    The South African government basically said that they had no mandate to ban Nord from arriving in Cape Town because the sanctions were enforced by the EU and the US but not the UN.

    I agree entirely that owners do not stay onboard for long passages. Having said that I worked for a retired owner on a 59m vessel and he came with us across The Pond. It was a very calm passage but he said it was rough and never did it again. The return journey was a bastard with 60 kn winds and 10m seas.

      Personal safety would be a main consideration.It’s not like the yachts can hide out in Antarctica indefinitely without taking on food and fuel and crew changes.Ultimately they have to show up somewhere and no doubt there is a dedicated tracking device on the yacht in case of a piracy incident and ais is turned off.Your idea is good in a normal world sense.

    Great suspense brewing all the time. Nord is unusual in many ways, her unusual behavior part of the whole parcel. Always look forward to updates on her. Great job sorting out and explaining the name changing game, obviously MEANT to be confusing...
    As an aside but VERY worth mentioning, those shots while you were talking about ocean crossings were spectacular. Seasickness is not something I ever want to experience again.

      I experienced seasickness only once in my life. As a child we travelled with a small passenger ferry in near-stormy weather north of Bornholm in the Baltic Sea. But I was fine. Until my father insisted on me taking a "seasickness pill". The pill worked like a wonder - within five minutes of eating the pill I got seasick, a lot. Bingo! Being from Denmark I have sailed a lot, but never again eaten pills against seasickness, and I never again got seasick.

    Please add a correction to your statements on AIS. They are wrong and missleading.
    AIS is transmitted using VHF 161.975 MHz and 162.025 MHz, using a bandwidth of 25 kHz. This is line of sight only! Typically on a ship where the antenna is high enough above sea level this can be up to 20 miles allowing for the curvature of the earth. IE visible to local vessels and or line of sight receivers only. The information you are reporting is from satellite derived AIS which is not the the same and can be turned off legally under the IMO regulations. This means local transmission can continue while international/satellite positions will not be reported to the web site. You should not rely or report using the Marine traffic web site as this is not a reliable source of local AIS transmissions from any vessel. It is indicative of a vessels position not a definitive. As you will see if you look up our position on the web site. Regards. Ant.

    OK now mark this date and record it. The next time South Africa wants or needs ANYTHING AT ALL from EU or the US remind them of this date and that since they "have no legal obligation to abide by sanctions imposed by the US and EU" then the US and the EU have no legal reasons to help them NO MATTER WHAT they want or need. See simple problem solved

    South Africa 🇿🇦 welcoming these Yachts is very smart business. So much money comes with a visit to port of these Yachts.
    I would turn off my AIS in the Indian Ocean on a trip to Cape Town. Lots of US Navy as well as pirates 🏴‍☠️ in this part of the Ocean.

    The AIS I have on my boat has a simple on off switch . It is a vesper watch mate that both transmits and receives .
    No cables have to be disconnected or breakers thrown off. It is as simple as scrolling through the menu and selecting the power down selection.

    If the crew or management company of MY Valerie are British and Britain have sanctioned that vessel does that mean the crew or management company by their actions are breaking British law and therefore could be found to be criminally responsible by a British court?     During part of your story about how the ship owners usually don't cross the oceans with the vessel for reasons like not liking the potential bad weather ... anyway while you were talking about it you were showing some footage of some rough Seas from the Pilot House point of view and the Seas were pretty rough and you were rocking back and forth as you were talking and for a moment there I almost got a little seasick! :-) but anyway ESYSMAN you also mention the fact that part of the story would make a great movie also goes to my point about you creating a book and or novel that would also make a great movie! And Like Rick says below in his comment that your network of spotters and Friends and so on add value that could be incorporated into a select venue ...( which) could be liaisoned with various entities including certain government agencies, we all know they use your stuff anyway, and as I've mentioned before there's no shame and realizing some True Value from your time and efforts. Anyway we love you man ..stay safe

      I was on the USS Midway years ago in rough seas that broke over the front flight carrier deck 90 feet off the water never want to do that again with the destroyers in our group pitch and yaw way worse...no thanks this is before stabilizers

    At 6:31 where you show the ships' particulars, it is still listed as Valerie, and it shows that it is not on Ship U.N. Sanction or Owner / operating entity under U.N. sanction.
    Is the U.N. running a seperate sanction list to the U.S. / E.U. and which sanction has priority..??

    This is like a scenario copied and reminds me from the movie “Lord Of War” with Nicholas Cage as the main actor. Excellent movie btw! ;-)
    Some scene in that movie the crew were given the orders to change the name from Kristol to Kono and registration and flag while they where chased by the coast guard to hide its cargo of weapons, and got away with it. Watch it, It’s a classic!

    You mentioned that AIS is picked up by satellites; To the best of my understanding as a US merchant marine officer, this is not the case. It is however common for some ships and shore stations to upload a snapshot of anything in their VHF range along with their satellite traffic or landline to the AIS webserver that you use. However a lone AIS transmitting ship not in range of someone uploading to the internet would not show up on the internet webserver, it would however be detected by anyone in VHF vange with an AIS transceiver.

      That’s not how it works. There is no facility onboard a ship to relay data to an AIS website.

    I live in Cape Town so will definitely try go see it. It's way too big for the waterfront harbour so I'm wondering where it will dock? Cape Town harbour? But then it's going to take up space normally occupied by large commercial ships so I'm assuming it's going to rack up large docking bills epscially if it is here for a long time. Other option is Simons Town naval base which makes me wonder how the US/EU will think of the SA Navy essentially hosting this beast.

    The reason a Superyacht is owned by a company isn’t purely to hide the beneficial owner. It’s mainly done due mitigate the liability of the beneficial owner. For example, if a Superyacht was owned by a billionaire and it were to crash and people died the billionaire would be liable and could be sued. Their entire wealth would be at risk. If it were owned by a company then the company could be sued but that company wouldn’t have lots of cash or assets so much less would be at risk. Depending on the company structure the billionaires wealth wouldn’t be at risk.
    Lots of high value assets like planes are owned like this. Even businesses structure themselves like this to mitigate risks to their core business.

    I am very surprised at the use of temporary banners being used to display the vessel's name. My experience was as a naval architect and marine engineer for several oil companies. The IMO, classification society, (in our case ABS), and the flag state, (in our case USA/USCG) required permanent markings. For steel hulls the markings had to be welded, painted, inspected and certificated.
    As for the actual ownership of vessels, in the commercial world the actual owner is often not who you think. Our ships were named and identified by name, logos, and trademarked ship stacks associated with the company I worked for. Some of the vessel's eere owned by the company. Others were bareboat chartered. These vessels were owned by banks, law firms, and even churches.

    Why don't these superyachts have fuel delivered via sea like "regular sized" yachts? For instance, I've seen 40 meter yachts refueling outside of ports and having thousands of gallons delivered. Are the superyacht tanks just way too large for this to be practical?

    You’re not 100% correct when talking about AIS. AIS has ON/OFF switch like almost any other device on the navigational bridge. You don’t have to flip the breakers or pull out the cables out of it to disable it. You can simply switch it on or off on the power button.

      There are receivers on land but the satellites pick up the rest in the ocean.

    At sometime can you give some reports on new Yachts in design or fabrication? I see these on Boat Int’l and Superyacht Times. It might be interesting to get your reporting in activities at Benelli Luerson etc.

    Excellent forensic analysis and explanation of the deactivation of Nord’s AIS.
    At least we can absolutely and comfortably rule out the possibility that any person in authority in South Africa has decided to be amenable to Nord’s plight as a result of a big bag of dirty money, because such things don’t happen there.

      I posted their (SA’s) actions in the UN regarding Russia in the last video and stated that they would let the yacht in. Absolutely no surprise they did. There would be many countries in Africa who would also let them in.

    is there any possibility of being arrested by either US or British Naval vessels while on open waters. There is a US/UK Naval base on Diego Garcia - which might make a nice jail cell for Nord.

    On Nord: would it be SOP for it to have different speed and heading prior to switching off AIS and then change speed and heading so harder to predict its position? (though I assume Americans could probably track it via satellite images). Can a US court grant order to seize ship anywhere, including in middle of Indian Ocean?
    On Valerie: How is a ship arrested? Padlock on mooring lines? 7/24 guard to ensure morring lines not taken out?
    "Ship is given permission to leave" is the big question. payoff to the guard? Wait for one guard to get new job, change ship name overnight, and when newbie guard arrives next day, they tell him he is guarding the worng ship, pointing to paperwork that show she is to guard Valerie and they are a different ship?

    On the subject of AIS - if it is "illegal" to turn this off, or not transmit. Surely this would allow any Maritime Authority, or Local Authority, to arrest the Captain for this breach of rules?
    If the Captain is responsible for the vessel - and that vessel is breaking International Law - it would make sense to then detain the Captain for investigation.
    Is this just a to simplistic way of looking at the problem - or does no one responsible for Maritime Law care ?

      This is maritime law - it isn't exactly enforceable. It mostly works on a trust based system because of the whole international waters thing, not to mention their is not really a governing body that can enforce it. There is a reason why all military boats can turn it off and on at the push of one button.

    The curent Soth African government (ANC) was helped by Russia during the apartheid days. They will not go againts their old Russian comrades. Also they see this as a business oppertunity to service other super yachts. Will this be in the best interest of South Africa... time will tell.

    Actually the South afrikans now stating the they see no reason to enforce the sanctions doesnt mean that when the yacht is there they might put it on chains anyway for some other reason.

    It's actually pointless trying to flee arrest - International maritime law permits the "right of pursuit" which allows naval/enforcement forces of a port state to pursue and board/arrest a vessel leaving that state's waters even if it enters into international waters. ITs an interesting decision by South Africa - essentially they're choosing to side with Russia over the EU and US, which is fine and they have that right but those choice come with consequences and I'm not sure it's a good idea for the country in the long term to choose Russia as your friend.

      Okay not completely pointless - if you could make it to the territorial waters of a friendly state then you'd be okay. (Or if anyone's willing to put up enough military force to protect you - but lets face it that's unlikely)

    Over 200 luxurious yachts roaming the world seas for K G B pleasure? How about recruitment? Recruitment of local invited guests by recording incriminating evidence to blackmail them (at a later date) into cooperation w/ K G B. These boats were like little floating epstein islands on board which out of port "anything goes" under a watchful eye of... K G B cameras. The ownership of these boats was so well camouflaged that invited guests couldn't have any idea that they've entered the K G B territory. South Africa is friendly with K G B, since the entire anti-apartheid movement was financed and directed from Moscow since the 1960's. Russians have compromising information about majority of South African politicians, majority of whom possibly spent "quality time" on board of those boats.

    Gee perhaps the US ought to withhold the nearly $400 million in aid we provide South Africa to bolster it's health and welfare needs and just divert that money to Ukraine.

    Ultimately all these Super yacht owners just need to buy controlling shares in P.O lines and incorporate these vessels into the fleet for charter as ultimately the sanctions are illegal anyway as international courts will find when the cases come through for compensation.
