The current owners KKR are a Global Investment Firm who own all kinds of businesses Dollar General, 1 800 Contacts, partial holders of Epic Games, UFC and the list goes on. They are not in the game of guitars for the love of it they just look at Gibson as a historical American brand that they can profit from and no they do not give a shit about quality.
Start by firing their poser POS CEO, then Agnesi, then address their value problem that leads people to buy other guitars. The problem is lousy QC and poor bang-for-the-buck. Anything else is smokescreen B.S.
Gibson is a self sustaining entity. They earn their revenue from blues lawyers buying 10k guitars, so that Gibson can use that money to hire those same lawyers. It's the "Authentic Cycle".
Heritage is where you go when you want an old fashion Gibson made by the same people that made the old Gibsons that were so famous between the 1950s and 1980s. Their quality is still top-notch unlike the guitars sold under the Gibson brand today.
First, I didn’t realize you could still get TAB, let alone that someone still drinks it! Gibson is following the model McDonald’s set. Sue everyone that comes even close to a trademark and scare them into submission with their deep pockets. Honestly, if they made a more affordable product, they wouldn’t need to sue people. If I were going to lay down a few grand for a single cut, I’d get a Heritage over a Gibson any day.
@Vince Franco • And so would I, one of the best single cuts ever made was from Japanese company and had several models to choose from but the made one model with a built in sustain switch that would make the hairs stand up on the back of your neck. I am talking about Fernandez Guitars which are now illegal to sell in the US.
At this point they need to sell the biz to an entity that cares about the company, and not the "BrAnD ImAgE" and "Trademark rights" or just call it a day and let others who do care take their place.
Just think, if they spent their money on paying their builders better wages and making working conditions better instead of spending it all in court, they might actually make good guitars.
Better wages? What are they making now and what should they be making? How specifically could factory conditions be better? Are you saying their guitars are not good? How are they lacking in your expert opinion? I'll bet you are like all Gibson-haters: absolutely talking nonsense out of the hole in your ass. I'd love to see the guitars you've made.
@@joeking433 I've played a few Squier guitars and they are pretty nice. But I already have a MIM Fender Strat, along with a US-made PRS. :) I'm actually considering buying a Harley Benton or two, just to have something I can mess around on and not care if it gets messed up. I've heard quite a few good things about them.
@@DinsdalePiranha67 HB's cost a lot, about $75, to have them shipped if you live in the US. Fireflys are just as good or better, IMO. The HB I got, the Gotoh SG, had the E string not even going over the pole piece at all, which I haven't seen on even the cheapest guitars. But mine could be an outlier.
@@joeking433 I got one for 100 shipped (unbranded, but 100% the same). Many deals like it if you look around, just be good withj a setup, these arrive as GSO's, guitar shaped objects that need some work to be playable (just like a gibson lol).
I’m new to guitar. Just at 6 months. My impression of Gibson is they are a hyper litigious company. So I’ve avoided them. This adds a log to that fire.

Gibson is upset because Heritage makes better standard guitars then Gibson’s custom shop guitars! But Hey the Epiphone line is better in a lot of ways then their standards!
They really do! I own three Gibson Les Paul’s with a standard being the finest one. It is really really great, however, I picked up an H150 at a shop to give it a go, and it’s a different guitar altogether. Most people don’t know this if they’ve never seen one in person, but they have the original, correct violin-cut too that’s much more pronounced. This comes from the arching that Gibson used to use when they were in that Kalamazoo factory. Heritage makes very fine instruments!
Well said Ashley, and there are many other MIJ brands, such as Deviser( Momose, Bacchus, Evo), Aria, FGN(many brands) to name a few. FGN previously had the contract to repair Gibsen guitars, in Jpn. They had a lot of work to handle in that deal.

My Les Paul style guitar is a Tokai, had a Gibson, sold it, its only Boomers who value these relics and are trading on badge snobbery, this litigation is going to come back on them, People who could afford them will go elsewhere, same with Artists and their Lawyers who are constantly litigating against people on Social Media or TH-cam who post covers, we have the Power by boycotting these Companies, the Wold has changed, Guitars from China and Indonesia are now really good quality, a computer controlled router doesnt care where it lives.

While its true that this applies to a lot of "boomers" as you call them if you look you dont see professional musicians using knock offs for the most part. That said these guys are usually using the older Gibsons that are actually worth the cost they pay. What it boils down to, is that Gibson needs to innovate and go back to the days of making products that are worthy of the price and not spend their resources suing everyone under the sun out of fear. They also need to expand their lines to offer more affordable instruments that the average guy can afford instead of charging boutique one off prices for every unit they produce. Old School Quality + Wider range of instruments + Price points for every level of the market = Dump trucks full of cash in profit. Not... Crappy Quality + Limited range of Products + Overpriced units marketed to stupid people who will overpay for crappy instruments + Lawsuits that alienate everyone = Why can't we dominate the market and where did all our cash go. The first equation results in a successful company and many loyal users of your product. The second equation results in your business slowly circling the bowl and people not willing to support your business. Where exactly did the people running Gibson graduate from business school? IMHO Gibson needs to restructure the head office with actual musicians in charge who will take an interest in fixing the issues their products have, such as the fragile headstocks, and take the company in the direction of quality. you increase quality and offer affordable instruments in every level of the market you will no longer need to sue anyone as the market will shit back in your favor naturally.
@@joeking433 past the '80s fender and Gibson are not very reputable as player's instruments. A 1956 gibson will hold its value, a 2006 Gibson factory guitar is no more valuable than factory Ibanez or Fender.
Yep, Absolutely right. Gibson doesn't want competition and the "Play Authentic" Weasel has been running with that mentality. Failing QC in comparison to other guitar companies will perhaps force Gibson shut down factories. They were forced to shut down once, it will happen again if they don't mind what little business they have.
At some point Gibson needed to have their market position defined for them. You can try to be king of the hill by shooting anyone who starts to climb, but eventually someone will get up there to challenge you. Looks like Heritage is that someone. Hats off the Heritage 😊
The “lawsuit era” defined that you can trademark the headstock, but not the body shape. This stood until Gibson recently somehow convinced a judge to force Dean Guitars to stop making certain models because the body shapes (like the Flying V) were too similar.
Seriously, screw Gibson. The only guitars of theirs that I even want can easily be found elsewhere with much higher standards of quality without all of the premiums associated with the name on (and shape of) the headstock, AND for less than half the price for the same features.
Yeah its really sad what Gibson did to dean. The V and the Z from dean we're true innovation. The headstock, the binding, the dimarzios the colors, etc... They made those 79 and up dean guitars destroy all!!! I think Gibson pissed off too many musicians with buying power here. Dean really needs to innovate now too. The 6 and 7 string V they designed recently rule the game. Hopefully dean gets smart with great body shapes, innovation and more endorsements!!!! These deep pockets greedy types need to go extinct. Ordered a Gibson Flying V some years ago, Custom Shop, MTM. It cost a fortune, and it took me three days to make it playable. No fret end dressing at all!
I learned about the Heritage guitars when a friend bought one. I didn’t know the company but he told me how the company started and insisted that the ex-workers from Gibson wanted to produce guitars with the same standard of quality as they were used to do before Gibson moved the company. And when I tried his Heritage guitar, I understood what he meant… While Gibson started to find ways to build guitars at a lower cost, and to lower quality by the same token, Heritage guitars kept the same techniques to build their guitars and the result was that they kept the same quality that Gibson used to have…
This, all day long. They kept most of the old equipment old Gibbys were made on. In effect, they are what Gibsons were, before they went full corporate/commercial.
I just realized that the guitar I tried was surely one of their earlier models because the pick guard was made of wood (in part or entirely, I don’t remember. And it was their semi-acoustic model. It’s possible that the newer ones are different???
Being from Michigan. If I ever have that kind of cash to spend on a guitar. I would take the Heritage. Not only are they better. But it would be nice to have a guitar made in the same climate it will live in.
But do they have the resale value of a Gibson? That is why people buy Gibsons, they make a good guitars that hold their value better than any other brand. And even with all the jealous guys on social media trying to bring them down they just keep on selling.

Gibsons and Fenders have captured the heart of Americans. They're iconic brands like Harley Davidson or Levis Jeans. Or Smith and Wesson, LOL!
Gibson heavily reminds me of my hockey club, the Toronto Maple Leafs. Some people say that they’re good, a majority say they suck (indifferent, just want success). And the leafs always break under pressure, like a Gibson headstock.

I don't understand the attraction to Heritage. They cost roughly as much for commensurate Gibson guitars but have a fraction of the resale. Guess I'm not a big enough Gibson-hater yet that's their primary draw...? It's bizarre. No, Gibson does not sue to "simply to stop competition". That's childish and in no way reflective of today's world, with everybody and their goddamn dog making LPs and SG copies for fifty years. They sue to protect their intellectual property. The idea of spending boatloads on money on lawyers to stifle competition of electric guitar manufactures in 2022 is simply moronic. You're better than that. Your resemblance to Hal Sparks in appearance and manner is striking.
Look at how many Strat models are out there. Also, why did Gibson allow Heritage to take over its old location if they didn't want some of their best employees to continue to make guitars? Did they expect that they would start making ukes?
It is kinda crazy that smaller guitar companies feel like they can clone Les Pauls, Strats, Telecasters, etc as if that's not an issue. Is it so hard to make your own designs? Taking someone elses design and making it cheaper doesn't seem like a very legitimate way to compete yet it is the standard in the guitar world.
I really like Gibson guitars but eliminating their competition by suing every guitar company that has similar designs, is really not making them look very good. It kind of makes me want to buy the guitars from the competition.
Why should other companies make money off of copies of Gibson guitars? Gibson goes to the trouble and expense of designing their guitars, marketing them, and having artists play them and then someone is just supposed to ride on Gibson's success without incurring any of those costs??? WTF, man? If they can make a good guitar why don't they have their own fucking designs? Why copy almost perfectly Gibson's design??? I always appreciated Parker and Steinberger, at least they had their own designs and improvements! Now you have everyone and his brother copying Strats and LP's down to the millimeter! Does every car maker pay Ford for every automobile made because they all have substantial similarities? No. There comes a point when certain designs become standard, and are in greater demand. 70 years is *far* more than enough time for return on investment to render the designing expenses complaint completely invalid. Gibson's expenditure on marketing is their own expense that is not impacted at all by the work, products or marketing of other manufacturers as every manufacturer must cover those costs themselves, and take no money from Gibson in doing so. Further, "having artists play them" is far more of a benefit for Gibson than their effort is worth because every time a well known player appears with their product, it is an advertisement for their instruments, and Gibson often gets to use popular players' names to further enhance their apparent prestige. Gibson has earned the position they occupy, but their behavior and quality of workmanship is being surpassed by their betters, and they will either become better members of the musical community or be relegated to history. The choice is theirs to make.

In fact, Epiphone never sold a solid body guitar of any kind until Gibson bought them! And Heritage, which was started by Gibson employees who didn't want to leave Michigan, wasn't going for a "Les Paulish design", they were hoping to sell a Les Paul copy riding on the success of Gibson's Les Paul guitar made in the same factory Gibson left! It's hard to not assume they are trying to bully out the competition. Why spend 2k+ on a poorly made guitar when you can buy similar products for cheaper and better quality? They're simply trying to monopolize guitars of the sort they make to try and force people who like those styles to buy their garbage items. If they had any confidence in their products they'd have little need to try to stop other companies from doing it better for cheaper. If Gibson would lower their prices to something more reasonable and/or make their guitars at a level of quality worth the money they're asking then people would still want to buy them instead of looking elsewhere
You do realize Gibson guitars have ALWAYS been expensive, right? In 1959 a Les Paul was $375. That's about $3000 in today's money. A Les Paul Standard is less than $2000 today....so they are cheaper than they've ever been.
Yes heritage guitars are of much higher quality than Gibson custom shop for sure. And priced very reasonable. Gibson needs to check their qc and make thir guitars perfect if there is such a thing. And even then their prices are out of control. Just my thoughts. Love my heritage single cut its amazing.
I'm a guitar maker and know a lot of smaller luthiers who have been hit with "cease and desist" orders from Gibson. These cases are generally without merit (they're not replicas or even close copies), but the small guys don't have the time and money to fight the Big G, so they simply sigh and discontinue the model or models in question. This rubbish has been going on for years. It's almost at the point where, if you're a smaller US luthier in particular, having one of those "C&D" letters is kind of a badge of honour. It means you're important enough to have attracted their notice. I should also mention that any one of those luthiers probably hand builds amazing instruments with great tone, playability, finish, and general QC standards that leave Gibson in the dust. Often for considerably less money! However, I should also say that many people in the industry are also very grateful to Gibson. Fixing their broken headstocks and awful setups is a major part of the business of any small guitar shop. If Gibson started making decent guitars, all that repair work would vanish.
Gibson needs to sue themselves for FRAUD of the single cut solid body design that carries the Les Paul name. Originally designed by O.W Appleton in 1941. Be Authentic Gibson!

A couple years ago I sold ALL my Gibson products. I'm done with the arrogance and negative bullying. They had all that time to do this and chose not to. Now it just a bunch of venture capitalists ruining the music industry with their hubris.
Yes they did. But they invested in CNC a few years ago. They still do some of the build processes like Gibson used to in Kalamazoo, but then again so do Gibson in Nashville, but a lot of the manufacturing processes of both companies have been modernised.
@@davidburke2132 makes perfect sense, I think I heard that part of the Heritage name was predicated on original location, long time Gibson employees and original equipment. That said going the CNC route and modernization is probably the way stay in the market.
@@GMec78 Heritage at this point do, I would argue, play up to their “heritage” (no pun intended) a bit much, given that the former Gibson employees are gone (certainly as owners and I’d expect pretty much to a man and woman from the production floor too given the number of years that has passed) and their production methods have modernised too. But none of this is to say they don’t make great guitars, because they absolutely do. I’ve owned Heritage guitars (although I don’t have one right now). Personally I think the talk I’ve seen on this chat from a number of people regarding “better than Gibson Custom Shop” is a real stretch, but their guitars are up there with the Gibson USA instruments for sure and they’re pitched at a price point that is invariably a bit lower (as they need to be to get a market share against the bigger name).
Perhaps they shouldn't be selling their guitars at 10x's what they're worth. Oh sure - I know - "It's made in America". Too bad that doesn't carry much anymore. I'd say a large portion of guitars made overseas are better quality-wise than Gibson's. Last new one I tried was an SG Standard in 2017. I never strummed a chord on it, as I didn't have to. The fret overhang almost cut my hands when I ran my hand up & down the neck. I literally laughed out loud in the GC I was in. It was beyond pathetic. Yeah - buy American. I know. But why get f**ked American? I'm not going to do that.
I've got a 2017 Gibson SG standard cherry burst and it's freaking amazing but it's flawless And for Gibson that must be a fluke but my import Dean select series Z is flawless as well and amazing in every way. it's an import so maybe that's why Gibson sued Dean!? I just can't justify spending Gibson prices when Dean is putting out a better guitar at a better price !

(third world country almost now) Then I grew up and realized this country is run and owned by a bunch of greedy pieces of human excrement. Even with all the lies and greed this country did make quality products once upon a time "long gone". I worked union and I worked scab, and those expensive union people, do more harm then good. Lots of companies make Strats and Teles, but Fender doesn't complain. They carry on making quality products that people want with out legal BS. Gibson are getting known for making substandard products and suing everyone who makes anything similar to theirs. Gibson isnt a company I would want shares in. They never complained about people make Explorers etc until recently... are they in financial problems? The only true face of Gibson is Slash... it is a dying company living on old glories.
Hello Max, thank you for your video . I’m tired of Gibson suing one company after another (Kiesel, Dean, ... ) and it is using so much Tricks . I modded a Gibson les Paul copy for better tuning stability and sounds. Started to save money for an original Gibson Les Paul Custom. But now after Gibson suing so many companies I’m gonna find another company . Perhaps with the same scale length.
Go with Heritage. They make great guitars that're worth the money. They're the real thing. They don't have to sue everybody to stay in business they compete by making better guitars. Gibson isn't great anymore
Precision Guitar kits. Get exactly the Les Paul you want with your own preferences splashed in without having to pay custom shop prices. You won't be disappointed.
@@maxwellcohen2917 Kits are only gonna be as good as the person that knows how to build them. Yes, they’re great learning tools but sometimes it’s biting off more than some people can chew on a project. I’ve seen too many times a kit get abandoned because the builder hits a road block. Sometimes they lack a specialized skill set. Other times it’s the financial toll where they can’t finish it because they need an expensive tool that only StewMac sells or some other related reason. It’s not that I’m discouraging anyone to try but rather to know what they’re getting themselves into and be certain that it’s something they are willing to invest time, money and effort into. Or go the GFS kit route. You still have to do some of the work but a lot it done for you.
Gibson doesn't realize that they're suing their customers' favorite brands and retailers, which made them hated by the guitar community. Plus, there are so many quality used Gibson guitars on the market, who needs their ridiculously and arrogantly priced new guitars?
It's probably cheaper to sue than to simply make better guitars. I grew up in a time when Gibson was consistently excellent. And could smile and shrug at the competition. Alas, I'm old....
Gibson used to make great guitars - but after a certain point, they started cutting corners (or something). I bought a nice looking Limited Edition Studio model in 2004 at Guitar Center and came away unimpressed. After 14 years of ownership, I decided to sell it locally. I gave that guitar many chances, played it on-stage at gigs w/ my 80s cover band for 7 years. Finally decided to pull the plug 4 years ago and haven’t missed that guitar at all. Replaced it with a Made in Vietnam IYV Les Paul and even FireFly is making their Elite Les Paul clones that play and sound better than the original brand. I’m not sure what happened to Gibson - or exactly “when” - but they’re definitely far overrated in this day & age.
I’m sorry I’m a little confused I’m going to watch it again and see if I can totally get this. This is important to me due to the fact I live a couple hours away from the heritage factory and I love both guitars. I hate that Gibson has this bully reputation. I was hoping the new administration would stop it but it’s actually worse

The previous regime at Gibson under Henry J. was Gibson’s Golden Era for lawsuits. The current management inherited several in-process lawsuits from the Epoch of Henry J. I’m wondering if this was ultimately one of those suits or was a derivative of one of those older suits.

first as i stated with Gibson vs Dean. No person or company can trademark or copyright headstock or body shapes, pickup colors, finishes and certain graphics like lightning sky, pile of skulls/skull graveyard, i believe it is called the nebula, any variation of swirls, and crackle finishes, All variations of bullseyes, polka dots, pinstripes and stripes including EVH Stripes, all these are public domain graphics, there is a few more but i can not remember what they are right now. But any instrument company can make any shape they want down to being exactly like gibson explorer, flying v's, SGs but like deans which were nowhere close to being like gibsons models, Heritage models are not even close to gibsons models. even if they were exact down to the micrometers of everything still they could not be sued. Because Copyrights and trademarks never was made to protect pickup colors, headstocks or body shapes, they were intended and to this day only protects the brands name such as gibson, dean, etc. and their product/model name such as ML, Les Paul, Explorer, Flying v. That is absolute fact. The trademark and copyright office and the people need to realize this fact. I don't know when people started to think it protects body and headstock shapes and pickup colors as in dimarzios case. but copyrights and trademarks do not protect those things and they are being abused. The trademark and copyright office needs to be completely redone. first go back to when they were properly enforced where songs to claim copyright infringement had to be 99.,99 percent like the original to be able to sue so the songwriter who wrote these boots could not and would not be able to sue Megadeth for their version because it is too different, Iron maiden would not have gotten sued for Hallow be thy name because that was not 99.99 percent like the song the persons suing them claimed and led zepplin would not gotten sued over stairway to heaven again not 99.99 percent like the other song. Now Vanilla Ice would be sued cause that was 99.99 percent like david bowie and queens song. But when it comes to guitar and instrument brands they can only protect their brands name, their logo, their product name/model names only. they can not even copyright or trademark how their product is made. also they to end this whatever the price is now for trademarks and copyrights per year and make it $50 a year for entire music catalogs and songs, brand names, logos, product names/model names or $250 for 10 years. meaning you do not have to go each year and renew them .
This is just ridiculous. You don't see Fender suing other companies for making S-Type or T-Type. Gibson is just mad that everybody else makes their models better than they do. I say we all boycott Gibson and Epiphone and hopefully they'll be out of business soon.
I see your point... but the market is full of Single Cut's that don't get sued. Heritage builds exact copies of the 1950s instruments, from the materials to the exact setups and colors. That's far more than an ESP or PRS Single Cut with their own character...
@@dennisgaca no crap Captain Obvious. It was decided in a court of law that the only part of the guitar that is intellectual property is the shape of the headstock. It was concluded that there's only so many shapes that a guitar can be and fit the human body. Gibson should spend more time improving their quality control instead of suing people that make better guitars than they do. After seeing them drive a bulldozer over hundreds of guitars I will celebrate the day that they go out of business. When they closed down the Memphis Factory they could have donated those guitars to schools and other programs for children that can't afford their own. They could have had a tax write off but instead they decided to destroy them. They destroyed many Firebird X's, many 335s, Les Paul's, and SG's. There are a garbage company and they don't deserve to be in business.

Gibson should really be going after China for their Chibson's that actually infringe on their intellectual property.

Gibson 4K ,HB 250, play both, make your own mind up if the extra 3750 is worth it. Strat style I have a Jet JS400, its like a Strat, but has its own character and build differences and a Fazley Tele style guitar, with a P90 in the neck, 113 GBP, the equivalent Fender would be 10 times that in the UK, I've had 2 Fenders, sold them to people who wanted them, I would buy another Fender when the exchange rate changes, I wouldnt buy a new Gibson.
I'm a proud owner of a Kalamazoo made Gibson Les Paul. It's a great guitar. If Heritage is building them like they did when mine was built, that's a great deal. I haven't found a "modern" Gibson that plays as nice as my old Black Beauty. Heritage guitars get great reviews, so they must be doing something right. I'd be willing to check out Heritage if only to thumb my nose at the folks running Gibson now.

The more Gibson does things like this the more it just makes them seem desperate to hold a place in an ever evolving guitar market. BTW, I like the TAB soda prop. That's living large when it is going for about 10 dollars a can now. Funny how the price goes up on stuff that you can't give away until they quit making it. I used to use Williams. It was the best to get a close shave. Didn’t realize they’d left the market because I used to buy them at that price back in the day. Even boars hair brushes went the way of the dodo… What I wouldn’t give to see them both return.
@@taimaishu-nao1922 There is a fairly large culture of what they call "Wet-shavers" that still use brushes, shaving soaps and either straight razors or double edge safety razors. Am#^on has brushes that are "boar bristle, horse hair and badger fur. There are several TH-cam channels that are dedicated to wet shaving and the equipment used in it. I've been into wet-shaving for at least 10 years now. :)
@@joeking433 I wouldn't say that the guitars themselves are "evolving" they do seem to be stuck in a technical rut, but I would argue with the proliferation of low cost relatively good quality guitars that are being made in many places around the world, Gibson's business model does seem to be holding them back somewhat. JMHO though. They need to decide whether they are going to be an ultimate quality low production volume at a high price manufacturer, or bring their pricing more in line with their competitors instead of bringing lawsuits against them and crying foul all the time.
I wonder if Gibson realise how much exposure they are giving Heritage, basically letting the buyer know that the quality of Heritage instruments is a threat to them. I play Gibsons a lot and all this is making me want to get my mits on a Heritage soon!
I have 3 Gibson models. love them all but Heritage has a better headstock for string guild. Gibson is making lawsuits against companies that are making better versions of Gibson guitars. That shouldn’t be possible. Gibson should be a name brand that no one can come close to copying. They were the best guitars for decades and now they are coming after other companies that match or beat their quality. Side note: I own 6 Gibsons and I love them all but only because i have been a tech and luthier for 12 years and i can put the work into them to make them great.

Two points based on reading dozens of appellate court decisions: Article says Heritage et al. seeking declaratory and injunctive relief with no mention of monetary damages; under US antitrust law(Sherman Antitrust Act) monetary damages awarded are TREBLED by law. Second, this case seem to be at the motion for summary judgement phase. At this point, the judge must presume all well pleaded facts by the non moving party (Heritage) are true. So if Heritage pleads a plausible case that if the facts are true a factfinder (judge or jury) could find in Heritage's favor then the court cannot dismiss. Did FMIC miss the boat on trademarks re: the "S-body" style (i.e., the Strat®)? Everyone & their sibling (except Gibby & Epi) seems to make a S-bod clone. Or has FMIC positioned the Srat® as the pinnacle of SSS & similar double cut aways? FMIC offers several levels - Squier, MUM, MI USA plus premiums (Charvel, Jackson) and ultima thules of custom shop & master-builds. Plus an after market of parts rivelked only by that if the SB Chevy (prob ™ or ®) V8.
Gibson opened the Nashville plant in 1975. Kalamazoo and Nashville operated simultaneously until the mid 80s when Gibson moved everything to Nashville.
Imagine you built seek beautiful cars and everyone wanted it. Then the guys across town build the exact same beautiful car but the tail lights are slightly different. This would not be allowed and car companies protect their designs diligently. Gibson does have a problem with all kinds of companies building almost exact copies of their classic designs. I love all the other brands of Gibson like guitars but it does make sense that Gibson wants to protect what they popularized.

What goes around comes around, I think a few of the bigger companies have forgotten this is about music. Sure everyone has to make a living but handing out lawsuits anytime they want, really? I mean look at the Dean suit, few million spent in court by gibson only to be awarded damages of $4,000 instead of the $7 million they were seeking. That should have been a wake up call for them.

Heritage is where you go when you want an old fashion Gibson made by the same people that made the old Gibsons that were so famous between the 1950s and 1980s. Their quality is still top-notch unlike the guitars sold under the Gibson brand today.

First, I didn’t realize you could still get TAB, let alone that someone still drinks it! Gibson is following the model McDonald’s set. If I were going to lay down a few grand for a single cut, I’d get a Heritage over a Gibson any day.

@@DinsdalePiranha67 HB's cost a lot, about $75, to have them shipped if you live in the US. Fireflys are just as good or better, IMO. The HB I got, the Gotoh SG, had the E string not even going over the pole piece at all, which I haven't seen on even the cheapest guitars. But mine could be an outlier.
@@joeking433 I got one for 100 shipped (unbranded, but 100% the same). Many deals like it if you look around, just be good withj a setup, these arrive as GSO's, guitar shaped objects that need some work to be playable (just like a gibson lol).

They really do! I own three Gibson Les Paul’s with a standard being the finest one. It is really really great, however, I picked up an H150 at a shop to give it a go, and it’s a different guitar altogether. Most people don’t know this if they’ve never seen one in person, but they have the original, correct violin-cut too that’s much more pronounced. This comes from the arching that Gibson used to use when they were in that Kalamazoo factory. Heritage makes very fine instruments!

My Les Paul style guitar is a Tokai, had a Gibson, sold it, its only Boomers who value these relics and are trading on badge snobbery, this litigation is going to come back on them, People who could afford them will go elsewhere, same with Artists and their Lawyers who are constantly litigating against people on Social Media or TH-cam who post covers, we have the Power by boycotting these Companies, the Wold has changed, Guitars from China and Indonesia are now really good quality, a computer controlled router doesnt care where it lives.

While its true that this applies to a lot of "boomers" as you call them if you look you dont see professional musicians using knock offs for the most part. That said these guys are usually using the older Gibsons that are actually worth the cost they pay. What it boils down to, is that Gibson needs to innovate and go back to the days of making products that are worthy of the price and not spend their resources suing everyone under the sun out of fear.
They also need to expand their lines to offer more affordable instruments that the average guy can afford instead of charging boutique one off prices for every unit they produce.

Where exactly did the people running Gibson graduate from business school? IMHO Gibson needs to restructure the head office with actual musicians in charge who will take an interest in fixing the issues their products have, such as the fragile headstocks, and take the company in the direction of quality. you increase quality and offer affordable instruments in every level of the market you will no longer need to sue anyone as the market will shit back in your favor naturally.

Yep, Absolutely right. Gibson doesn't want competition and the "Play Authentic" Weasel has been running with that mentality. Failing QC in comparison to other guitar companies will perhaps force Gibson shut down factories. They were forced to shut down once, it will happen again if they don't mind what little business they have.
At some point Gibson needed to have their market position defined for them. You can try to be king of the hill by shooting anyone who starts to climb, but eventually someone will get up there to challenge you. Looks like Heritage is that someone. Hats off the Heritage 😊

The “lawsuit era” defined that you can trademark the headstock, but not the body shape. This stood until Gibson recently somehow convinced a judge to force Dean Guitars to stop making certain models because the body shapes (like the Flying V) were too similar.
Seriously, screw Gibson. The only guitars of theirs that I even want can easily be found elsewhere with much higher standards of quality without all of the premiums associated with the name on (and shape of) the headstock, AND for less than half the price for the same features.
Yeah its really sad what Gibson did to dean. The V and the Z from dean we're true innovation. The headstock, the binding, the dimarzios the colors, etc... They made those 79 and up dean guitars destroy all!!! I think Gibson pissed off too many musicians with buying power here. Dean really needs to innovate now too. The 6 and 7 string V they designed recently rule the game. Hopefully dean gets smart with great body shapes, innovation and more endorsements!!!! These deep pockets greedy types need to go extinct. Played a Heritage LP in our local shop- if you don’t mind the headstock shape and it not saying Gibson on it it’s a full on win.

I learned about the Heritage guitars when a friend bought one. I didn’t know the company but he told me how the company started and insisted that the ex-workers from Gibson wanted to produce guitars with the same standard of quality as they were used to do before Gibson moved the company. And when I tried his Heritage guitar, I understood what he meant…
While Gibson started to find ways to build guitars at a lower cost, and to lower quality by the same token, Heritage guitars kept the same techniques to build their guitars and the result was that they kept the same quality that Gibson used to have…
This, all day long. They kept most of the old equipment old Gibbys were made on. In effect, they are what Gibsons were, before they went full corporate/commercial.
I just realized that the guitar I tried was surely one of their earlier models because the pick guard was made of wood (in part or entirely, I don’t remember. And it was their semi-acoustic model.
It’s possible that the newer ones are different???
Being from Michigan. If I ever have that kind of cash to spend on a guitar. I would take the Heritage. Not only are they better. But it would be nice to have a guitar made in the same climate it will live in.
But do they have the resale value of a Gibson? That is why people buy Gibsons, they make a good guitars that hold their value better than any other brand. And even with all the jealous guys on social media trying to bring them down they just keep on selling.

Look at how many Strat models are out there. Also, why did Gibson allow Heritage to take over its old location if they didn't want some of their best employees to continue to make guitars? Did they expect that they would start making ukes?
It is kinda crazy that smaller guitar companies feel like they can clone Les Pauls, Strats, Telecasters, etc as if that's not an issue. Is it so hard to make your own designs? Taking someone elses design and making it cheaper doesn't seem like a very legitimate way to compete yet it is the standard in the guitar world.
I really like Gibson guitars but eliminating their competition by suing every guitar company that has similar designs, is really not making them look very good. It kind of makes me want to buy the guitars from the competition.
Why should other companies make money off of copies of Gibson guitars? No. There comes a point when certain designs become standard, and are in greater demand. 70 years is *far* more than enough time for return on investment to render the designing expenses complaint completely invalid.
Gibson's expenditure on marketing is their own expense that is not impacted at all by the work, products or marketing of other manufacturers as every manufacturer must cover those costs themselves, and take no money from Gibson in doing so. Further, "having artists play them" is far more of a benefit for Gibson than their effort is worth because every time a well known player appears with their product, it is an advertisement for their instruments, and Gibson often gets to use popular players' names to further enhance their apparent prestige.

Seems the market only wants Fender and Gibson designed guitars! Every asshole with a CNC machine has to pay tribute to those company's designs in order to make a sale and can't think for themselves! Even PRS, who actually diverted from the Fender/Gibson design a little bit, has it's best seller, the Silver Sky, almost an exact replica of a Fender Strat! It's just sad.
I really respect truly innovative companies like Steinberger and Parker but for some reason they couldn't survive in the guitar market.

It's hard to not assume they are trying to bully out the competition. Why spend 2k+ on a poorly made guitar when you can buy similar products for cheaper and better quality? They're simply trying to monopolize guitars of the sort they make to try and force people who like those styles to buy their garbage items. If they had any confidence in their products they'd have little need to try to stop other companies from doing it better for cheaper.
If Gibson would lower their prices to something more reasonable and/or make their guitars at a level of quality worth the money they're asking then people would still want to buy them instead of looking elsewhere
You do realize Gibson guitars have ALWAYS been expensive, right? In 1959 a Les Paul was $375. That's about $3000 in today's money. A Les Paul Standard is less than $2000 today....so they are cheaper than they've ever been.

Yes heritage guitars are of much higher quality than Gibson custom shop for sure. And priced very reasonable. Gibson needs to check their qc and make thir guitars perfect if there is such a thing. And even then their prices are out of control. Just my thoughts. Love my heritage single cut its amazing.
I'm a guitar maker and know a lot of smaller luthiers who have been hit with "cease and desist" orders from Gibson. These cases are generally without merit (they're not replicas or even close copies), but the small guys don't have the time and money to fight the Big G, so they simply sigh and discontinue the model or models in question.
This rubbish has been going on for years. It's almost at the point where, if you're a smaller US luthier in particular, having one of those "C&D" letters is kind of a badge of honour. It means you're important enough to have attracted their notice.
I should also mention that any one of those luthiers probably hand builds amazing instruments with great tone, playability, finish, and general QC standards that leave Gibson in the dust. Often for considerably less money!
However, I should also say that many people in the industry are also very grateful to Gibson. Fixing their broken headstocks and awful setups is a major part of the business of any small guitar shop. If Gibson started making decent guitars, all that repair work would vanish.
Gibson needs to sue themselves for FRAUD of the single cut solid body design that carries the Les Paul name. Originally designed by O.W Appleton in 1941. Be Authentic Gibson!

Yes they did. But they invested in CNC a few years ago. They still do some of the build processes like Gibson used to in Kalamazoo, but then again so do Gibson in Nashville, but a lot of the manufacturing processes of both companies have been modernised.

@@GMec78 Heritage at this point do, I would argue, play up to their “heritage” (no pun intended) a bit much, given that the former Gibson employees are gone (certainly as owners and I’d expect pretty much to a man and woman from the production floor too given the number of years that has passed) and their production methods have modernised too. But none of this is to say they don’t make great guitars, because they absolutely do. I’ve owned Heritage guitars (although I don’t have one right now). Personally I think the talk I’ve seen on this chat from a number of people regarding “better than Gibson Custom Shop” is a real stretch, but their guitars are up there with the Gibson USA instruments for sure and they’re pitched at a price point that is invariably a bit lower (as they need to be to get a market share against the bigger name).

Last new one I tried was an SG Standard in 2017. I never strummed a chord on it, as I didn't have to. The fret overhang almost cut my hands when I ran my hand up & down the neck. I literally laughed out loud in the GC I was in. It was beyond pathetic.

I've got a 2017 Gibson SG standard cherry burst and it's freaking amazing but it's flawless And for Gibson that must be a fluke but my import Dean select series Z is flawless as well and amazing in every way. it's an import so maybe that's why Gibson sued Dean!? I just can't justify spending Gibson prices when Dean is putting out a better guitar at a better price !

Lots of companies make Strats and Teles, but Fender doesn't complain. They carry on making quality products that people want with out legal BS. Gibson are getting known for making substandard products and suing everyone who makes anything similar to theirs. Gibson isnt a company I would want shares in. They never complained about people make Explorers etc until recently... are they in financial problems? The only true face of Gibson is Slash... it is a dying company living on old glories.

I modded a Gibson les Paul copy for better tuning stability and sounds. Started to save money for an original Gibson Les Paul Custom. But now after Gibson suing so many companies I’m gonna find another company . Perhaps with the same scale length.
Go with Heritage. They make great guitars that're worth the money. They're the real thing. They don't have to sue everybody to stay in business they compete by making better guitars. Gibson isn't great anymore

Yes, they’re great learning tools but sometimes it’s biting off more than some people can chew on a project. I’ve seen too many times a kit get abandoned because the builder hits a road block. Sometimes they lack a specialized skill set. Other times it’s the financial toll where they can’t finish it because they need an expensive tool that only StewMac sells or some other related reason.
It’s not that I’m discouraging anyone to try but rather to know what they’re getting themselves into and be certain that it’s something they are willing to invest time, money and effort into.
Or go the GFS kit route. You still have to do some of the work but a lot it done for you.

Gibson used to make great guitars - but after a certain point, they started cutting corners (or something). I bought a nice looking Limited Edition Studio model in 2004 at Guitar Center and came away unimpressed. After 14 years of ownership, I decided to sell it locally. I gave that guitar many chances, played it on-stage at gigs w/ my 80s cover band for 7 years. Finally decided to pull the plug 4 years ago and haven’t missed that guitar at all. Replaced it with a Made in Vietnam IYV Les Paul and even FireFly is making their Elite Les Paul clones that play and sound better than the original brand. I’m not sure what happened to Gibson - or exactly “when” - but they’re definitely far overrated in this day & age.
I’m sorry I’m a little confused I’m going to watch it again and see if I can totally get this. This is important to me due to the fact I live a couple hours away from the heritage factory and I love both guitars. I hate that Gibson has this bully reputation. I was hoping the new administration would stop it but it’s actually worse

The previous regime at Gibson under Henry J. was Gibson’s Golden Era for lawsuits. The current management inherited several in-process lawsuits from the Epoch of Henry J. I’m wondering if this was ultimately one of those suits or was a derivative of one of those older suits.
The new owners of Gibson could have filed a motion to withdraw the suit if that were the case.

first as i stated with Gibson vs Dean. No person or company can trademark or copyright headstock or body shapes, pickup colors, finishes and certain graphics like lightning sky, pile of skulls/skull graveyard, i believe it is called the nebula, any variation of swirls, and crackle finishes, All variations of bullseyes, polka dots, pinstripes and stripes including EVH Stripes, all these are public domain graphics, there is a few more but i can not remember what they are right now. But any instrument company can make any shape they want down to being exactly like gibson explorer, flying v's, SGs but like deans which were nowhere close to being like gibsons models, Heritage models are not even close to gibsons models. even if they were exact down to the micrometers of everything still they could not be sued. Because Copyrights and trademarks never was made to protect pickup colors, headstocks or body shapes, they were intended and to this day only protects the brands name such as gibson, dean, etc. and their product/model name such as ML, Les Paul, Explorer, Flying v. That is absolute fact. The trademark and copyright office and the people need to realize this fact. I don't know when people started to think it protects body and headstock shapes and pickup colors as in dimarzios case. but copyrights and trademarks do not protect those things and they are being abused. The trademark and copyright office needs to be completely redone. first go back to when they were properly enforced where songs to claim copyright infringement had to be 99.,99 percent like the original to be able to sue so the songwriter who wrote these boots could not and would not be able to sue Megadeth for their version because it is too different, Iron maiden would not have gotten sued for Hallow be thy name because that was not 99.99 percent like the song the persons suing them claimed and led zepplin would not gotten sued over stairway to heaven again not 99.99 percent like the other song. Now Vanilla Ice would be sued cause that was 99.99 percent like david bowie and queens song. It was concluded that there's only so many shapes that a guitar can be and fit the human body. Gibson should spend more time improving their quality control instead of suing people that make better guitars than they do. After seeing them drive a bulldozer over hundreds of guitars I will celebrate the day that they go out of business. When they closed down the Memphis Factory they could have donated those guitars to schools and other programs for children that can't afford their own. They could have had a tax write off but instead they decided to destroy them. They destroyed many Firebird X's, many 335s, Les Paul's, and SG's. There are a garbage company and they don't deserve to be in business.

Gibson 4K ,HB 250, play both, make your own mind up if the extra 3750 is worth it. Strat style I have a Jet JS400, its like a Strat, but has its own character and build differences and a Fazley Tele style guitar, with a P90 in the neck, 113 GBP, the equivalent Fender would be 10 times that in the UK, I've had 2 Fenders, sold them to people who wanted them, I would buy another Fender when the exchange rate changes, I wouldnt buy a new Gibson.
I'm a proud owner of a Kalamazoo made Gibson Les Paul. It's a great guitar. If Heritage is building them like they did when mine was built, that's a great deal. I haven't found a "modern" Gibson that plays as nice as my old Black Beauty. Heritage guitars get great reviews, so they must be doing something right. I'd be willing to check out Heritage if only to thumb my nose at the folks running Gibson now.

Am#^on has brushes that are "boar bristle, horse hair and badger fur. There are several TH-cam channels that are dedicated to wet shaving and the equipment used in it. I've been into wet-shaving for at least 10 years now. :)

@@joeking433 I wouldn't say that the guitars themselves are "evolving" they do seem to be stuck in a technical rut, but I would argue with the proliferation of low cost relatively good quality guitars that are being made in many places around the world, Gibson's business model does seem to be holding them back somewhat. JMHO though. They need to decide whether they are going to be an ultimate quality low production volume at a high price manufacturer, or bring their pricing more in line with their competitors instead of bringing lawsuits against them and crying foul all the time.

Gibson is making lawsuits against companies that are making better versions of Gibson guitars. That shouldn’t be possible. Gibson should be a name brand that no one can come close to copying. They were the best guitars for decades and now they are coming after other companies that match or beat their quality.
Side note: I own 6 Gibsons and I love them all but only because i have been a tech and luthier for 12 years and i can put the work into them to make them great.

Also, it took this storied company you’re defending over a decade to attempt a proper reissue in the early eighties. There had been demand for Standards since the late 60s, yet Gibson saw so little value in this design, they did nothing with it.

Two points based on reading dozens of appellate court decisions:
Article says Heritage et al. seeking declaratory and injunctive relief with no mention of monetary damages; under US antitrust law(Sherman Antitrust Act) monetary damages awarded are TREBLED by law.
Second, this case seem to be at the motion for summary judgement phase. At this point, the judge must presume all well pleaded facts by the non moving party (Heritage) are true. So if Heritage pleads a plausible case that if the facts are true a factfinder (judge or jury) could find in Heritage's favor then the court cannot dismiss.
Did FMIC miss the boat on trademarks re: the "S-body" style (i.e., the Strat®)? Everyone & their sibling (except Gibby & Epi) seems to make a S-bod clone. Or has FMIC positioned the Srat® as the pinnacle of SSS & similar double cut aways? FMIC offers several levels - Squier, MUM, MI USA plus premiums (Charvel, Jackson) and ultima thules of custom shop & master-builds. Plus an after market of parts rivelked only by that if the SB Chevy (prob ™ or ®) V8.

Gibson opened the Nashville plant in 1975. Kalamazoo and Nashville operated simultaneously until the mid 80s when Gibson moved everything to Nashville.
Careful Max, that TAB soda can runs dangerously close to infringing on the Gibson trademark and you too may even get sued.
Imagine you built seek beautiful cars and everyone wanted it. Then the guys across town build the exact same beautiful car but the tail lights are slightly different. This would not be allowed and car companies protect their designs diligently. Gibson does have a problem with all kinds of companies building almost exact copies of their classic designs. I love all the other brands of Gibson like guitars but it does make sense that Gibson wants to protect what they popularized.

Gibson should try making guitars with the same quality as imports. I worked at the Gibson sweat shop in Nashville and they are still making junk.

What goes around comes around, I think a few of the bigger companies have forgotten this is about music. Sure everyone has to make a living but handing out lawsuits anytime they want, really? I mean look at the Dean suit, few million spent in court by gibson only to be awarded damages of $4,000 instead of the $7 million they were seeking. That should have been a wake up call for them.
Yeah but they also got an injunction where Dean can't make/sell the flying V style anymore either, so they got a win that way.

I mean I get it and the copyright but other companies don't do it like gibson, think of fender going after everyone who makes a strat copy just with a different headstock shape, as dean did with gibson. Gibson is the brand which should have faced soo many lawsuits that they wouldn't have bothered anyone in the first place. They think they are own everything even the market and people's love. People should stop buying their products and look elsewhere for greater good of themselves, music and companies. We can attain a better guitar in lower price tiers.
