Sir, I need you assistance, I joined as ldc in 28th jan 2018 in Central govt as direct recruitment , I was senior in my batch but general category after direction from ministry on 22.01.2018 while 02 of my colleagues 01 sc and 01 st category but junior than me as per seniority join on 11.12.2017 and gets their first increment in July 2018 while I got my first increment on 1st jan 2019 Almost 06 month delay to them, Sir is their any rule through which being senior of the batch I can get the same increment, as I am senior and delay was from admistration side (non css cadre)

Sir pls tell m what rules are applicable for direct recruitment whose advertisement notifications are same bt date of selection lists and appointment orders are different. e.g our appointment order date is 26/02/2014 then after a gap of Six months other selection list and appointment order of same notifications was issued e. g date of appointment order is 15/07/2014 bt their merit is higher than us. Even some candidates were in waiting list bt due to high merit their seniority have been fixed before us. Sir pls tell me how to fix seniority in this matter.

Supposed some 3 nos candidates recommended by service commission in 2005 but... state government of that time not given cabinet approval to give appointment or offer that time ......but after in year 2013 government takes agree to give a offer and appointments these 3 nos of officer .....but due course of time during 2006, 2011, 2013 some candidates 14 nos had selected by selection commission and joined in department before 3 nos of those......than who will consider senior? Sir, mera appointment 2009 Group-C me hua tha,,, uske baad next appointment Group-C 2010 me hui jisme same year me departmental quota se 15 Group-D se Group C me bhi promote hue..
In 2017 me 800 employees 1 judgement se promote kie gae who qualified 5 years of service.
Us 800 me main promote nahi ho paya because vacancy full ho gai but 1 Group D se promote 2010 ka official reserve category se promote hua ST ki vacancy k against. Main 1 batch pehle select hua but wo official Departmental quota se promote hone k baad mujhse pehle promote ho gya.
Kya koi rule etc hai jis se stepup claim kar sake because wo junior tha. (Previous batch junior promoted from group-D)
Promotion is right.In case of SC ST if no suitable candidate is found,3 to 4 times of the quota may be considered going down the seniority list.

If notification is same in case of direct recruitment, but dates of joining are diff. due to delay in results by recruiting agency who will be promoted first meritorious or who joined earlier .
सर मैरा सेलेकशन वर्ष 2013 में MES department में direct recruitment से मेट पोस्ट पर हुआ जिसमे मेरा फाइनल सिलेक्शन मेरिट नंबर 03 लेकिन मैने joining बाकि सारे candidate के बाद में किया यानी मेरी ज्वाइनिंग डेट सब candidstes के बाद थी , department ने date of joining ko seniority का base मानते हुए जिसने पहले ज्वाइन किया उसको सीनियर माना और मेरिट base पर सीनियरिटी प्रदान नहीं की जिस कारण मैं बाकी कैंडिडेट्स से सबसे जूनियर हो गया....उसके बाद वर्ष 2017 Mate post से SK यानी सेमी स्किल्ड पर हुआ तथा oct 2021 में Sk post से HS( 2) पर प्रमोशन दिया गया जिसमें मेरा प्रमोशन नहीं हुआ जो की डेट ऑफ joining के आधार पर seniority base पर हुआ Merit base पर नही...अब मुझे क्या करना चाहिए कृपया मार्गदर्शन करे

Sir मेरा चयन 2019 ESIC UDC recruitment में हुआ था जिसका offer of appointment Nov 2022 में D V के समय दिया गया था और उसी समय accept कर के जमा करा लिया गया था। 7 जनवरी 2020 को joining letter mail द्वारा प्राप्त हुआ और 21 जनवरी तक join करने का आदेश था। मैंने 3 माह का extension लेने के लिए पत्र लिखा लेकिन कोई official reply नहीं आया। 11 अप्रैल को मैंने join कर लिया। Final merit में मेरा स्थान 3 था और 7 व्यक्तियों ने 20 जनवरी से पहले join कर लिया था। अब promotion के समय क्या मेरी seniority पर कोई असर पड़ेगा। कृपया मार्गदर्शन करें। धन्यवाद।

Sir मेरा selection ESIC UDC 2019 में हुआ था जिसका offer of appointment Nov 2019 में दिया गया था और 7 जनवरी 2020 को joining letter जारी किया गया था। 21 जनवरी 2020 से पहले joining करने का आदेश दिया गया था। मेरे साथ 15 candidate select हुए थे जिसमें मेरा 5th rank था। सभी candidates ने 20 जनवरी 2020 से पहले ही join कर लिया था लेकिन मैंने 3 माह का extension के लिए पत्र लिखा था जिसका कोई official reply नहीं आया और मैंने 11 अप्रैल 2020 को join कर लिया था। इस बीच कोई waiting list जारी नहीं हुई थी। क्या promotion के समय में मेरी seniority merit के अनुसार 5th रहेगी या कुछ बदलाव होगा। आपके मार्गदर्शन का आकांक्षी हूं। धन्यवाद।

Sir, I am looking for a legal advice in matter of service and law.
Candidate 'A' (OBC cat.) joined the central govt. Post from select list/ main list on Dec 2017. (Office published the select list dt. 10-11-2017) After that office operate the reserve list/ wait list in exigencies to fill the vacant post (which was created after some officials from main list left the post or resigned). Office operated the wait list and published the result dt. 29-06-2018. A waiting list candidate 'B' (UR cat.) Joined the post in the month July- Aug 2018. Obviously UR candidate from wait list secure the higher marks than OBC cat.
Now office has finalized the seniority and placed the wait list candidate enbloc senior to 'A'.
It's seems not according to DoPT 11:11:2010 (a candidate from earlier selection be senior to those from subsequent selection)
Now, the question is that how the seniority will be fixed between both candidates.

Since he has joined from the same recruitment list, he will be placed as per the order of merit of original merit list. But if an OBC candidate had left job then his category OBC candidate should have been called as the reserve list is drawn category wise. So in case of main OBC candidate leaving, the first candidate from the Reserve OBC list should have been called.

In case of technical resignation, if you return to your parent department within 2-3 years,your seniority will be maintained

You should be placed above the latest batch joining after your date of actual joining.

Lowest in cadre from any Direct and Promotion candidate but upper in seniority from Compassionate appointment candidate in particular year only. See rule in Swamy Handbook in Seniority of Compassionate Appointment.

Sir, I have joined under obc category in the central govt. department in 2015, now my department organise a LDCE, and my category has been changed to ST from OBC. Can I now put ST certificate in my department and appear in the LDCE.
You know the truth. If they have done the mistake then ask them to change. Because when you joined the service the caste and category claimed by you will prevail over any claim.
