I used to be a car dealer in the U.K. and for a limited time dealt with first response. Let me just say our business agreement with them terminated with legal action, which I might add we won. That was after two other agreements with them to return cars for no real reason except to try and maintain a relationship. After this we only used two prime finance companies that conducted business in a more honourable manner. Don’t be bullied Joe, and find another sub prime route for your business. Most of all be happy! 👍🏻

25 years ago i sold up my second hand car sales garages , retired and left the UK. Best thing i ever did , i dont miss it one bit. The VAT system made it very easy to come to my decision.
The disc cutter was used on a bellhousing bolt to remove the gearbox rather than taking out the dpf to access it. Its a shortcut. The balljoint dustcover was most likely damaged removing the driveshafts too as they are a pain to remove when corrosion sets in.

Regarding your coolant issue with your customer audi a3 ... These cars have a silican crystal pouch in the coolant reservoir this ruptures and silicate crystals block the heater matrix causing a blockage and over pressurizes the system .. the solution is change heater matrix and replace coolant reservoir and flush the system .. hope this helps anyone with vw golfs seats audi a3 post about 2012 onwards....

Morning Joe, honest content and refreshing to see the downs alongside the ups! Could I gently suggest a way around the expense, time and effort of compiling an evidence pack for court action. The finance provider will have a complaints procedure and a route to ADR, Alternative Dispute Resolution. A qualified independent ADR practitioner will quickly and effectively take an overview of the circumstances and make a swift and binding judgement. With the non disclosure in the Decision Notice, lacklustre action after your request for a written statement and that woeful engineers report I should imagine the resolution would be immediate. Know you’ll have your own procedure in place but hope this may provide a less anxiety inducing way forward. Take care.

To be honest Lee, if you're sticking to the sub £5k market, I really wouldn't bother! It's the cheaper cars or the ones where people are really stretching themselves that end up with issues like this!
Love the rant on the finance company. See it all the time finance companies retrieving the car and being out of pocket so it’s either the customer or garage they chase to get it back. However I had the similar problem to your customer as brought the car and later found out it needed injectors, coil packs and spark plugs because the original mechanic/ garage did a very poor job 1st time around and I did not find out until after 600 miles of driving the elm light came on and would not start. when my mechanic opened it up and said all the screws were loose and no seal etc. unfortunately for me it was a private sale so had to pay out of my own pocket but as a private sale it was much cheaper than buying from a garage, even with the additional garage bill. Great vid, and I think you had a similar car issue but unaware as you had not driven it enough to encounter them. My mechanic said these issues would of been undetected even by them on a test drive and inspection

My personal opinion is if you can’t afford to buy a car outright, then you should not be buying it. Too many people out there taking liberties, dealer or customer. I know people will say “what about mortgages” but with that you don’t get comebacks like you would with vehicles. But from a customer’s perspective, it looks like First Response are brilliant because quite often dealers are reluctant to resolve issues within the mandatory warranty period. A dealer saying the car just passed an MOT means nothing as we all know they can be pushed through even if there are a few issues.
Problem with that is it’s good financial sense to finance a vehicle in some cases, and no finance would make selling lower value cars a lot harder too. However I do agree there should be less consumer rights or they should be restricted to say 1 month because 6 is a joke. How can someone drive something for 5 months without issue and return it in month 6 because of an issue?
Being a car dealer has many obstacles but you take it in your stride its a shame because your a genuine nice guy and people seem to take the mick out of your niceness. That finance company is taking the mick and with the evidence you provided I can't see you not winning. Good luck.
I look forward to the video on the commercial discovery…my dad had a disco 3 like that and put backseats and seatbelts in it….he took the window covers out and it still had electric windows…the chassis still has the anchor points for the seats and everything to be bolted in….he bought it through the business so got vat back so it worked out a lot cheaper than buying one with back seats…❤

Also don't sell anymore vehicles to him or any of his family, because these types will never be happy, they want to pay £2000 and expect a brand new full working car. I find these videos very interesting. I don't have any ties with dealers or buying and selling of cars, but it's great to get an insight into the trade. We don't have vlogs by car dealers here in South Africa, but I should think the issues are the same. Keep them coming!

You can bet that First Response are running their evidence and paperwork thru their lawyers "before" sending anything to you in writing. They will want to check that they have a reasonable case to defend if you take them to court. So they will delay and then if they respond they will be very cautious in their correspondence with you now that you have indicated you will take the legal route. Likewise you should be gathering your evidence and timelines. I personally think you have a good case. But what do I know, I'm not a lawyer 🤷

So you had the Ford up for sale in late November 2023. It MOT'd on 4th January '24 at 64511 miles The 'independent napkin' report was at 68350 miles on 17th April '24 Since that report, its been driven nearly 2000 miles for another MOT on 16th July '24 at 70181 miles (failed and then retested) Looks like it was Haverhill Car Xchange that bought it and have already sold it on at 70,171 miles, but no mention of the EML on the MOT or any significant issues on their end. Might be worthwhile reaching out to Haverhill and asking if they can send you a copy of any vehicle health check they did when they got the car? Or any health check at the time of the MOT. Could go some way to help your defence if another dealer hasn't picked up the same issues as are being claimed. I hope Haverhill havent sold it through finance as well! Thank god your customer didn't get their money's worth from the car before binning it off. What a chancer.

All the issues reported on the scrap of paper are a direct result of the clutch renewal. Both ball joint gaiters destroyed when separating the bottom arms to extract the drive shafts and angle grinder damaged gearbox when cutting a bolt. All down to the owner.

The car finance issue will become more common as people look for ways to reduce their debt levels and, with car finance payments being a big one, that will be their first target. Sods law being applicable, this all coincides with a downturn in sales, with the added stress of limited cashflow but the same overheads. Time to stand firm on this tactic, as you intend to do; there is no longer any margin left to pander to these chancers. I have known people who spend their lives borrowing money and then refusing to repay it and become very agitated and abusive when it's suggested they should.
And add to the that the spike in car value around COVID and owing far far more than the used value, people who are comfortable playing the debt game are just going to stop paying.
Oh Joe 😕 you deserve better than that. My job is dealing with car finance complaints alongside the Financial Ombudsman Service and I'd like to think we treat our dealer partners with the respect they deserve. We all know you can't win them all in terms of satisfactory quality disputes for used cars, but the difference is in how the finance company deals with the situation and the support they offer their dealer. The report is a very poor diagnostic from a garage, which carries next to no weight from a legal standpoint. What the finance company should have done is commissioned a report from a qualified engineer but it saddens me to see what was presented to you - could have been written by anyone! 🤦♂️ Came across your videos as a recommendation, try not to let it get you down - it's clear you take a lot of pride in your business. Keep up the good work 👍
I work for a finance broker (we actually deal with you), and can say confidently that it sounds like theyve been negligent! Anyone in the trade knows the type of deals you get from First Response and honeslty Joe I wouldn’t deal with them again if I were you… what a complete joke!!!
My mate got a car from a large group 25k 18 month old car 3 years ago never had any issues. They deal with less than prime credit but not all people in that boat are dodgy, got an extended warranty.

I look forward to the video on the commercial discovery…my dad had a disco 3 like that and put backseats and seatbelts in it….he took the window covers out and it still had electric windows…the chassis still has the anchor points for the seats and everything to be bolted in….he bought it through the business so got vat back so it worked out a lot cheaper than buying one with back seats…❤

Also don't sell anymore vehicles to him or any of his family, because these types will never be happy, they want to pay £2000 and expect a brand new full working car. @@CookieMonsterawr The trouble at that end of the market is whilst £500 to you might be a good night out, to the person buying the car it’s usually their life savings, the grief I used to get back in the day over £100 trade-ins was off the chart - even had a known Irish terrorist in demanding a refund, mind you he got one without any quibbling 😂

Don’t pay the finance company cowboys, I can see the stress they’re inflicting on you, try and pass it to your legal guys, I suffer with a general anxiety disorder and it sucks, walk away from it.

I find these videos very interesting. I don't have any ties with dealers or buying and selling of cars, but it's great to get an insight into the trade. We don't have vlogs by car dealers here in South Africa, but I should think the issues are the same. Keep them coming!

You can bet that First Response are running their evidence and paperwork thru their lawyers "before" sending anything to you in writing. They will want to check that they have a reasonable case to defend if you take them to court. So they will delay and then if they respond they will be very cautious in their correspondence with you now that you have indicated you will take the legal route. Likewise you should be gathering your evidence and timelines. I personally think you have a good case. But what do I know, I'm not a lawyer 🤷

So you had the Ford up for sale in late November 2023.
It MOT'd on 4th January '24 at 64511 miles
The 'independent napkin' report was at 68350 miles on 17th April '24
Since that report, its been driven nearly 2000 miles for another MOT on 16th July '24 at 70181 miles (failed and then retested)
Looks like it was Haverhill Car Xchange that bought it and have already sold it on at 70,171 miles, but no mention of the EML on the MOT or any significant issues on their end.
Might be worthwhile reaching out to Haverhill and asking if they can send you a copy of any vehicle health check they did when they got the car? Or any health check at the time of the MOT. Could go some way to help your defence if another dealer hasn't picked up the same issues as are being claimed.
I hope Haverhill havent sold it through finance as well!

might have been been financed at haverhill via first response , rinse and repeat haverhill hopefully watch shifting metal , hope its not the case cos first response wont have a leg to stand on in court if it turns out to be the case

All the issues reported on the scrap of paper are a direct result of the clutch renewal. Both ball joint gaiters destroyed when separating the bottom arms to extract the drive shafts and angle grinder damaged gearbox when cutting a bolt. All down to the owner.

I think you’re in the position now where you can choose what finance companies you want to work with. This whole fiasco was a joke!
The car finance issue will become more common as people look for ways to reduce their debt levels and, with car finance payments being a big one, that will be their first target. Sods law being applicable, this all coincides with a downturn in sales, with the added stress of limited cashflow but the same overheads. Time to stand firm on this tactic, as you intend to do; there is no longer any margin left to pander to these chancers. I have known people who spend their lives borrowing money and then refusing to repay it and become very agitated and abusive when it's suggested they should.
And add to the that the spike in car value around COVID and owing far far more than the used value, people who are comfortable playing the debt game are just going to stop paying.
Oh Joe 😕 you deserve better than that.
My job is dealing with car finance complaints alongside the Financial Ombudsman Service and I'd like to think we treat our dealer partners with the respect they deserve. We all know you can't win them all in terms of satisfactory quality disputes for used cars, but the difference is in how the finance company deals with the situation and the support they offer their dealer.
The report is a very poor diagnostic from a garage, which carries next to no weight from a legal standpoint. What the finance company should have done is commissioned a report from a qualified engineer but it saddens me to see what was presented to you - could have been written by anyone! 🤦♂️

I had a a3 with a coolant leak nobody could find, it ended up having a new heater matrix, egr cooler and water pump.

I work for a finance broker (we actually deal with you), and can say confidently that it sounds like theyve been negligent! Anyone in the trade knows the type of deals you get from First Response and honeslty Joe I wouldn’t deal with them again if I were you… what a complete joke!!!
My mate got a car from a large group 25k 18 month old car 3 years ago never had any issues. They deal with less than prime credit but not all people in that boat are dodgy, got an extended warranty.
Sounds like you have been right mugged off about that c max but im no car dealer or have finance on any vehicle as if i cant pay for it myself i don't buy simple but wouldn't want anything new with anything vehicle i will stick with my 2 grand old ford which I can fix and maintain my self
