      disorderly behaviour likely to cause harassment, alarm or distress i.e filming and interrupting a ongoing investigation

    • @Ian-ev5tg
      @Ian-ev5tg 3 ปีที่แล้ว +23

      @@elliotb7980 filming in itself cannot be classed as harassment alarming or distressing. According to the law its an extension of your eyes. So in a legal standpoint, under you reasoning, you could be arrested for looking at someone or something.
      Public order offences also only relate to physical situations and threats of violence. You cant be anti social by standing still with a camera. Otherwise the paparazzi would have been arrested and put a stop to a long time ago.
      Obstruction is also physical. You're not obstructing a police officer by filming. Only by physically getting in the way, or verbally interrupting them speaking to a suspect. He's stood well away from the officer and causing no obstruction whatsoever.
      If you think standing at a distance and filming is disorderly you must be a snowflake.
      Likely to cause alarm harassment and distress only means to a member of the public. The police in their official capacity can't use those as a personal feeling. For example of I'm swearing at a police officer, and no other member of the public is around. They can't arrest you under section 5 as the officer can't claim they were alarmed harassed or distressed by it.
      Same situation and 1 member of the public are around. The officer would need a statent from them to say they were alarmed harassed or distressed.
      If a crowd were there and could hear, only then is is reasonable to assume that some of them may be alarmed harassed and distressed.
      So get you law right before you comment on what you don't know

    Actually, he is. He's collecting evidence of how the police treat people who are asking perfectly reasonable questions in regard to why they're being detained.
    Note how she moves around in an attempt to block the camera.
    'Arrested for a public order offence?' I think not. Sheer lack of evidence, for one thing. The camera never lies. Observing the police is in no way a, 'public order offence', and neither is questioning them on their conduct whilst on duty.
    They love using the old, 'suspicion of', excuse to arrest people, then, once they get them to the station and there's no evidence to back any of it up, they release them without so much as an apology. All done purely because they don't like the, 'look', of someone. If the police had to prove the suspicion of a crime having been committed at the scene, they wouldn't have a leg to stand on, most of the time. The fact that they released them here is still no excuse for detaining them without proof of having committed a crime. Common assault and false imprisonment. The reason the police do this is because people are largely ignorant of the law and they know that the majority of the time, they can get away with it.

    I’m glad these guys quickly realised that you filming them was beneficial for them. Unfortunately this rot has now become embedded into the police force in this country and they believe they have a free pass to abuse their position whenever they feel like it without ever being held accountable for their actions.

      What do you mean "in this country"? Do you seriously think it looks different in other countries? Believe me it does not. In some it's even worse and I'm really surprised people aren't fighting back in there yet. It will slowly become as bad in the UK, too. I have no doubts.
