What's interesting is that Toya, probably one of the more unhinged villains in the series, is the only villain who's expressed some seeming remorse over the people that he's killed. When he thought back to what Snatch (the sand hero) asked him in season 4 about the families of the people he's killed, he actually shed a tear and said that he had. It's a fleeting scene, but a fascinating one.
Also, Japan has the death penalty, and fighting for Touya to survive, only to sentence him to death for his crimes afterwards, would be counterproductive to the story as it would only make it longer and sadder, which is why there is no debate for fans anymore, because it closed it, and letting Touya die alone is a nice compromise and closure for the character.
