It always amazes me how little law enforcement/security know about what is public and what is private, never mind their absolute ignorance of the US Constitution.
The first guy tried to be somewhat polite before mentioning the police, but the rest of them are just used to the convicts doing exactly what they want. They’re not used to dealing with anyone that defies their authority.
Public right of way is the proper term. Easements are for specific uses over private property. The public right of way is fee simple, meaning it’s owned by the state DOT or the county or town. Regardless, you’re right, he’s definitely not on prison property.

Agree. The right of way for a major two lane road in reasonably level terrain is usually in the range of 60’-75’ from the center of the roadway. I really doubt the 33’ cited by the photographer is accurate. A 33’ right of way sounds more like what is typical for a railroad right of way. I worked as a highway designer for 44 years. I realize each state has their own guidelines though.
If it’s a state prison on a state road then it’s all state property. The only difference is that one is a traditional public forum and the other is a limited public forum - but it’s all public property.

They don't. They were defined with regard to establishing reasonable restrictions on the verbal expression of free speech, and that is the only context in which they have ever been applied. They are not relevant to a right to be somewhere, or a right to take pictures from somewhere, or indeed even to other expressive forms of free speech such as holding a sign or wearing a T-shirt with words on it or anything like that. They just allow for some reasonable restrictions on VERBAL free speech in the interest of keeping the peace, protecting a schedule, interrupting or otherwise disturbing an organized discussion, etc., etc., etc. I've seen people try to say that a person can't freely take pictures in a certain place because it's only a LIMITED public forum. Those people are wrong.

Hey, retired photojournalist here. I worked mostly in the Los Angeles County area. You should absolutely NEVER leave the scene if you know the cops have been called on you. Doing so makes is easy for whomever called the cops to lie about what you did, claim you were on private property or make up all kinds of stories, and then claim you fled the area to avoid arrest. And cops will write that in their report and assume it's true. Even if you are done with what you are doing, inform those who called the police that you now have to stay until the police arrive. And, if you ever get charged for anything, in court the prosecutor will absolutely claim the fact that you "fled" the scene is proof you are guilty. Gotta protect yourself. Also, there are no credentials required to operate as a journalist. News media members, citizen journalists and all citizens have the exact same First Amendment rights to record in public. Stop engaging these bafoones in arguments, simply be informed and stand on your rights. You don't have to tell anyone shit or in any way justify you exercising your first amendment rights. ANYTHING you can see from a public space or somewhere you are legally allowed to be is open to being photographed or recorded. If they want privacy they have to create it by hiding it from public view. And, if you walk up to a publicly accessible window you can absolutely shoot through it and anything sensitive on the other side is the duty of the workers to protect, not you.

He can get more from Google Earth than what he is seeing from where he is at. Besides even if the prison was private property, he is on public easement. And you can not stop him from recording here. If the officer that responds knows the law then maybe you won't be named in a Civil Rights lawsuit. If he doesn't both you and his department will be educated in an expensive way.
And once again they have absolutely no idea what "private property" means. (If something is private property, it has a private owner. Either a citizen or a private company. The government cannot own private property by definition. Everything owned by the government is public property by definition. They are confusing "private property" with "restricted access area", which is a completely different thing.)

I have worked security for public events, private business, and estates. The photographer, standing in the street, may be questioned to determine mental state. If he appears sober and sane I.D. may be requested. If the photographer refuses I.D. either police or security can stand by him. The issue is whether police or security has available officers to monitor the man and his actions. This is about it, until a law is broken or trespass occurs it's a stand off.

These are some of the stupidest I've witnessed. They have zero authority where your standing. Actually it's your right to enter the check in lobby.
I have worked security for public events, private business, and estates. The photographer, standing in the street, may be questioned to determine mental state. If he appears sober and sane I.D. may be requested. If the photographer refuses I.D. either police or security can stand by him. The issue is whether police or security has available officers to monitor the man and his actions. This is about it, until a law is broken or trespass occurs it's a stand off.
