- The plaintiff says she’d purchased a border collie from the defendant she wished to breed, but two years after the transaction she still hasn’t received the dog’s papers from the defendant. She is suing for lost money she believes she is owed. The defendant has been breeding collies for 20 years and made no promises to provide the plaintiff with the paperwork necessary for breeding. She says this is because the plaintiff had stated she was just looking for a pet she would be getting neutered.

Larger breed dogs should not be neutered until AFTER they reach full physical maturity ~ 18 months to 2 years. The reproductive hormones are very important for normal and healthy development. Aldo, there is an increased incidence of anxiety aggression in dogs neutered early.

@@not_thedroids871 buy one that isn’t. Did you watch the case? Defendant’s entire reasoning for the alleged contract is “over breeding” which is abuse. (It’s more about competition and she doesn’t do it herself because it would lower the price of dogs as she would have to wait and the older they get the less value)
The defendants “no breeding contract” is just a doily for my beer since it was NEVER signed!!

@@sadiebrown4493Customers that pay $$$ to purchase from reputable breeders are not the problem. Good breeders have a contract to have the pet spay/neutered. It’s the “backyard breeders” that don’t follow up with their customers that are part of the problem.
I do agree with you. I understand that their families who have done it for generations and treat their dogs well and etc etc. but with so many dogs and animals in general who need homes. I really think it's cruel. Also, I am not saying all dogs in shelters are from breeders either. I feel the same way about children. Of course I don't think someone shouldn't be allowed to have a child of their own but there are so many people who do have children and they are passed around, neglected , and put in foster care. It's just very sad.

The only reason she didn't want them to have the papers was she didn't want competition on breeding in her area. That's the ONLY reason these breeders have that clause. Get your dog from a shelter. They make the best pets

It’s not unusual for breeders of purebred dogs to require that you either sign a contract agreeing not to breed, OR pay an additional fee to be allowed to breed. Some breeders will also hold your AKC paperwork until you can provide PROOF that the dog has been spayed/neutered.
Plenty of breeders have in their contract that the buyer cannot breed the dog.. the judge acts like that is unusual and it’s not. The breeder/kennel’s name is most of the time attached to the pedigree of the dog.

These breeders think they still own the dogs after they’ve sold them. It’s NOT your dog as soon as you take the money!
The dog is not but the genetic line is still owned by the breeder and the dog’s registered name will reflect the breeder. Thus many responsible breeders (the defendant is NOT included in that category) will require a non-breeding contract to be signed by the buyer if the breeder feels that dog’s genetic line should not continue. If you don’t sign the contract, you don’t get to buy their dog. And those breeders WILL come after you should you break that contract because they are responsible breeders who care about the health of the dog and the dog’s progeny.

I’m surprised she didn’t have a standard contract with the no breeding clause that most animal breeders do. Usually if the purchaser does want to breed the seller will mentor them to ensure the correct care.

The point of a no breeding contract is so others don’t mess up the blood line. No one wants poorly bred puppies link back to them. When I decided to breed again all my pet home puppies will be neutered first .

Dogs are property and you don't get to tell others what to do with THEIR property.
The breeder has every right to put anything they want in a contract. If you don’t like it, don’t buy their dogs.
Non-breeding clauses are common for responsible breeders. If a breeder doesn’t ask about your lifestyle, your home, and what you plan to do with the dog, you should find another breeder who cares more about the dog than they do about selling the dog.
A breeder can legally put a clause in the sale contract that the dog cannot be used for breeding. The dog can still be registered, but there is a box on the registration that prevents the registration of any puppies produced in violation of the contract. Many reputable breeders are protective of their lines, and that is a sound position to have, as it protects the genetic integrity of all dogs of that breed. When a breeder does permit a dog to be used for breeding, they sell at a higher fee. Breed registration, say AKC, says nothing about the genetic quality of the dog, it is just a document of heritable history.
Agreed in general. The only thing I totally disagree with is that many of them are inbred and to me that's irresponsible. Inbreeding causes cancer and behavior problems 😢
Agreed, inbreeding is a horrible practice but it is mainly done by backyard breeders who don’t generally care what you do with the dog after you buy it. The breeders who require non-breeding contracts are generally the responsible breeders who recognize that a certain puppy/dog is not a high enough quality of animal to reproduce. Can still make a great pet but that genetic line should not continue. Those are not the breeders who you have to chase for paperwork; they won’t let you have the dog until the paperwork-including your signature on the non-breeding contract-is complete.
Interesting that the judge doesn’t understand? She is a breeder but if she is selling puppies to other individuals and they continue breeding to make money to sell puppies, you don’t know who they’re going to and if they’ll be taken care of. I think she is very caring to do this to not want them to be bred.
I think she is trying to knock out the competition. She has no right to say if she can breed her dog she paid for if it was a gift yes but not when she sold it.
This is a contracts case. Make her sign a contract that she won't breed.
The judge understands, but that’s not the defendant’s choice to make. If she doesn’t want the puppies to be bred, then she can pay for them to be spayed or neutered herself before selling them.

Once you sell an animal...you do NOT get to dictate what the new owner does with the dog so long as it's not abusive.
And the defendant brought the contract that the plaintiff did not sign, due to the plaintiff wanted to breed the dog in the future and needs the AKC papers.
I think there should be this non-breeding clause for some people.

That’s kind off foolish. I get what you’re saying but if someone wants a purebred, of whatever breed, why is that wrong? Hard to find those at shelters. People can get whatever kind of dog they want. I mostly have owned shelter dogs but now I have a pure bred lab. Nothing wrong with that!

We've had 2 registered Dalmatians from different breeders, both have a no breed contract. It keeps the bloodlines and health of the breed in check.
They do that because they know they can’t make any money on breeding when it belongs to someone else. It’s pure greed.

I've got the feeling that the Defendant was looking for avenues to get more money out of the Plaintiff to get the dog properly registered and failed. It's really none of the Defendant's business trying to dictate what the Plaintiff could and could not do, as per the written contact. I'm glad the Defendant is out of the breeding business if this is one of her normal business tactics.

It always makes me laugh when breeders require the new owners to sign a "no breeding" contract, stating the new owner will absolutely get the dog fixed. The reason I find it funny is because most of the breeders claim they want to know the dog won't be mistreated and used solely for the purpose of breeding. Yet, those same people will still sell you the puppy even if you disagree, only they typically raise the selling price tremendously. I guess they're only concerned for the dog's quality of life when they're not able to benefit from the breeding.
I only know this because when I was searching for our pup, at least 90% of the puppies for sale were advertised as being registerable, but in fine print ( or when you're picking the pup up) it states the puppy is being sold as a pet only(no breeding rights). I had no intentions of breeding anyway (especially since my poor puppy was born with hip dysplasia). I just found it interesting.
Btw: in today's world, registerable means nothing because now there are different "breed clubs" that hold zero value regarding your dog's bloodline. Beware of breeders puffing their ads and prices using registerable tactics.
Overbreeding as she says may eventually cut into her business if there are more of the breed in that area!

Border Collies are a high drive, high energy dog that need a job suited to that. If you can't provide such a job, then that is not a breed suited to you and is inhumane.
So, responsible breeders make a future owner sign an extensive contract in order to purchase a dog

Just in general breeding dogs for a living seems icky. Forcing an animal to become pregnant so you can sell their babies for a profit seems wrong. We wouldn’t do it to humans. I hope.

Plaintiff has no business breeding dogs
You can always tell if papers were promised based on the purchase price. An unpapered dog will sell for much less than a dog with papers. Most breeders of purebred animals demand the dog be spayed or neutered, unless a seperate breeding contract is written up. Lack of a contract actually suggests the dog was to be neutered. It's actually standard rather than the exception. Either way, no contract signed, no contract to be enforced. Both parties are trying to get something not agreed upon with a written contract. That right there shows me neither one should be breeding dogs. They both seeem driven by money.

The defendant stopped a backyard breeder in the making. The only people who should be breeding are those with extensive knowledge of the breed, those who test for the genetic illnesses most breeds carry, those who show, and who are committed to BETTERING THE BREED. Having litters Willy nilly like it seems the plaintiff was going to do can introduce low quality and sick lineages. This lady didn’t even know what the different registries/associations were!

He was VERY leery of them when he was younger- when the incident was fresh but we were lucky, my Aunt/Uncle HAD a border collie and we went and spent time w them so that he wouldnt be afraid! My Uncle is the smartest person Ive ever known and a doctor!

Only professional breeders of show dogs should be breeding. The mistake was that the breeder didn't sign contract that dog had to be neutered and not bred.

That's easier said than done. I have tried and got turned down. I know people who own their own home, front/back gardens, and had pets all there life still got turned down. In the end I brought my dog from a neighbours friend.

It's too many dumb people in this country
Some dog breeders are just full of 💩, “They cannot breed because they’re like family and i need to know if they are taking care of it”…. They just don’t want competition, some of them treat the animals poorly and then try to sell with “high standards”.
Ownership, Property, paid for, domestication, cages, chains. This is a soul with feelings and spirit yet people all around the world think their entitled to another life form. It's giving slave owner.
Only watched about 2 minutes as I don't care for any of these litigants. Breeders and people that buy from breeders don't love animals. They're selfish people who take advantage of other selfish people who just have to have that special breed. Every time people do this, it's another animal left in a shelter. That's not love for animals.
The defendant is mentally ill or has deep emotional issues to want to control the breeding of a dog. She says they're her family. Once she sells them they are none of her blankety blank business. The new owner can do what they want. Defendant needs an asylum.

Well, in all fairness, women’s body composition does change drastically after menopause and some start gaining weight despite diligent exercise and healthy eating, due to the dramatic drop in estrogen and the other hormones as well. In her case, I think a lot of the weight is also from being in a wheelchair and the fact that whatever her illness is, might be contributing to her just not being able to live a healthier lifestyle that’s conducive to weight control. We’re all built differently, not everyone could control their weight well. I’m built naturally lean, long and super skinny, with very good muscle tone, just like my dad, who was even skinnier in his late 70’s than any other time in his life, and he was always thin his entire life without any effort. But I’ve always watched everyone else needing to work really hard in keeping their weight down or staying thin all my life. So it’s easier said than done to maintain a healthy weight. Some people just naturally have a much harder time losing weight and fat. If you were in a wheelchair, it might be a lot more than just 7 pounds. 🙂
