Funny, we used to live three streets down from Northcliff corner - we left for the UK in 2009 when my wife got pregnant. This is why I did not want to raise my child in SA. She’s now thriving very well in a grammar school and has never heard a gun go off. The best (and hardest) move I ever made.

The law is structured in such a way that you are held responsible for every single bullet that you fire. If you empty your magazine and one of the bullets accidentally strikes an innocent bystander, you are going to regret it in court. That's why gun owners are always advised to get training. So that even if you are angry, you are always in control when holding a gun.

So if you ever decided to shoot a fleeing suspect, you always have to ask your self, is this suspect clearly going to harm someone else within your vicinity? In this security guard's case, the answer is yes. There are two main points that support this answer. Point 1: The suspect was already fleeing even before hijacking the car, and yet he was still willing to fire shots at unarmed bystanders and violently hijack a car. This shows that just because he was "fleeing" did not mean he was still not an immediate danger. Point 2: You could here a lot of squealing when the camera panned away. This indicates the type of driving he performed was a danger to other drivers around that petrol station. He was a threatening people's lives regardless if it was by a gun or by the car he was driving. Also, the fact that the suspect did not survive, will make the case MUCH easier for the guard to beat since he will not be present to give his own version of events. If however the suspect is a known dangerous person and the security guard does not have a shady background, he might not even have to appear in court. The cops would handle the whole process. But if the suspect was shot by a normal civilian, that civilian would definitely need to appear in court justify to the court that it was self defense.

Nope, to me, it sounded like they were exchanging gun fire. If that's the case, he has every right to shoot someone in the back. The law states that "your life or someone else's should be in immediate danger, meaning don't shoot unless you are being shot at". Aside...I can remember when fishermen washed off the rocks used to wash up a week later on the beach and people went to look, and I always wondered why one would want to see this. And I question this integrity having watched this. More importantly to be borne in mind generally and in no particular reference to the above...as people have different toles to play in society however... It is critical to keep away from any accident or crime scene, unless you are a qualified first aider and there is no one else better qualified onsite. There is an exception as always to legal propositions, he has show that the threat for loss of property was still ongoing and that his action formed a single unbroken sequence with the result. There is a case of a guy who was robbed of his bag and he ran 350 metres to his shack to fetch knife and caught up with the robber and fatally stabbed him to recover his bag. This was held to be with the boundaries of private defence.
Plot twist, the guy who hijacked the car couldn't get a job because of the unemployment rate has a kid that's starting his first year of creche and there ain't no food in the house. Nope, to me, it sounded like they were exchanging gun fire. If that's the case, he has every right to shoot someone in the back. The law states that "your life or someone else's should be in immediate danger, meaning don't shoot unless you are being shot at". The shooting will be probed (because the old people in our government like spending state resources on stuff that is clearly justified) and he will get away with a slap on the wrist. However, him discharging his firearm in that manner while the perp was fleeing, now that! is what the pensioners will eat up! That is a terrible experience to have had. Aside...I can remember when fishermen washed off the rocks used to wash up a week later on the beach and people went to look, and I always wondered why one would want to see this. And I question this integrity having watched this. More importantly to be borne in mind generally and in no particular reference to the above...as people have different toles to play in society however... It is critical to keep away from any accident or crime scene, unless you are a qualified first aider and there is no one else better qualified onsite. Particularly in a medical emergency as noise and jostling will only serve to heighten anxiety and stress for both injured and emergency personal. This is kinda a duty of everyone's. Thank you.

I'm defs not against shooting criminals like this, but it is insanely irresponsible and just plain retarded shooting in the direction where there are innocent civilians everywhere around and behind the perpetrator, any of the shots can easily miss its intended target and hit someone at the back. I've seen saps do this as well, like wth, is common sense when it comes to handling guns not a thing?! In that case it's better to let the guy get away with the car that is probably insured and can be tracked down later or to a more suitable area for shooting than accidentally killing a bystander in the process, now the insurance has to pay out for the damaged car anyway and innocent people were in danger of getting shot.
