      @@SpaceRanger187 Interesting you distrust the cops for that and not the testing procedure. I was amazed for the 20 false positives with household products. Police officers are just people. If all you saw for your whole work career was drug dealers, murderers and rapists you would assume everyone is a criminal, and a false positive would make that gentleman a criminal. You Sinster should treat the police with respect and admit they are doing the best they can. Some people are honest and some a corrupt, the ratio is the same whether its police or McDonald's workers.

And the amount of illegal immigrants incarcerated is congruent with the amount of people incarcerated.       this "mistake" happens in quite a few counties of Florida. Martin County police were on national news a year or so ago for claiming laundry detergent was cocaine.. they also planted evidence on over 30 people while they had innocent people in jail for months.

      It shouldn't matter whether you are perceived as wholesome or not. No one should be arrested due to faulty procedures, faulty test and certainly not due to a tiny amount of a substance even if its illegal. Issue a citation instead and set a court date.

      Agreed, and the fact its still on his record - and he'll have to pay legal fees to have it expunged. I would have settled, but required the city of Orlando to pay all fees to have the record removed going forward. If they can't commit to that, then ask for $1 million as you probably obtain a good paying job going forward.

      Thank God I read all your comment I was going blast mode over the first sentence. Officers are abusing their right to investigate and not justvin the usa. They park their cars in the middle of the road right after a bend creating a hazard but in their mind you won t have time to throw anything out of the car without them seeing. Then I had 5 people in the car and had to keep my windows up for them to be happy staring at a guy next to my window with a god damn machine gun strapped to his shoulder as if it s a war zone. Hesus cristos popos chillaxxx. WE LOVE YA :-) especially roasted or crispy in the morning mmmm baconnn

    The fact the test kits are so inaccurate, yet still used is absurd. I had a similar thing happen to me. Where they thought I had cocaine, but it was Prozac. Never had to show up in court they dropped the charges but it still shows the arrest on my record.

      I am an ER doctor and we are required to get urine drug screens for all admitted psychiatric patients. The number of false positives is insane... Staff will see the result and say, "Wow that 13 year old girl uses meth" when the test is falsely positive due to their prescribed psychiatric medications. No one cares to correct the record and false positives are never followed up by expensive confirmatory testing.
      Unfortunately, "drug screens" have not been used as screening, but as diagnostic/confirmatory testing.

    The thing that makes me sick is the cop still believing he’s guilty and that was indeed meth despite the test being completely unreliable. That’s why people are not trusting of cops, you get these ones that are so full of themselves that they think they ARE the law.

      Oh they will never, ever admit to a mistake. Doesn't matter if they're wrong. Doesn't matter if they go to court, LOSE, and the judge tells them they were wrong. They will still stand there on the courthouse steps and "disagree with the judges decision" and "vow to do the same thing again." In their view, they are infallible. No matter how bad they screw up, it's always "good policework."

      @@killdizzle There is a process to expunge it from your records, but it's costly and requires you to prove beyond a shadow of a doubt that you are innocent and there is absolutely zero possibility that you could've committed the crime in any form. I was reading about it the other day. It's very difficult to do.

      Our so called justice system is just makes me nauseous. We got crap like this, civil asset forfeiture, control freak cops plinking people for fun. It's just truly sickening. A buddy of mine had to go to the police gun range for his security guard license. He called me afterward, almost in shock. He said all afternoon he had been listening to different cops either bragging about people they had shot or talking about how much they wanted a chance to shoot someone.

    37,000 was no where near enough, especially when you consider that the lawyer probably gets at least half. And this guy comes from a well off background. Imagine if he was a homeless guy who just got done eating a donut. He would still be in jail. These idiot cops must be held seriously responsable for their actions. It can be very scary to think that the brainless cop who pulls you over might just pick a crumb up off the floor and say that it's drugs.

The Young Man told the cop over and over that it was bird crap...but no friggin way, said the cop, it tested positive twice for cocaine... Yeah, I always keep my blow on the hood of my car going 60mph, I tend to spend alot more than I used to on blow, because I can't figure out where my stuff keeps disappearing on me! The cop was fired ONLY because the DA would not prosecute ANY cases brought forth by that officer...Friggin' Unbelievable!!!

      @@cait812 I'm not a lawyer & I don know the terms of his settlement, but I'd venture to say that arrest records are rarely if ever, covered in false arrest settlements. Each fiscal year this arrest record has a negative impact on his finances, should be grounds for a separate suit, as long as he doesn't sign a blanket settlement. That would be my guess..

    Several years ago I got up and got my car out of my garage and parked it out in front of my house - then I cooked breakfast. A couple of hours later I looked out my front window to see 3 cops trying to get my doors open on the car. I went out and while staying within my fenced in yard I said "officers what are you doing"? They said back "we'll get to you in a moment"!!! Very dismissive. So I said back that is my car, in front of my house, which I got out of my garage. "What is going on anyway". They said this car has been reported as being involved in a crime or something. So one of them got a phone call and then they kinda looked embarrassed. They walked over to me and said "Oh, we are sorry we have the wrong address"!!! And I said back "what would you have done to me if I had walked out of my yard and confronted you". Would you've put me in handcuffs? Cops make mistakes all of the time but people can have their lives threatened by them or reputations ruined. So be careful all of you.

    This sounds similar to my story. I was arrested for drug paraphernalia because they found a spoon on a plate in my backseat. I worked 3rd shift at the time and I ate a plate of meatloaf and mashed potatoes otw to work. The police said the spoon was burnt, with white residue on the bottom and they took me to jail. I got out the next day on an OR . When I went to court my public defender tried to get me to plea out, I refused and waited for the results. So she talked to the prosecutor, I seen the prosecutor laugh and my case was dismissed. I've also never been to jail and I don't drink or do drugs.

      The verdict was overturned therefore the charge is no longer on his record. He did however have to spend time behind bars which he can never get back as well as costing him his job.

      In USA you have arrest and conviction records. So he doesn’t have a conviction record, but retains his arrest record. So people can still see it and it just looks like he had a good lawyer. People get let off for illegal searches, improper procedures etc.

      I once pulled in my neighborhood and there was a man standing over a girl beating her mercilessly. I jumped out of my truck and yelled stop that! he yelled F you! So I pulled him off of her he then squared up with me and swung I ducked he swung again I stepped back and hit him with a left jab and he dropped. I then called 911 the police arrived and took him off to jail and an ambulance came to help the woman everyone shook my hand and told me good job. Two days later two sheriffs pull up at my house serving a warrant for my arrest for disorderly conduct and fighting 😡 I had to go to court 🤬 the charges were immediately dropped but still to this day its on my fbi record 🤷🏻‍♂️

    Why isn't the arrest record removed straight away and totally in a case like this? America- you need such a comprehensive housecleaning. Yet another example of a broken system.

      Actually, an arrest record is typically never removed, and no matter what a court may order. The national database of arrests is held by the FBI, not an agency that the court has authority over, and no matter how invalid, he now has an arrest record for life and it may still come up on background checks. That's the actual way our system works. Expunging it from the local system, even if such an order is carried out, doesn't typically make it disappear. It just makes the defendant feel better. I don't think most Americans have any idea of this. You can be arrested for a horrific crime and then a court throws the charge out as absurd, but that arrest will usually show as part of your record for the rest of your life.

The Founders declared that the people’s ability to keep it was another matter, which they could not control. For example, their insistence on innocence until proven guilty has become, at best, a cynical silliness demoted to little more than a theoretical concept of American jurisprudence. When those ideals no longer inform those who call themselves Americans, and especially mean little or nothing to those who govern and enforce its laws, they are the ones to blame-not America and its ideals, since discarding those is the only way this kind of thing becomes possible.

      @@ReluctantPost I think in my country you can go to court to get this thing removed from the record. Things will be removed after certain time anyway depending on the crime. But ordinary employers are not allowed to ask for that anyway. When you want to work for government or with children or want to buy a gun thats another story. Things will only enter the register after a decision was done by a judge. Small things like punishment on probation or jail up to 90 days wont be in the record anyway.

They have promoted personalities like Nancy Grace who embody open defiance of American founding principles of jurisprudence and, in that example, demands that her listeners join her in her declarations and prejudices. Unfortunately, people like her have sensational appeal and persuade the public towards mob justice instead. That creates lots of openings, and sometimes even public pressure, for policies like those above in the name of being “tough on crime.” Few think to ask, “At what price?” It would be interesting even to see a peer-reviewed costs vs. benefits analysis, separate from the question of whether the US founding principles should be so easily compromised.

She has to act with what she is given. The state is at fault for false economy and the legal system. In the UK he would have been arrested and bailed on free bail pending lab tests, not thrown in jail on his presumption of guilt. He would not even have been charged until the result of the test was known. The US legal system is archaic and as bad as any third world country.

      @@Biffo1262 The test was fine. She said in her own words that she didn't know how to use the test properly because she wasn't trained well to use it, but she still used it anyways and tried ruining this poor mans life.

    Funny how their test resulted positive over a donut glaze. And the arresting officer still wasn't convinced even after the actual lab test result says negative. Stupidity lasts forever.

      The cops said the same thing about Emmett Till... And the 14 yr.old black boy s.c. he was killed in the electric chair !!! I've seen one on a field trip as a kid and just the site of it gives me nightmares until this day !!! Imagine that ... Wow...

      Lawyers charge upwards if $5000 to get an arrest expunged. Doesn't matter if it is a completely bogus arrest.

      This happens every day in America for thousands of people. Fewer than half of those arrested (preliminarily charged by the police) ever face formal charges from the district attorney. Fewer than half those formally charged by the district attorney are ever convicted. Fewer than half those convicted receive active jail or prison sentences (most get probation). As such, the majority of Americans that are arrested are falsely arrested because the district attorney does not agree with the arresting officer(s) and formalize the charge(s). The American justice system is highly subjective and largely based on an officer's poor decision making and poor understanding of the law.

    god i love this story. The fact they chose one of the most straight edge, responsible, and caring people this charge. The donut glaze thing is hilarious, but the chemo, going to the gym, one donut every other week, and handing out bibles to the homeless is just glaze on the donut. They "caught" probably the most innocent person they could have.

    Never consent to an unreasonable search. This is the US, where we are innocent absent proof of guilt in a court of law, and have every right to refuse a search absent a warrant. This officer never had reasonable suspicion to execute a search. He never claimed he searched the car after seeing "evidence". Thinking they're above the law, some officers and departments just have an itch to go above and beyond their authorized powers in the pursuit of finding people to prosecute. They have no right to just stop people and violate your constitutional rights by looking through everything hunting for something to charge you with. What is this... Russia?
