It's the legal system that i have issues with because it wasn't one person where my bad experience was had. It was the system as a whole and its bias. It was a barrister who once said the truth is whatever can be agreed upon. The law is about perception, with very few facts.

      If it's shown overseas, I don't think that matters. Heaps of people who are kept anonymous by the judicial system have their names leaked by overseas press publishing overseas.
      It's actually the only way to find out about things, when they are kept closed for political reasons.

    DS. Thank you for getting involved. TR fans (including me) do not hold the judiciary in very high regard most of it may be due to ignorance of the law. Following TR over the last 15 years he seems to have been treated differently. To hear an active barrister discussing his case and all the problems that might bring professionally is refreshing.

      Yep if there's any avenue for them to retrospectively say they didn't need to properly serve the injuction they'll just do that. I'd be very surprised if the judge actually threw the contempt of court out on that basis, even if that's what should happen.

    It’s great that there is somebody from the judicial service with your knowledge, qualifications and understanding to explain all areas of the laws. I do feel though that Starmer and his government have already proved that the British laws currently in existence do not matter for them and they can break rules and change laws to. suit them at the time and for future, especially with Starmer’s past role of head of CPS and now PM he puts his pressure on the judicial service and they all now bow down to what he wants no matter how wrong or against the law it maybe. So I’m pretty sure in the case of Tommy they’ll happily change anything they need to get the results they want.

      The statue shows blind justice as you know but nowadays it seems justice is blind to the truth, rather than blind to prejudice ... it is certainly hard to see any objective justice in recent cases as there are glaring discrepancies.       @@davidgavin7280 Initially Tommy didn't play the documentary, an American company did and it was not under the restrictions set down by British law. Thus Tommy, in person, hasn't breached the injunction. How the American company got hold of a copy of the documentary is subject to American law not British so, again, Tommy cannot be held responsible for it's distribution. Everyone knows that the internet is capable of making certain streams go 'viral' and I, myself, viewed the documentary from the American source. Does that mean that I am guilty of 'contempt of court' too?
      As for the second showing of the documentary earlier this year, technically Tommy is guilty but due to the way that the injunction was posted by email I would suggest that that could have come via Hate not Hope's offices rather than a judge in chambers so I would have no faith in it being a real court order.

    Can we all agree that no matter the circumstances, TR Will be found in contempt as this is a political judgement and not a legal judgement. Colour of law was used in the original judgement and didn't follow precedence. Try proving your being set up by the judge even though we know it's a frequent event ie the recent 3 Yr sentence passed down for an I'll conceived social media post by a tory councillors wife.     If Serving via 1st Class Post, make sure you only ever do that via a Post Office, and get a Proof of Posting Certificate ("PoP") at the same time. Keep the original PoP, and keep that safe. This adds powerful original Hard Copy evidence that you did send it, and exactly when, even if the other side later contrive to deny receipt.

      @@Will-re8bt Agreed it doesn't mean they will get it, and I entirely accept that. However, in the scenario I outlined above, that is not really the key issue, strange as that may seem. The key is when armed with Proof of Posting, the actual delivery is effectively not your problem. The key is you can show compliance with whatever the Court require for Service, and that's backed up by things like The Interpretation Act 1978 and the later 1984 Queen's Bench Practice Direction, which set out what the Court will accept in terms of the ordinary course of the post, and the assumed time scales when sent via 1st or 2nd Class. Basically, if sent via 1st Class Post, the thing is Deemed to have been Served after the 2nd Working Day after posting. In simple terms, you did your bit, when required, and the Court will have no option but to accept that, rather than the compliance step for Service being open to challenge.
      Probably also wise to take an image of the letter as well, before sending, to add further evidence that it was also correctly addressed, albeit the Proof of Posting should also state the Postcode of the addressee, which should be enough.
      Something that is unclear, is if sending via Recorded Delivery or Special Delivery, are those covered by the same Interpretations, when neither are specifically mentioned?

    I do find this whole thing extremely strange for a ‘modern’ ‘civilised’ Country like the UK.
    Does the actual truth no longer matter when it comes to the law? Surely that should be the basis of everything! If someone uncovers the truth about a situation, why is that a bad thing?

    about 10 years ago i was offered a live in job so i handed my notice in then they withdrew the job offer, when i looked into recompense i was told an email is not a legal document

    I was walking in to the hallway of the family court one morning in 2008 , I met the opposition solicitor and the court welfare officer, they looked at me and I said, "good morning muppets", about a half an hour later, I was brought in to the court and sentenced to 21days for contempt 😮

      Yet some of the parties to family law cases repeatedly and flagrantly ignore access orders for the other parent to see their children and they are almost never held in contempt.
      There was an item on it on BBC radio 4 a few years back. Another form of two tier justice.

    Courts do what they like. I raised several errors in court procedure in a recent case and got told by the judge I was nit picking and it was guidance. After much complaining I got a 'gesture of goodwill' payment....no accountability, no one reprimanded, no financial penalty.

    Thank you for explaining the service of documents in England to the average layman. This helps to put in context what is going on with Tommy Robinson and his recent arrest for contempt of court. My heart also goes out to Peter Lynch's family for their loss of a great man who was imprisoned for almost 3 years for a minor matter in a protest. He was not rioting as the main stream media continues to lie about. Shameful what is going on and how Keir Starmer is acting and treating honest and innocent British people.

    I just made a call (November 2nd) to where he is currently allegedly being kept. I was enquiring about an email address for the G0v so that I could communicate my concerns for safety of this person. I never mentioned who it was. And they NEVER asked. But the response was bizarre. I was informed that they have been told there is no email to give out but I could WRITE a LETTER. That was the preferred method. I said , again, that it was a safety - immediate- concern and it was the weekend therefore the letter suggestion wasn't ideal. I was told again that the letter was the option they were good to offer. Bizarre

    1st class mail is considered a good service? I'm getting mail for other people delivered to my house because someone misread the address at the post office. Had I not delivered them myself (was nearby) the recipient would have never got them.

      Because the conviction and sentence is already fixed before he gets arrested. A jury would be an inconvenience for the government.

    So, if I get these alleged breaches of the injunction right… one was repeating the forbidden allegations in an interview with Jordan Peterson (believed made in Canada, so potentially outside the courts Jurisdiction) and the other breach was someone (not necessarily Tommy) showing a film in London where the forbidden allegations were repeated (on the film) by Tommy… but was filmed prior to the injunction being put in place. Whole thing sounds very uncertain to me.

    I thought your comments on the "family court" was amusing. I've had to go there twice: the first time was a necessity as my ex was in a relationship with someone disreputable (he was no longer there by the time CAFCASS came to investigate...so all was well apparently); the second time I realized what the function of the family court was...my ex had become homeless in the intervening period, and had got a subsidized dwelling, lifetime tenancy with potential deferred home ownership - all for 50% of childcare, while I had to "prove" my parenting to the authorities which required my ex agreeing to equal childcare AND by going to court to get an "equal shared care order".
    The second time, after 18 months, I realized the function of the court is to control fathers.

    So Posting by Royal mail is sufficient to demonstrate it's arrival which is not to be challenged. Can anyone else think of where businesses connected to the Post Office have been a tad unreliable? Answers on a post card - however, send the answers by DHL

    The judiciary has got it wrong with TR many times & cost him £thousands to prove this. No compensation though, the process & the costs are the punishment.
