The whole concept of a Failure To Deliver is a disgrace and something the financial markets should be ashamed of. How can you borrow something and sell it, then when it comes to actually buying what you sold you don't bother? You just created a counterfeit share that you got paid for, that should not exist, drives the price of the underlying stock down by dilution and completely undermines the company you shorted and it's shareholders illegally. The fact that this is not just allowed, but allowed over and over and over by paying a small fine and not even admitting the crime is the most incredible of all.

The whole concept of "money" bastardizes fair trade with a centralized form of payment.
Furthermore, money being based on digits in a computer means money is able to be MULTIPLIED at the press of a button or a moments notice (leverage, derivatives, pumping garbage chinese stocks 16x in a day, etc)

You mentioned the missed GME/XRT whale purchase July 3/5. But that is when KOSS popped off, T+35+21 aligns with all of the August settlements for XRT, CHWY and GME. Aug 7-30

I bought 500.00 of KOSS to hold because I think Kitty does live stream and buys KOSS and then shows he has all the extra shares beforehand. The world will broadcast his live stream like last time and they are busted
the volume doesnt show he bought all of it. either on 5/13 or 5/14, and even then he would of had to file a sec form. whywould heeven buy allof koss. doesnt make any sense at all. its not in the basket. and i dont think he bought all of koss this last week. its a bad investment. he only buys options when they are cheap and HOLDS GME.
We should look into who is backing Koss. The market maker, if anyone gave them a loan, there’s gotta be a Wall Street firm that popped up to make Koss a thing all of a sudden. Let’s check the filings. Somebody has access to Koss shares and pledged them somehow. Koss is small enough that we should be able to figure it out, Imma check the board.

I'd speculate that the times when KOSS doesn't correlate with GME, then it'll be correlating with another company they were in the process of cellar boxing

Richard, the crazy thing about Koss is that they only have 9 million shares outstanding and insiders still hold a lot of them. So an estimated ten times the number of available shares (per day) have been traded in the last few days. Is Koss perhaps in a swap basket because hedge funds at some point bought more shares than actually exist? This is exactly the theory that gamestop follows and it seems to be true. Crime

I think I have a smart idea. If I am right... I do not have a platform, voice, or microphone to get the community to actively correspond with the SEC to spark change. However; WE, the retail investors recently saw our capabilities when we voice together in changing settlement to T+1. We asked for something reasonable (instead of pushing for instant settlement) and after some time, with consistency we got it proposed and made the new normal.... so, here's my idea [ WE, the retail investors should push for T +5 settlement ] we will lose if we push for zero FTD's in the name of "liquidity". However, I believe we can be successful if we show how capital formation is being decimated by allowing trades to be settled 10 times per year roughly; in a best case scenario.
I think the stock only moves when i stop looking at it...

idea for your consideration Richard. We have been focusing on stocks getting shorted with the swaps. Find next one wait for volatility, etc. Simple
What about other stocks in swap baskets. Are they not getting pumped as source of collateral. If we can expose those stocks, rather than just guess nvidia or btc, we can formulate a clearer picture that can be understood by most, rather than complex option trades

A free market is a fair market. When you have institutions come in with their social and monetary leverage, you get imbalance.
In a fair market, it will balance itself out. Like if the buy button was turned off.
In unfair markets, it usually ends with tyrants heads on pikes.
I was looking at the data in your spreadsheet and I noticed KOSS Volume is the largest it's ever been, I think it's very telling of what's to come. AMAZING!!! Wow!!! Expecting something massive soon.

What is really problematic with these derivatives and other financial vehicles is that the shorts can keep on creating new instances. There really isn't a hard limit to these internalizing mechanisms, it seems mostly dependent on the availability of counterparties, which is downstream of the macroeconomic environment. In many ways Gamestop is just a macroeconomic play targeting the fragility of interconnected markets.
If you want to move price action from one security to another, you could conceivably open multiple basket swaps using multiple securities to force counterparties to hedge their exposure to the collection of swaps as a whole by moving the price of a range of securities to your benefit. Essentially, as with Archegos, we've seen that you can engineer what sort of hedging your counterparties will engage in if you plan accordingly.
What do you mean XRT is full? What data can i follow in order to see the ETF that is full, and they have to pass to another ETF?
XRT has 4.5m or so outstanding shares and GME is 1% or so of it's holdings. So there is a limit to how much failing they can do on it. However, it is oversold (shorted) 400% or so, making the shares owned by institutions quite large - somewhere above 20m shares of XRT. This means it has the ability to account for somewhere around 1m shares of GME (totally rough guess based on it's 230k reported held x4).
So once it's all fails in XRT, they would have to go somewhere else.

I was looking into things, and one thought I had why GME didn't spike on 7-3, looking at DTCC important notices, Citibank filed on 7-3 saying they were refusing to pay their bill that was due and as a result no payment was processed. I don't KNOW that it's definitely GME related, but I suspect it is, and then what's the fallout from this event? no clue unfortunately

Just a thought but if you consider that there are three quarter notes (two tied together indicating that they’re played together) 1Q,2Q&3Q three quarters in the fiscal year
1st note is a D
2nd Note a B
3rd note is an A
In the first Q earnings $GME earned 19mil less than projected. But net loss was only 32.3 mil, 18.2 mil above the market projections and GME issued 75mil shares adding to the 45mil currently in existence. And increase of 166.66% increase which dropped share prices by 39%. The market has since recovered staying at around $24 per share thus far this quarter. A nearly 100% increase over the base line of last quarter.

I dont really think the trading days are applicable to KOSS. I think your first assumption is right in that it's tied to GME through those historical swaps and so it just so happens to run when GME runs, not because of cycles triggering.
So why do you think GameStop volume has been dropping off while Koss had the highest volume day in quite some time? (nvm, I was halfway through and you just answered the question LOL)
Also, want to say that I really appreciate your videos and they have helped me have such a better understanding of cycles and developments surrounding these stocks!

If you buy options wait for low IV and be prepared to roll them longer. Everytime there has been a hyped date( opex, c35. etc) it doesnt seem to run when we expect. DFV may give us a sign with his 5000 block purchases before the next run though.
6/6 was hyped and it ran, though.
@RichardNewton You're right. I think DFV's involvement may have changed things, potentially getting retail back into options which helps gme move, plus earnings is always volatile.

I keep hearing T-35 is trading days, business days, etc. but I read the rule and it says calendar days: "no later than the beginning of regular trading hours on the thirty-fifth consecutive calendar day following the trade date for the transaction, immediately close out the fail to deliver position by purchasing securities of like kind and quantity". Not saying one or the other is wrong, just thinking it would benefit everyone to get 100% clarity since I think there is something to the T-35 rule.
Indeed. The problem is I can't point to T+35 being Calendar days and it ever working out.
(Except around the sneeze but basically every T+anything works there with all the wild FTD and volume activity and everything being on RegSHO).
That said, T+35 being trading days works out constantly. For example, just this week with KOSS was exactly 35 trading days after the events of 5/13 and 5/14.

Richard can you look at ETF and Index rebalancing as an issue? My thoughts on the run up was institutions betting GameStop would be profitable and able to be added to S&P500. When they announced they were not profitable they were no longer viable to be inducted. Once GameStop is added to S&P… that will be the run. Imo.

For Koss, regular stocks run on T+3 for Market Makers and for ETFs (gamestop short) there is exemption for T+6, I'm wondering if the participants are using this rule difference to their advantage right now. I would need to see in next 2-3 trading days if this is reflective.

Koss must be in a swap with gme, for sure. Thing is since the sneeze, when gme runs koss follows, but not the other way around...
dude market makers can be naked short without a borrow they do not pay the borrow negative rebait that is the rule and they can rollover trades nakedly in limitless time periods.
Have you looked into leveraged ETFs? That seems to be a tool more rife for abuse where they can amplify the effects but I haven’t heard them talked about much. I expect that’s what they are using.
This might also play into your theory why Koss has to be respected in swaps- it’s not in a leveraged ETF but GS is. I’m smooth though so was just feeling for wrinkles after watching several academic lectures on ETF abuse.

Koss is not in XRT. Not sure if it was before. MEME etf doesn’t exist anymore. Weighting for GME is now very low in XRT. Only 1.15% after it was top holding before June 21 rebalance. Caravan and Chewy are now largest holdings in XRT. Check tipranks for XRT listing and changes.

As long as there is so much ETF (and ETF options) exposure, I don't think it would matter.

Koss dropped -13% June 28 Friday with no news and GME dropped -13% from June 28-July1 with DFV lawsuit and dismissed on same day. I do think it's either shorts or longs did the lawsuit to create similar algo as KOSS. I do expect gap up on Monday or rally before OPEX like in May and big final short squeeze in September. It does seem like every 2 months, this big gamma + FTD + short squeeze happened until bull cyle ends.

It will be 35 Calendar days from his purchase but I've rarely seen that produce anything. We'll have to wait a few weeks and see.
8/8 is based on ETF settlement theory which is totally different.

It’s trade date + 35 calendar days as per SEC rule. So the 4M FTDs from RK buy have to be bought before 7/18.

I guess my question would be with all these settlement dates, obviously they want to kick the can on having to pay any money as long as they can which I could completely see why they wait the full 35 days, but do they have to wait 35 days? If they saw or deemed it fit to fulfill all their positions on day 10 or day 14 or day 28 could they do that?or is it mandatory you have to buy them on the 35th because I could see everybody figuring that out and having knowing that they have to buy. So are they able to fulfill any time with the 35 days or is it mandated on that 35th day they need to be fulfilling their positions.

I think on GME FTDs that's why there is variability.
ETF FTDs seem tied to creation/redemption cycles and possibly ETF Options settlement. So I think that's why those cycles are so consistent (Monthly Opex +34 trading days).
