      The road isn't adopted by the council, but there aren't any signs indicating it's a private road, so it is publicly accessible. To any reasonable person there is no indication that this is a private road, so the public will follow public highway rules.

      D Y They hanged German and Japanese war criminals. Our war criminals are good guys and thus the Nuremberg Defence is inapplicable.
      Our government has decided that international law and UN Charter doesn’t apply to us either. This mindset filters down to corporate bullies who think they, too, are immune from scrutiny and accountability.

    well capita seem to think it's ok to film on your private property, when they knock on your door for tv licence enquiries. It's time the public start advising the "goons" to remove their cameras when accessing our private property.

    If the man's telling the truth about protecting young and vulnerable within the site then there Disclosure and Barring service bill must be astronomical unless they make every employee pay for their own, assuming of course that everyone on the site has been checked.

    Fantastic video! I love the way you are prepared for an argument and you aren't afraid when security outnumber you or try to turn things up a notch.
    Often when photographers go out to take pictures it's a peaceful activity done in a person's spare time for enjoyment, they aren't looking to upset anybody and they aren't prepared for any kind of conflict. Conversely, security guards do a lot of sitting around staring at the walls so as soon as they see a photographer it can be the most activity they see in a week. Afterwards, between many cups of tea and digestive biscuits, they'll fill-in some forms and tell their supervisors about the situation in great detail to create the impression they're not lazy and are passionate about keeping the site 'safe'. For several weeks, when they're at the gate they'll be telling people stories about the photographer they once harassed with great pride as they try to create the impression their job is varied and interesting. Meanwhile when they get home after work their wives don't talk to them and the dog sh*ts on the carpet.
    Security aren't usually employed for their customer service skills or diplomacy (or intelligence...or good looks) and you have the strength of character to stand up to them. I imagine you are able to handle yourself too if they ever try any of that 'reasonable force' nonsense.

    I noticed a couple of these security do not have their SIA id on display while they are working? That is a big No! No! and they are actually committing an offence by not having it on display. I then noticed at least one of them suddenly had his on display when the cops showed up lol. Well done Marti!

    If you are on private property trespassing and refuse to leave upon being asked, you are interfering with a legal activity. This means your trespass becomes aggravated trespass... and is an offence you can be arrested for.

    It is a private place but the public has access through an implied right of entry because there are no barriers. If there is a public path or right of way across private property the public have every right to stay on the path and take photos etc. If on a private area that does have public access, not a public footpath, the owner can withdraw that permission and tell you to leave.

      Marti Blagborough Yes of course. The police have no right to involve themselves. It is not their duty to eject trespassers either unless crime has been or is being committed. If a trespasser refuses to leave the land ,it is not a Constable duty to assist the land owner to do so. The owner may yes reasonable force to eject a trespasser. The owner can ask police to stand by to prevent a breach of the peace. This would occur as soon as the trespasser resisted the landowner ejecting him. The police can then arrest the trespasser. They then should remove him to a distance or place where there is no likelihood of a recurrence of a breach of the peace and release him. If the trespasser persists and continues to cause a B.O.P the police might take him to a police station and issue a summons to appear before a court to be give reason as to why he should not be bound over in a sum of money to keep the peace. In some circumstances the police can keep him in custody to go before the next court sitting. The police ,sadly,in too many cases do not know this.

    i would wager that part of the agreement that company made with the government, to be able to build on that site, was they had to keep a public access. The government side meant public access as the law does, while the company see it as public can come as long as they omly do what we like.
