Your take through on this was so insightful. Thanks man. 🙌🏼 As a kenyan youth who's Looking to own land in Kenya I am glad and inspired to see this level of professionalism. Looking forward to doing this, hopefully with Goshen😅, in the near future, once I am back in the country, Inshallah. 🙏🏼
Thank you so much for your kind compliments Henry! We will be most honored to have the opportunity to serve you when you are ready and count you amongst our dearly esteemed customers.
Thanks for the insight, very educative, I bought a piece of land some years back and I didn't knew any of this rules, feels conned and I need to work for it in details .Once again thanks
Question: If you buying land from a company, and a wife to one of the directors objects to the sale (due to a reason that is legal), would you advise a client to go ahead and buy land or a unit from that company? and would you advise buyers to obtain consent from Directors' families before buying land or a unit from the company?
It will entirely depend on the company's Memorandum of Articles of Association. For instance, is the Wife of the Director, also a Director of the company or not? What would be the basis for her "Legal" reason for objecting against the transaction? Your advocate ought to be able to help you answer all these questions, based on their due diligence carried out on the property's ownership. Without further context, there is not much else we can take a view on.
This is such fantastic and extremely helpful content, thank you!! Unfortunately I’m buying directly from a seller who’s a family friend and things are being done so informally it’s making me very anxious. Can I ask at what point does the buyer pay stamp duty?
Stamp duty is paid after the government valuer states their valuation, which is done after Land Control Board's consent to transfer is issued and all completion documents submitted to the Lands Registry.
@@GrandAcresLTD Thanks for responding! One more Q, do you get issued with letter of consent immediately on the day of the land boards meeting or do you usually have to wait some time?
This would generally depend on the specific Land Board. We have experienced both scenarios, from different Land Control Board's. It is not unusual to wait a couple of days or so, to collect the Letters of Consents for approved applications, especially from extremely busy Land Boards, as these Letters of Consent have to be manually prepared by the secretary and then signed/stamped by the Chair.
@@kevinnjue608 , simply fill in every detail requested for. It's quite straight forward. Ensure that the description of the application (Wether it's for subdivision, amalgamation, transfer, change of particulars, etc) is as detailed or as descriptive as possible.
Good afternoon @Jon War! Thank you for your question. This would depend on the transaction value, because part of the cost includes stamp duty to KRA, which is computed at 2% for freehold or 4% for leasehold. In addition, your legal fee to the advocate, has to be included and this will vary from advocate to advocate.
Whoever needs it at the time, but ideally, your seller ought to provide you a certified one, along with the Title deed to the property they are selling you.
Slight correction - The Stamping of legal/sale agreements (also technically called Franking), is done at the Lands Office and not the AG Chambers.
