How to Negotiate Your Plea Agreement

- This video discusses the options for negotiating a criminal plea agreement or a plea offer. It is for those people who do not particularly like the first plea offer and are unsure what to do. Most people ask, what can I do if I do not like the plea offer or agreement? The answer is: you can negotiate. Not all plea offers are negotiable. However, you have nothing to lose.
I was arrested for assault 120.00 (a misdearmenor in NY) for the first time this year; l took a plea to a violation which is not a crime; all l had to do was pay a $250 fine & the case is sealed & dismissed in 1 year.⚖
We have a trial coming up soon and had been offered several pleas which were rejected because my spouse will not admit to doing something they didn’t do. But recently they offered to dismiss the charges (which happen to be very serious felony charges) but there are stipulations such as a protective order for the person who made the accusations to include a protective order against your spouse as well who no charges or anything have been made against your spouse? So how can they include me in their offer when my spouse can not answer for me and I haven’t been charged with anything.
Which if I understand correctly, my spouse would not be able to get their guns back that the police have had in “safe keeping” for the past 3 years, which I feel is unconstitutional because if they dismiss the charges then they need to make things right as far as my spouses background and give them their guns back so they can protect themselves and the family, but I am not an attorney. But, To me, if they are willing to dismiss the charges then they should dismiss them without any stipulations but what do I know. We are still set for trial unless they dismiss/drop the charges with prejudice and no stips except to make things right regarding my spouses background as this whole things has almost ruined us financially.
Some plea deals do not have to be negotiated

What if the public defender forgot he received the plea from the prosecutor and held it for 4 months, Gave it to the defendant 2 days before court and gave him incorrect sentencing guidelines during a 2 minute conversion before court. The judge did not even question who held the plea. She just told the defendant to sign anyway or get more time. The prosecutor jumped in and accused the defendant of holding up the court. The public defender justv sat there and did nothing to defend his client. It seemed very unfair. It was a 7 to 10 year plea...The defendant was asking for a new lawyer due to a conflict of interest. The public defender lost his daughter to a drunk driver and the defendant was accused of dui. The judge denied it. Its very evident Judge and Prosecutor are working together. The judge was horrible to this young man. Would he have any recourse after that?

If your lawyer is throwing your case you may have no choice. I see it all the time.
