I totally believe that the young lady would’ve left if she told her to. Like she said, she didn’t care at that point. Young people don’t care about getting sent home early from work. They’re like, “BYE!”

I don’t know about this one. I think whenever there’s a younger defendant or plaintiff everyone assumes they are wrong I do think the girl scratched her car. She’s absolutely wrong for that. But I believe her story on how the fight was started. Older people (in my culture) tend to talk to people like their sub humans. I believe that lady got mad after the girl went off walked up on her to escort her out using her hands. I don’t think she asked her to leave, she was mad the girl went off and wanted to assert her dominance and got slapped. That’s it. And for judge Milian to scold her for texting, if I’m not mistaken it was the lady who texted her first with the list and asking her why she was late. She simply responded to the text.

I agree 100% with this one being a little off. I've noticed Judge Milian does this often to younger ppl, she talks down to them and tends to be snarkier and dismissive. The plaintiff didn't look like she is so calm and passive, as she claims to be, but the defendant definitely has that "I'm going to be calm to piss you off" attitude.
I agree. Also, right in the beginning when she said she was 8 minutes late but it really was 6, so she claimed a discrepancy right there. Two minutes difference??? Give me a break. I would never work for anyone who doesn't understand that sh*t happens and unless she is late regularly, for heavens sake, less than 10 minutes is totally understandable.

What I found interesting is Defendant mentioned Plaintiff's camera outside and judge didn't acknowledge. She also didn't look at police report. Lastly, 1st call to 811, Plaintiff claims Defendant was walking away, but 2nd call she claimed she was still there.

The plaintiff is not professional at all! Regardless of the defendant's behavior it's clear the plaintiff escalated this situation. All she had to do is stop talking about what has happened, move the children to another room and let the defendant wait there for her ride.

Depending on your state, you can physically remove someone from your property, especially if you told them to leave and they've refused to do so. The defendant said she was grabbed by her wrist and then responded by smacking the plaintiff.

I can understand the defendant's frustration about her schedule because in the past I have worked for employers who did the same thing, especially in retail. Not posting work schedules, job assignments, etc. Then they get upset when people don't show up or get an attitude for the inconvenience. So glad I got into nursing. I know my schedule a month in advance.
I prefer to arrive at work with a item list to do for that day. It makes my life a lot easier!
Ikr that's where I paused and came to the comments to see if someone else disagreed w/ her like i did. I make my own schedule and sometimes I'm late than I planned for. The girl was speaking facts and telling her upfront unlike she is doing with that schedule. If u don't know ur schedule more than likely it is going to be some days missed as well, especially a woman with children. There's no way of planning ahead.
Frustration is one thing. Being combative and destructive is another issue. Bad actions lead to bad results.

You might as well do both u guys a favor and just say "this isn't going to work out" and get someone w/ reliable transportation. Employers try and take advantage of young people bc they are learning. Any contract is negotiable as long as it is in writing. Basically the employee was negotiating with employer after she changed schedule at last min. The employer didn't like that she had a backbone instead of just saying ok bc that isn't ok at all.

If you don't like the terms of the employment, find another job. Talk to someone in the restaurant, or health care services. Schedules change frequently.

And I've been working for decades but never has a job required or requested that I be on site 15 mins before my scheduled shift!
@@CleveNative My dad brought me up with that kind of frame of mind- always try to be there at 15 minutes before your shift. You show you're responsible, and you're definitely there on time to relieve the person before you. Plus, things can happen that may make you late, so those 15 minutes can you help you out in those instances.
But that whole 15 minute thing was really hammered in when I was active duty Navy. In some cases it was 'be there 30 minutes before', especially if it was to relieve someone who was finishing up a 12 hour watch, or something like that. That was a requirement, and definitely not a recommendation, haha.
All of that to say that while it was suggested by my father, no employer ever asked me or demanded that from me. So, I agree with you there. haha
@@babiifrshj07 employers don’t ask hourly employees to arrive earlier than their start times, because they’d have to pay them for that time. Your boss can’t say, “Your shift starts at 7 so be there at 6:45 so you’re ready to start work at 7,” unless that employer is willing to pay you beginning at 6:45. The clock begins at whatever time an employee is required to be onsite, regardless of how the employer frames an official beginning of a shift.

The whole idea of showing up to work 15 minutes earlier than your schedule is not necessary, this is why unions are so extremely important,, you are required to be on time not early, I wonder how many employees she has had since being in business

So if you leave home at the same time every day and get to work perfectly on time what happens when you get stuck in traffic or there's an accident? Oh teacher teacher I know, YOU'RE LATE. By leaving early you ensure that you get to work early so you're ON TIME to clock in, with the added bonus of it giving you time to get a cup of coffee, go to the bathroom and put your things away (things which should be done prior to clocking in). It's good work ethics, and no you shouldn't be paid for settling into your day at work.
I worked at a company where a few employees would clock in then proceed to go to the restroom to change into a work uniform. Then chat with people before heading to their position, causing the person they are relieving to be late leaving..just be a little early or come into work 100% ready to work.
Clearly she did it. Both of them was unprofessional.

It's a good concept to get to work 15 minutes early, provided the employer is paying the employees for their time. I've worked for a shady employer who refused to pay for the extra hours they received from employees, who came in early and were expected to also stay late. Shady AF.
The concept of being 15 minutes early is to give yourself a cushion. If you're scheduled to work at 8:30, plan on being there by 8:15 that way, if life happens you're less likely to be late. Shady boss not giving pay for extra hours worked is a completely different can of worms.

What is it with all these young people thinking that they have to have to be paid for EVERY second of their time??? It's called work ethic not how much can I squeeze out of an employer. Being early, even just 5 minutes, is to give you a BUFFER. What if you leave at the same time as any other day to get there when your shift starts but guess what traffic is at a stand still because of an accident, now you're late. If you leave early and give yourself that buffer then you always get there on time, not to be paid by your employer, but to give yourself time to ease into work if you are early, and yes to start early if needed. This younger generation has no backbone or ethics at all, I'm so glad I raised my kids to be nothing like their peers, it's disgusting.
This grown lady with a home daycare should have been able to resolve the matter better than this. I feel that she was the aggressor in front of those babies 👶🏾 with a hot headed young lady. Yes the young lady is wrong but when you own a business working with children you need to not escalate conflicts while the children are in the area. This is why I don’t do home daycares.

I think she was more so trying to impress upon her that with text message, the “tone” and intention are left to individual interpretation, whereas when saying something face-to-face, it’s much easier to judge exactly *how* someone intended a comment to come across. If she was going to keep working there she could have still texted the thing about being late from time-to-time, just to protect herself.

Yes she does. She was LATE and should have gone to say that she was there and then started working. Both have some responsibility for what happened in the house HOWEVER once she went outside and scratched the car, she was WRONG all the way about her overall behavior. She has a lot to learn and that her cuteness makes her ugly by her actions. She needs to learn how to act working on a job. Watch who you hire and learn the rules for supervising employees so that you don't have these issues. Set the standard and expect them to stick to it.

Maybe you work salary and yes that’s standard for salary but it’s actually illegal to expect that for an hourly position. I clock in early ten minutes it’s allowed and I get paid for it! Yes the 10 minutes helps me tremendously because I can properly be acclimated for the day but it also benefits the employer. I’m glad to have a company that understands that.

I once had an employer that wanted us ready to accept calls from clients at 8 am. It took 20 minutes to log into all of our systems so I started punching in at 7:40am and got reprimanded for "stealing company time".
TD Bank did the same thing and had too pay over 1million employees in a settlement. I got 30$ lol.

This lady is crazy 15 min early?! At no pay. I’d never expect an employee to be early, sure it’s nice, it’s preferable but it’s not standard. Employers who expect this(but don’t pay) are nerve wracking. You should schedule someone at a time that will allow them to go over the day’s responsibilities.
Almost every job I've had have asked for me to show up 10-15 minutes early to give me time to put my purse and my things in my locker and put on my apron and or put my hair up or whatever the case may be so when my shift starts I was good to go. Just saying

She may not have meant for the grab to escalate how it did, and I'm not siding with the defendant, but as an employer she went about the situation the wrong way.

The case is not about the fight, the young lady being late, or the boss' mishandling of the schedule. It's about a car being keyed/scratched. Period. For the boss to win the case does not imply that she was RIGHT in her actions. It just means that she has enough evidence to prove the girl scratched the car. Y'all are really over here getting upset at JM over the back-story leading up to the case and not taking into consideration the actual facts of the story that pertain specifically to the case. 🤦🏾♀️

Uh actually the back story does kinda affect the possibility of whether defendant did or did not damage the plaintiffs car because if we believe the plaintiff then the defendant was definitely angry enough to cause the damage but if the defendants is true then why the hell would she be angry enough to damage the plaintiffs car because she's basically getting a free day off duh. Also why the hell would she want to force the defendant out especially since she's doesn't even have a ride home yet and who knows how long it will take for the person(who I don't know could be working) who usually picks her to even get there though I can understand leaving her outside long enough for her to calm down but not for how long it will probably take for her ride to get there.

This young lady didn't handle this situation the right way but I do believe when she says the Plaintiff talks at her and got aggressive first. My daughter use to say that when working with older ppl, they tend to talk at you like you're a kid. I gave her permission to respectfully check them.

when the Plaintiff received that ignorant text from the defendant about her being late all the time she should’ve known right there it was gonna be an issue but instead of letting it go until the end of the day or whatever the plaintiff decided to confront the girl right then and there in front of the children and asked her to leave and proceeded to put her hands on her and then the defendant scratched her car. If you ask me they’re both wrong. And whichever race she is doesn’t excuse the fact that she vandalized someone’s property.

If I was the parent of one of those children, I would be highly upset that she had my child in the middle of that situation. She could have handled that in a couple of different ways that would have given a better outcome. And I do think she is taking advantage of that young girl, probably paying her much less than she would have to pay a more experienced person to assist with taking care of the "house full of kids" she said she had. She has her 14 year old daughter and this young lady as her assistants in this daycare, I would bet she is not properly running that business.

Judge Milian is real patient. Judge Judy would have shut that "immature" young lady down the moment she kept talking while the judge was talking. Some responsibility on both sides but you catching a ride and then talking smack to an adult, grow up and learn to put a pin in if you're wrong. YOU WERE LATE TO WORK. Accept it. Now the plaintiff should have patiently let her know that they could go over her point about the schedule later. GET TO WORK right now. They act like they momma and child more than employer and employee. smh Don't hire folks that you let get too familiar enough to yell "you gone lose your license". That's serious. A lot of this comes down to who caused who financial damage. The plaintiff was in the wrong putting her hands on the defendant. The defendant was wrong in scratching up the vehicle. The defendant lost because she caused the most financial damage, outed herself when she said "I wasn't just sitting there scratching up the car," and the defendant had evidence with the 911 recording. If the plaintiff had hit the defendant on her head with a chair, the defendant would have probably needed medical attention for which the plaintiff would have been responsible for.
She should had filed assault charges against "the elder" for hitting her in the head with a chair. Did the judge think that was ok?

Makes me angry when the judge decides the whole case on one word. The word just. It’s not like I was just standing around scratching her car. The judge took this in the wrong context. Every one I know has spoken just like this. It’s called sarcasm. Maybe the judge needs to understand this. Say someone accuses you of standing naked in an intersection and throwing stones while you were really standing on a corner fully clothed waiting for a bus. You comment, it’s not like I was JUST standing around naked throwing rocks. It’s a sarcastic statement meaning you had other things you were doing instead of what you were accused of doing. And the judge made it sound like she was saying I was doing other things besides scratching the car. Very poor judgment from the judge on one little 4 letter word.
i dont know about u all but if somebody other than a close friend or relative grabs my wrist or my arm and starts yanking on it then its assault , especially if its a employer ! this is a bad verdict and both the plaintiff and judge made too many assumptions about the defendant because her young age and good looks . if u listened to all that was being said then it was clear that the plaintiff first attacked the defendant and there was no proof the defendant damaged the car , nothing on video , no photos , just a recording of a phone call to the police that anybody can do just sitting on their couch and make it all up .

If this was Judge Mathis this case would have ended differently!! I agree the defendant does have a lot of maturing to do and I think that's what got the best of her. Trying to be honest about her side of the story but instead inadvertently outed herself. I think Judge Milian picked up on that and didn't take kindly to it, hence her being so hard on the defendant. To me the plaintiff did initiate the fight and should have bared some of the responsibility in this case.
Not how that works. What you are saying is if I have an argument with my husband and he pisses me off, I have every right to go scratch his truck up. No. If you can difuse the situation thats what you do and that is what the law says you have to do. Its different if plantiff hit her and she hit the plantiff back. But no she scratched her car up. I’m also appalled a mother would put out a 19 year old outside, I’m sure her neighborhood is nice but I’d never force someone to wait outside, it’s a safety issue.
