the very fact that they publicly announced they were going to use the car to bait other drivers into street racing is pretty outrageous. it makes me think that was their plan from the outset and they just needed to get their hands on a supercar. i'm pretty sure baiting drivers is entrapment, but clearly Detroit PD isn't concerned with legalities

It's definitely bullshit, but the bar to prove entrapment in court is so high that it's almost never a successful defense. You’d have to win a civil rights case first then have magic happen to maybe sue someone in this case. Never going to happen and his lawyer knows that. He may push a little on a fourth amendment violation but it would be long drawn out and cost much more than those cars are worth to try. Then on top of it sovereign immunity for the locality will kick in and unless they pin it on one certain person there will be no one to sue.

Mustangs, Subarus, a Hellcat, all are or have been used in this county. No Lamborghinis that I'm aware of, but the kind of kid who is going to have a hard time pushing back isn't going to have much more valuable a car than a Mustang or WRX.

More than having an organization of lawyers to battle for the reclamation of seized property, there needs to be lawyers willing to challenge and sue against the legislature, PD in Federal Court. 😣
The law and implementation by the PD are clearly Unconstitutional; Violations of The Fourth Amendment which states explicitly that a warrant is required for search and seizure according to the specifications stated and includes "probable cause". 🤓
There is NO permission to threaten, arrest, search or seize property, persons, belongings, affects based upon potential or association, especially just upon presence which is legal. 😏
We clearly get the basis of the law, which is Authoritative and intends to threaten those that are passive or just present, but not actually participating, but the claim is intended to allow the police of accuse, arrest, etc. those that are passive and not actually in violation of any law. 😑
However, the US Constitution, explicitly, strictly prohibits such invasion of individual rights and include all such legislation, rules, laws, orders, 😒etc. at every level from the Federal, State, County, City through local.
      Simple. 🤓
      Period. 🤓
      Sincerely 😄

@@newtonfirefly3584 I agree 100%. The law needs to be challenged at the highest levels, instead of just on a case by case individual level.
Qualified immunity is another issue that needs to be challenged. I'm not anti-police at all, by the way. But the statute as it stands is clearly not only unconstitutional but illogical. Right now a rogue LEO can violate your rights with impunity so long as they do it in a way that has not been previously adjudicated in another case. I don't really have the vocabulary to convey the problem concisely, so I will use an analogy: suppose a district court has previously ruled that some officer A was in the wrong for entering a citizen's house while in uniform and taking all the cookies from the pantry. Qualified immunity as it is being applied now means that when officer B enters a citizen's house in uniform and takes all the breakfast cereal from the pantry, the precedent from the first case can not be applied. Even though anyone with common sense knows there's fundamentally no difference between taking the cookies and taking the breakfast cereal.

@@ShadowWizard123 yes, am glad You comprehend the illegality and unconstitutionality of the law.
You described the the concept of "qualified immunity" well.
However, from where did You get this legal concept from?
Also, it would not apply to any law or violation of the constitution, clearly.
There does not need to be a precedent, since the law is clear, therefore there can not be any immunity.
This concept must only apply to specific type of laws or cases, but am not yet familiar with it.

The worst thing is, they don't necessarily need to have measurement of your exact speed, meaning that they can claim that you have been speeding, streetracing etc. Your car will then get impounded by the police and you will "maybe" get it back.

This are orders from the top some of these towns have no revenue so they use law enforcement to take whatever cash and assets they can it takes a lot of money to get it back and due to qualify immunity is very hard to sue for damages.

Very concerned about this myself. Civil asset forfeiture may have been a good tool in the war on drugs. However that's questionable seeing as the war on drugs in my opinion is a victimless crime. Meaning that someone who does drugs sufferers from the consequences of their own actions without intervention. (Rabbit whole) This whole what's the movie that I'm thinking of ? Minority Report? Anyway trying to prevent crime before it happens is just wrong. And if someone is getting caught doing something dangerous or stupid on multiple occasions from what I have seen has been inconsistent. I saw where someone the other day was driving under the influence and had had multiple accidents. This individual had been incarcerated and had charges pending and had a fatal accident in the midst of that. Anyway I am thankful for the local drag strip if more of us who enjoy high performance supported tracks and road courses then we could scratch that itch legally where it wouldn't be a problem.

My 1965 GTO was towed from in front of my house as abandoned, the cop lied when he said he'd knocked on my door and my dogs will swear to it! Anyway when I picked up the car, with impound fees I discovered they had wrecked my transmission and the city was unwilling to pay. You're not allowed to sue the city, of course. That's when I remembered a business card in my wallet from a man whom I had helped on the side of the road, so I borrowed their phone and called, when the gentlemans secretary answered I said "yes, may I speak with the Lt. Governor, please?
It's amazing how quickly and bureaucracy responds when you threaten them with a bigger bureaucracy! My car was repaired and the impound fees were returned. I hope your luck is at least as good!
