A Ahmed.. as per law there is no rule to pay gratuity after 5 years . It is company policy only . And gratuity is paid once you resigned or terminated without any serious disciplinary action. Either u resign after 1 year or 2 year or 5 year u will recieve gratuity accordingly . But if u sign agreement before joining company . Company may bound you on this . But it is not as per law.

Iske elawa law mai month is equal to 26 days mention hai. Agr ap salary 30 ya month days pe calculate krte ho tu per day minimum wage ati hai.

Actually. There are self inventions in the organisations that does not cover legal requirements. If any organization pays gratuity after 5 years. They are following their own rules not legal requirment. It is just like leaves sandwich , there is no law to sandwich any holiday between leave days.but organisations do. Secondly, every worker will be qualified if organisations come under the definition of employer given in standing orders. And worker come under the definition of worker.

Pls guide why few companies are giving Gratuity and others not. A company says this is the discretion of the company to give or not gratuity ? Remember our company does not give any provident fund ! The company gives only sales incentives against our target sales and bonus to non sales people.
