I agree with the ruling, the lady didn’t give the defendant enough time to makeup for her no show and got nasty real quick. She tried to get the defendant evicted and her business license suspended, effectively taking her livelihood.
I don't blame her for canceling the contract, her lack of urgency & professionalism may have come through at the party. Her missing an appointment at her home shows she has poor time management (CPT), but the plaintiff should have taken the partial deposited return & not gotten so vindictive (bad karma).
In this case, I think the plaintiff should've won. The defendant screwed up the appt. And why would you think you deserve the deposit when you know you did nothing to earn it and your client is unhappy?
It doesn’t matter if the initial appointment was missed, the plaintiff was the one that breached the contract. She cancelled the whole contract when her grievances could have been resolved. The resolution for the unhappy client would be to give the defendant a chance to remedy the situation. Legally, the defendant did nothing wrong 🤷♀️
Deposits are usually non refundable. When you pay a deposit, you’re not paying for a service. You’re paying to make the service available to you on a certain date. The plaintiff was basically paying to be placed in the defendant’s calendar for catering services

Unfortunately, I have heard this comment too much from people in my community. As soon as one black person does something that the other black person doesn't like, they blame the entire black community for one person's screw up. Defendant is completely unprofessional. First, if you are a business owner, keep track of your appointments! Second, had that happened to me, I would have immediately apologized profusely and offered to leave my event right then and meet her in 10 minutes. If that was impossible, then once you get home you immediately contact the client, apologize profusely again, and make an effort to set up another meeting as soon as possible. The fact that not only did she never apologize, but then she made no attempt to contact her afterward, is utterly unprofessional. It almost seems like she took the deposit with the intention of not doing anything and then ripping the client off. I hope all of her potential future clients see this video to know what kind of a person she is.
In my opinion I don’t agree with the ruling. The defendant showed her inability to be punctual and professional. How could she be reliable for a huge catering job ? The plaintiff should’ve gotten the deposit money back to be able to use it for a more professional business.

I think the plaintiff proved the defendant was unreliable, it’s just her conduct after that soured the judge. A person that didn’t show or respond in a timely manner for a meeting the first time would give any customer doubt about hiring. Defendant had the deposit, it was her obligation to reschedule her missed appointment !

For church people these ladies were very mean, i would always support small black owed business, my son has his own business, the thing about having your own business is that you need to know how to treat people and how to talk to people and how to treat everyone with respect, instead of trying to pull the rug from under some one your going to run into a tuff customer but you do your best to work it out🤗

Unfortunately, this has been my experience as well when patronizing black businesses. Yes, unprofessionalism occurs in other races, but I have experienced it quite frequently with black businesses. In fact, I am experiencing it now. You can't dismiss people's experiences just because you don't like it. It's a real thing.

It’s y’all in the comments trying to be dense. Be real or be quiet - there is a need for customer service training in the black community. We always scream “support black businesses”, and many of those businesses turn around and are rude, have inconsistent/changing hours EVERY DAY, don’t communicate, show up late with no concern and charge you extra if you breathe too hard during the appt, ETC…. It’s not all, but it’s TOO MANY!!!! Yea, WE KNOW not all businesses of other races are perfect, but I don’t care about them because I care about MY PEOPLE doing better. I understand how it sounds but at the end of the day anyone who’s actually black knows that within our community, we try to support each other, and our businesses all the time, and we tend to spit in each others faces, and not provide the same level of service that we would the white man. We’re not the only race that doesn’t have good service sometimes but there’s specifically a big problem in the black community with how we treat each other when it comes to business or and how we act when we’re in charge of a business. I go out of my way to support Black owned businesses. If I encounter issues, I instinctively give them more grace, but I am just as intentional about my expectations as a consumer as I am with any other business. If things go wrong, my criticism is based on that business and not Black businesses overall.

The cancellation of the meeting was not fundamental to the non performance of the agreement. Even before that the plaintiff unilaterally cancelled the contract meanwhile the defendant didn’t act in bad faith by any way.
I'm not sure what the phone issue was. Sounds like I would have made the same mistake because I have no clue what she was talking about on the text messaging, and I do type a lot of text messages. After that interaction, it sounds like even though the defendant had already turned down two parties for that date, she was offering to return a portion of the down payment to the plaintiff. Instead, the plaintiff decided it was time to start making a racial remark about black owned businesses, then pulling out the big guns and making out and out threats! I stand with the defendant! Despite the fact that the plaintiff had no valid reason to drop out of their verbal contract, the defendant had had enough! The milk of human kindness dried up when the threats and the racist remark started. She would not return the deposit, rightfully so.

Retirement parties are very common. Sometimes people throw it for themselves (if they want it a certain way), sometimes your company throws it for you, and sometimes someone else throws it for you.
Sometimes our ppl can be a little difficult to do business with. Most black businesses requires a deposit. There's a black owned car wash that requires a reservation deposit in MD.
I think this case was odd in that there isn't a universal rule that deposits are NON refundable. Deposits come with all kinds of rules each individually write specifically to the business. The defendant wasn't out any money for party planning that hadn't even started. I feel like Judge M, just didnt like that the plaintiff said what she said about doing business with black people and calling BBB. It is her right as a consumer.

WHAT? The defendant breached the contract when she didn't show up for the appointment, so why does she get to keep the deposit. If she doesn't turn up for a simply appointment the plaintiff had every right to lose faith in her and thus cancel and get her money back. And if the defendant is not conducting a business out of her apartment, then she has nothing to worry about with her landlord. The judge is off her game with this verdict...
Because the plaintiff didn’t say right then and there that she didn’t want her business anymore she made an agreement to meet later on so that amended the original agreement

It’s y’all in the comments trying to be dense. Be real or be quiet - there is a need for customer service training in the black community. We always scream “support black businesses”, and many of those businesses turn around and are rude, have inconsistent/changing hours EVERY DAY, don’t communicate, show up late with no concern and charge you extra if you breathe too hard during the appt, ETC…. It’s not all, but it’s TOO MANY!!!! Yea, WE KNOW not all businesses of other races are perfect, but I don’t care about them because I care about MY PEOPLE doing better. We have to hold ourselves accountable so we can progress and be a community. I’m not spending my $ anywhere it’s not appreciated.
I understand how it sounds but at the end of the day anyone who’s actually black knows that within our community, we try to support each other, and our businesses all the time, and we tend to spit in each others faces, and not provide the same level of service that we would the white man. Let alone provide good service at all, sometimes. We’re not the only race that doesn’t have good service sometimes but there’s specifically a big problem in the black community with how we treat each other when it comes to business or and how we act when we’re in charge of a business. It’s not all of us, but I honestly feel like it’s one of those things that if you’re not my skin color, you just could never understand because you won’t experience it because you’re not a part of the black community.

I think the judge had this case wrong her no show to the appointment was the buisness owner canceling there verbal contract first and client should of asked for refund then not have waited as she was justified at that point that she's unreliable and has no care! She should of not of worded it the way she did or excuse her no show on appointment and she would of won. It pays to not be nice especially when it's a buisness deal.
Just because you’re justified in canceling the contract doesn’t mean you get your money back. Deposits are paid to hold your spot in the person’s calendar. They’re not for the actual service

I have to side with the plaintiff despite the law. The way the caterer mishandled the meeting and the scheduling follow up is a sign of sloppy business practices. I would have canceled her out too. 👀
She keeps denying to refund a deposit when is not in a contract, the other day the dude outside said something about “the law abhors a forfeiture” and they have to return the deposit if it’s not specified. Which one is it?

I go out of my way to support Black owned businesses. If I encounter issues, I instinctively give them more grace, but I am just as intentional about my expectations as a consumer as I am with any other business. If things go wrong, my criticism is based on that business and not Black businesses overall.

The cancellation of the meeting was not fundamental to the non performance of the agreement.
Even before that the plaintiff unilaterally cancelled the contract meanwhile the defendant didn’t act in bad faith by any way.
I'm not sure what the phone issue was. Sounds like I would have made the same mistake because I have no clue what she was talking about on the text messaging, and I do type a lot of text messages. After that interaction, it sounds like even though the defendant had already turned down two parties for that date, she was offering to return a portion of the down payment to the plaintiff. Instead, the plaintiff decided it was time to start making a racial remark about black owned businesses, then pulling out the big guns and making out and out threats!
I stand with the defendant! Despite the fact that the plaintiff had no valid reason to drop out of their verbal contract, the defendant had had enough! The milk of human kindness dried up when the threats and the racist remark started. She would not return the deposit, rightfully so.

The defendant didn't apologize the way people thought she should but she did apologize and I don't condone the way she handled everything but the plaintiff is the one who should've reached out since she gave another time. I would also think that since she said later in the week, then that means you'll let me know what date. And I'm sure she already knew deposits are non-refundable, that is definitely by default whether you sign something or not. She probably would've gotten her money back, without even having to come to court if she didn't resort to bullying and racism lol.

My aunt threw my moms retirement party. But at my job we usually do a little potluck for whoever is retiring.

Retirement parties are very common. Sometimes people throw it for themselves (if they want it a certain way), sometimes your company throws it for you, and sometimes someone else throws it for you.

Sometimes our ppl can be a little difficult to do business with. Most black businesses requires a deposit. There's a black owned car wash that requires a reservation deposit in MD.

I think this case was odd in that there isn't a universal rule that deposits are NON refundable. Deposits come with all kinds of rules each individually write specifically to the business. The defendant wasn't out any money for party planning that hadn't even started. I feel like Judge M, just didnt like that the plaintiff said what she said about doing business with black people and calling BBB. It is her right as a consumer.
Judge Milan didn't care about her making negative statements about black businesses. That's all for television. I've watched this program enough to know that.
