55 Intimate searches
(1) Subject to the following provisions of this section, if an officer of at least the rank of [inspector] has reasonable grounds for believing-
(a) that a person who has been arrested and is in police detention may have concealed on him anything which-
(i) he could use to cause physical injury to himself or others; and
(ii) he might so use while he is in police detention or in the custody of a court; or
(b) that such a person-
(i) may have a Class A drug concealed on him; and
(ii) was in possession of it with the appropriate criminal intent before his arrest,
he may authorise [an intimate search] of that person.
(2) An officer may not authorise an intimate search of a person for anything unless he has reasonable grounds for believing that it cannot be found without his being intimately searched.
(3) An officer may give an authorisation under subsection (1) above orally or in writing but, if he gives it orally, he shall confirm it in writing as soon as is practicable.
[(3A) A drug offence search shall not be carried out unless the appropriate consent has been given in writing.
(3B) Where it is proposed that a drug offence search be carried out, an appropriate officer shall inform the person who is to be subject to it-
(a) of the giving of the authorisation for it; and
(b) of the grounds for giving the authorisation.]

@@macsmith6216 It's endemic. Here's what needs to be done. Those that watch other officers screw up need to lose a months pay and pension. For the second offence, 2 months. Third time, 4 months. fourth, 8 months. Each time they stand by, the loss of pay doubles.

YES - As far as I am aware,... the procedure for 'suspicion' of 'hostile reconnaissance' (or any other) under the Terrorism Act,... is to inform an armed response unit to deal with the situation & not get involved.

There is usually no need for court, NOTICE OF CLAIM to the force legal department along with a copy of video evidence will be reviewed by lawyers who have to decide if they can defend the arseclown if they decide to oppose the claim. Illegal detainment with Assault & battery.

It does matter when you search someone. If a person didn't know the law, any officer could make up any excuse of a section of the law and abuse it.

Section 55 of PACE allows for an intimate seach - an anal probing for example, if authorised by an inspector. None were present.
Section 55 of the Terrorism act just defines certain types of weapons - biological, nuclear, chemical.

Police officer walks up, fails to inform you that he's recording, mentions "hostile reconnaissance", when asked to identify he refuses, then says he's going to search you under section 55 (That doesn't exhist), says the reason he's searching you is "because you're filming a police station", as you're asking what he expects to find they get impatient and drag you to the floor and cuff you. They complete the search but hold you hostage unless you give up your right to anonymity. Yeah that all sounds very legal lol.
I watched another auditor who delt with the body cam thing in such away that the police just turned and left.
He asked them if there was anything they wanted to tell him. When they said no then he asked if the Cheif Constable had given them permission to conduct covert surveillance on him. He then told them the section that says they must inform him and then said that they had just violated his human rights by conducting covert surveillance. The police just left him alone, was pretty funny
