    If an attorney can argu before SCOTUS that an inanimate organization can be determined to be a "person", we can surely find sentient living animals are worthy of living their lives in health.

      The court never ever should have assigned rights to corporations that would fall under human right this is truly the radicalization of the right-wing Court to give the top 1% all the power in this country it's freaking ridiculous. And if you look at when they did it it was right after Obama managed to collect a billion dollars in small donations. The Republican party is taking all the money from their constituents feeding it up to the top 1% stealing from the poor and giving it to the rich and the courts have permitted this. It's just like the Second Amendment. In my opinion The Constitution's pretty cut-and-dry in this an article 18 gives Congress the right to regulate militia. But because Congress had that right they added the Second Amendment to say hey you can't touch the guns of militia from any state that's why it clearly states and this is a quote guys a well regulated militia being necessary to the security of a free state the right of the people to keep and bear arms shall not be infringed. Well regulated militia meaning that you could have a militia i e the National Guard of each state where the executive the governor appoints the officers this also is in the Constitution. So very simply put the states were allowed to keep arms so that they could be not be attacked by another state without its population being able to defend that state. But the Supreme Court for some reason they're brilliant said okay we're going to get rid of the first line we're going to get the rid of the last part or are the security issue and we're just going to say everybody has a right to have a gun. So to conclude conclude if they actually pass this and a Pitbull eats a baby you will literally have to go to court to sentence that dog to death are you kidding me!

      A noun is a person, place or thing.

      As I mentioned, Jane Goodall is vegan. Other intelligent, widely admired people who chose not to eat meat- Pythagoras, Socrates, Leonardo da Vinci, Voltaire, Newton, Benjamin Franklin, Nikolai Tesla, Albert Einstein, Gandhi, Albert Schweitzer, George Bernard Shaw, Tolstoy, Thoreau, Saint Francis of Asisi, Nobel laureate and holocaust survivor Isaac Bashevis Singer, and many more. Some on this list switched late in life, but stayed on it to the end. Ben Franklin switched at age 16.
      "Nothing will benefit human health and increase chances for survival of life on Earth as much as the evolution to a vegetarian diet." -Einstein (Of course today, he would be vegan. So would the others on this list.)
      The famous Professor of Physics Brian Greene is vegan. You may have seen him on PBS hosting science shows for the layman. Greta Thunberg is vegan. Jon (Daily Show) Stewart is not only vegan, he owns a farm animal sanctuary! Wikipedia has a much longer list of vegetarians and vegans.

      I'm not saying its intentional, it just happens in the course of their trying to make a meal out of those other animals, that's all.
      Seems to be the natural order of things, so to speak, so who are we humans to question that natural order?

    Martha Nussbaum is correct! All sentient beings have a right to live out their lives as the being they are. It is preposterous that we humans are more intelligent than other animals. Really? If we are so intelligent then why are we destroying our planet, creating wars against other countries, and so on and so forth. I can imagine a world where we respect and coexist with all living beings including our sacred mother earth. "Open Mind" is a wonderful idea and series, thanks, Ari!

      I believe that other animals should have as much right to live their lives on this planet as humans do, and these rights should be respected.
      So while we shouldn’t respect animals for the benefit of humans, I think if we considered the effect of our actions on the habitats of other animals, humans would also benefit. We’d have cleaner water, cleaner air, and our habitats would be more in tune with nature and healthier for us. We humans do so much harm to ourselves when we consider us to be separate from the animal kingdom. Beneficial natural habitats are as critical for us as for all other animals on the planet. So many of our habitats and habits are unnatural, but in contemplating what other animals need to thrive I hope we realize how much their needs and ours coincide.

That will benefit both actually, for instance if we weren't bringing billions of land animals onto the planet every year, we could give the grain and water consumed by these animals to the 45,000 people who starve to death *every single day*. 😥

    i appreciate this presentation. glad it's gotten its own coverage, instead of just the usual brief mention. for some people this is not a revelation. there is no need to ascribe 'human' qualities or 'intelligence' to non-human animals to determine if they are worthy of rights. they ALL have rights to be who they are with no scientific investigation. it's just humans that mess this up.

      @KING CONDOM III Being allergic to an animal is not the same as hating the animal. I can't eat gluten. I don't hate gluten products. I am not a 'bird person'. I don't have any birds in my home. I still appreciate the birds. I like to see them. I don't want to see them hurt. I don't compare people I don't like to birds.

    corporations are not people!!!
    a corporation can not be sent to prison
    a corporation has an entirely different tax status and regulations
    since they exist in different realities, they are not the same

    As a wildlife rescuer this is the best story and would hope it was adopted all over the world. If we don't speak up for animals they have no hope cause they can't speak for themselves. Everyone and everything should have rights. Thank you for this program.

      I have a thing against rodeos. I have seen a movies where they rope them from the neck and throw the calf in the ground for points and money I guess! I hope someday people stop doing that for entertainment and price money!

It's all part of the animal agriculture industry--teaching people to see animals as objects who are there for people's pleasure, be it the pleasure of this so-called entertainment or the pleasure of their taste buds.     If a corporation can be called a person, why not a living breathing being who helps people in all situations, for the blind, for people with other disabilities, for veterans, for protection, and of course companions for families and their children who learn how to care for them which teaches them how to care for themselves and their fellow citizens.

    That's why I'm vegan.
    Once you realize the hypocrisy of loving and living with some animals, and then paying other humans to forcibly breed, commodify, torture and then slaughter others.. at the same time realizing that you've always known that animals have their own personalities just like we do you realize maybe for the first time that the survival instinct is an absolute imperative in every living being and the animals want to live and be loved and feel safe and not live in fear and pain~just like us.. And that is when you do everything you can think of not to contribute to any of that torturous, inhumane cycle anymore.

      What we need is an Ameglian Cow, like what Douglas Adams wrote about:
      It appeared in the television adaptation of The Hitchhiker's Guide to the Galaxy in the second novel, The Restaurant at the End of the Universe, and in the sixth novel, And Another Thing...
      The Ameglian Cow (also referred to as the Dish of the Day) was one example of a race of artificially created, sentient creatures which were bred to want to be eaten.
      So yeah, that's what we need and then we can finally sidestep all of these annoying questions once and for all!

    I believe animals do experience pain I saw a pig sacrificed when I was a child and I still remember how scared the animal was I am a vegan because of that experience I felt the animals pain and I have no words to describe what I felt sad very sad 😢

      I used to have a pet chicken. When I got home, I would go out back and when she spotted me she would come running as fast as she could, I’d open my arms and she would run into my arms for a long hug. I stopped eating chicken bc of her and stopped eating all animal products soon after. She was a beautiful soul ❤

    Reminds me of an interview I heard years ago with our former Australian High Court Justice Michael Kirby where he predicted that animal rights and animal justice would soon become among the most significant social change since the likes of LGBTQ rights.     We hold these truths to be self-evident, that all sentient creatures are entitled to certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.
    Maybe it's time for an update.

    Note to Professor Nussbaum: Cuttlefish, octopuses & squid are all molluscs. They are very intelligent & participate in highly sophisticated visual communication including lying. Something that we can argue displays a 'theory of mind.' An example: A male squid will display interest - "Hello baby." - on the side of his body presented to a female of interest, while showing disinterest or aggression, to other males on the other side of his body. Pretty sophisticated stuff! 😉

    Yes Ari. I completely agree that we are failing at protecting the animals we share the planet with. All we have to do is look at the ever growing list of endangered species. It's all our doing and all within our ability to reverse. But I don't know if we can get there. I mean we can't even seem to agree on something as fundamental as the consistent destruction of our planet with fossil fuel.

    I'm going with sentience as a cutoff point. If an animal can express some variety of interiority, sense of presence, recognization as self as different from their environment, and acknowledgement of surroundings that can be communicated to each other, are important as markers. Every day we see/hear about animals grieving, showing affection to one another, protect one another, show fairness toward one another, recognizing oneself in a mirror. They have some higher order of thinking and that's important! As Peter Singer asks, "Can they suffer?" Can they understand the passage of time and that the pain can cease? Important questions.

      Even earthworms have been shown to respond to the companionship of other earth worms. Plants do better when they are loved and talked to. It's going to be hard to pass laws about something so spiritual, but let us try any way.

    Animals are sentient beings with a soul. I get it. I became an animal advocate and vegan about 6 years ago. My life feels more fulfilled.

    Unfortunately, we do not have meaningful laws against cruelty to farm animals. Whatever weak, scarce laws there may be are not enforced. A lot of cruelty to farm animals is perfectly legal. such as cutting off body parts without anesthesia. If someone treated a dog the way farm animals are routinely treated the person would be arrested.

    The State of Arizona has rights for animals. A report of animal abuse is investigated by Police. If abuse is proven the person is arrested and they are tried, and many times, they're given jail time the animal is rescued and given a new life.

    I don't believe in pet ownership, but I accept dogs as terrific pets. I'd like to see our species stop attacking animals, and their habitats. Stop attacking knowledge of the natural world. Being wise is a noble life goal.

    This woman is empathic but biased. Cultures do still eat whale meat. Norway, Iceland, Alaskan cultures and Japan.
    Birds are only birds? Corvids are problem solvers.
    Octopus are mollusks. They can feel pain. They are also problem solvers. Their physical structure allows them to do amazing things.
    She kind of slid right past the animals we eat. Pigs are as smart as dogs.

    Kids need to learn how to respect animals from other humans who respect them. Not sure laws can do that very efficiently. But I support animal rights, fully. When I was a child I was lucky to have a grandmother who adored animals. I learned, very young, that animals are "people" too. Better people than most people, really. It's no secret that kids who torture and abuse animals will go on to do the same things to humans they perceive as "lesser than" themselves when they become adults.

    It would behoove us to value the animals we share the planet with; value, cherish, respect. Cruelty to any animal is wrong. We need to protect their habitats, set aside land for them, to live sustainably with them.

    This makes me think of a comment from Neil DeGrasse-Tyson about man talking to aliens. We share 98% of our DNA with chimpanzees but we can't hold a conversation with one. How could we possibly talk to an alien being?

    Another argument that can be made for more reluctant people is that animal protections like sentences for pet murder help to protect humans too. In many abusive situations, pets are used as leverage to force the victim to stay, because they can’t bring them with them to shelters. If you could be charged for the same sentence you’d be charged for murdering another person, then that could protect the pet or at the very least, land the monster in jail so that his other victims are safe.

    Well done for opening your new series with this topic. I thought the opening segment, when Ari highlighted historic social changes which seemed unthinkable at the time, was well done and did prompt viewers to consider the issue with an 'open mind'. I would have to argue though with Ari's comment that animals are protected by law and the implied suggestion that what Prof Nussbaum was proposing was over and above this. On the contrary, most animals (for instance, farmed animals) are not protected and need laws just to ensure their right to life and respect. What is being proposed isn't extreme, it's essential.

    This conversation is altering my brain chemistry. Humanity has caused regretful extinctions, so "adverse impacts" is not hard to understand. What is immoral abuse of animals is in eye of beholder. Expect howling disapprovals from hunters, meat industries, etc., inflicting horrors.
