Just for clarification. If you cannot get an appointment at an Italian consulate in the US for months an Italian attorney can file for recognition of Jure Sanguinis ONLY in the court where your ancestor lived? Or can they file where they are located? or is there a choice?

The Law requires to file in the Italian Immigration court where the Italian ancestor was from.

The Detroit consulate just opened up spots for January 2027, apparently this week. I missed that until today, and now there are no spots. I'm definitely going to do this in Italy, possibly with Bersani's assistance. The backlog is ridiculous, and I don't want to wait that long.

We suggest to hire a professional genealogist.
If it cannot be found yet, reach us to check if it’s possible to have a new done through a court petition.

Am I allowed to stay in Italy while waiting for the process?

No, you can’t have a residence permit because of that.

My brother was allowed to stay in Italy when he did his in Palermo. They actually said it was a requirement that he had to wait in Italy and he did for 4 months and he obtained his Italian passport and card. Los Angeles didn’t have any appointments and our case is easy, both parents born in Sicily and migrated to the USA so we only needed our mother’s birth certificate

@@Behemoth66 That is because there is a difference between applying at an Italian comune and applying through an Italian court

I've been trying for over a year to get an appointment through the Houston Consulate. Thanks to Covid it took me over 2+ years to source all of my documents in the U.S. If I could take a year off of work, I'd just go to Italy and spend the time studying Italian history, language, and culture. Now that there is a digital nomad visa I'm wondering if that might be a path that would allow me to work remotely while I apply in Italy.

The examples given deal with the inability to get any response from the local consulate. What about situations where there is a waiting list that is being processed at a rate that would involve a 10-15 year wait (New York, USA)? Have any cases been adjudicated for people affected by that?

    • @lawfirmbersani

Good morning, the infinite waitlist is the same as not providing appointments .

It took me 5 months of trying all hours of the day and night. I was so shocked I got passed the page to make an appointment. I found out that I am 7,548 on a waiting list in NYC. I was told not to cancel myself on the wait list. If I move out of NJ and go to another state in the US am I supposed to keep my appointment in NYC or try and get another appointment in the state I move too? Or am I allowed to fly to NYC from the new state? Im not sure what I am doing now. I may move in the US and wait or move to Italy and do it there. In the meantime I am trying to learn how to speak Italian. Mine is a simple case GF, F, Me.

If you were born in the USA after your parents naturalized and before 1992 = you won’t qualify.
