    If example po may annotation ang TCT na ang owner na nang lupa ay and Landbank of the Philippines since 1995 po? Tapos Yung lupa ay tilled by a tenant farmer for 25 years without the presence and support of the owner...pero ang nakalagay pa rin na owner sa title ay yilung mga anak ng dating owner. Ano pong previleges or advantage nito sa farmer?

    Gud pm ho I hope n masagot ang question ko.
    1. Sa Contract ng housing loan under hdmf may tatak ang photocopy ng TCT( may deed of assignment ang developer sa hdmf), Memorandum of encumbrance. Lahat nagng entry transaction sa bilihan ng property or Deeds of Sale ay may word n Cancelled sa statement, at bawat page ay may malaking CANCELLED. At duon mismo sa lower part ng CERTIFICATE OF TITLE ay may cancelled. Meaning ito ay Void or Fake title.
    Now, lahat yan ay documented sa RD, but ang masaklap alam ng RD n void ito still nag I issue sila ng fake title duon sa new owner n nag process ng transfered title dhl nag fully paid n ang housing loan sa hdmf at, n ibenta at na ibenta nang hnd nag kakaroon ng filling for Petition for cancellation of emcumbrance. If it is not a clean Title what is the real status of this Title that we acquired from hdmf. People are not aware of it, they never inform the borrower regarding this matter. So what do we gonna do this? Thank you

    The answer is yes, foreigners may own real estate property in the Philippines, but they are not allowed to buy and own land. Foreign ownership of property in our country is not absolute and subject to restrictions. Non-Filipinos may purchase and own condominium units built on Philippine soil.

    Hi atty, paano kung ang awardee ng farm lot nakabayad na in a direct payment, sa unang may ari ng lupa at may titulo na ito , ngunit may naka annotate na emcumbrace hindi na certify na bayad na in a direct payment , patay na at walng surving hier, paano mapa certify ito , at kanselahin ni ROD?     Attorney, galing po ng DAR at binayaran na in full ang property. may mga resibo naman. Ang clarification ko po, pag ba nagpatangal ng annotation sa title, as in hindi napo kasamang mapi-print yon pag kumuha ng bagong title sa RD? Yung naka annotate sa title ay may na-cancel narin. Annotation sa taas na bahagi ng papel, at sa baba naman ang cancelled.

    Atty. san po ba magstart mag count for 2 years? Sa Date of Entry po ba or Date of Instrument kapag may naka annotate na section 4 rule 74?
    Aug 2022 po kasi ang Date of Entry pero ang Date of Instrument naman po ay Oct 2021 nakapagapagawa na po kasi kami sa abogado pero nung papaya na po namin sa RD ayaw naman pong tanggapin, di pa daw po lapsed ang 2 yrs ano po kaya ang tama? thanks po

    Good day Atty Oliva 😊 Thanks for the information you shared in this video. Sa 11:44 po you mentioned that the encumbrances should be cleared through the court for a title to be considered “clean”. What if po deed of restrictions from the developer and cancellation of mortgage ang nasa memorandum of encumbrances ng isang titulo? Need pa rin po ba ito ipa-clear? Or safe na po ba bilhin considering paid na po ang mortgage and annotated na, and the deed of restrictions po is yung mga guidelines/limits lang sa house construction ng HOA ng isang exclusive subdivision? Thanks so much po

      these annotations do not have any significant effect on this specific title that would give an alert to the potential buyer that this property is not "safe to buy".

    NOn-filipinos are not allowed to own real state here in the Philippines but. if non-filipino is former Filipino (naturalized). He/she is entitled to buy or own real estate with limitations (size of land)

    Good day Atty! I hope you could answer this. Ano po kaya ang gagawin sa lupang nakapiyansa? Ginamit daw po dati ng lolo ko para piyansahan ang kamag anak. Hindi po namin alam gagawin. Pinapabalik balik lang kami pero di po nagbibigay ng instructions ang registry of deeds. Salamat po.

    Hello po atty my nabili po Kmi property pero hndi agad natransfer s name nmin..that was yr 1994.. after 26 yrs pinalipat n nmin titulo sa anak ko.. at meron nakalagay dun memorandum of encumbrances subject to liabilities imposed under sec 4 rule 74 against the estate of the deceased within 2 years mar 1994..ano po gagawin nmin para maclear ang encumbrances atty?? Pde b iloan ung title kahit n meron MOE?

      i suggest that you have a legal consultation with your lawyer so you can discuss the process of the cancellation of encumbrance. and i cannot answer if financial institutions will accept land titles with annotations in the encumbrance part of the title. it is best to ask the institution directly.

    Good evening po attorney! Ask ko LAng po, Yung portion po kasi ng lote namin, nasakop po ng ambuklaw. Bibilhin daw po ng ngcp. Sabi po patatakan LAng ang titulo sa Rd. Ayaw po nila ng ibukod ng title Yung portion ng lote na nasakop. Ang worried ko po baka pagdating ng panahon mag ka problema po kami sa titulo pag gusto na po naming isubdivide sa aming magkakapatid.     Ask ko lang yung binigay po sakin na title ay may memorandum of Encumbrances, nabili ko po sya sa mismo na registered owner. Mana po nila sa kanilang magulang. Parcel Lang po nabili ko na may sukat 235 square meter. Ngayon hinihingian po nila ako ng share na pambayad sa landbank para po maalis ang memorandum of encumbrances. Kailangan ko po ba magbigay eh kasama po yun sa bayad sa binenta nilang parcel lot. Ano po ba dapat ko gawin para maalis yung memorandum of encumbrances Atty? Kung tutuusin utang po nila yun, sabi po nila bago bilhin nagbabayad po cla sa landbank. Kaya po namin nabili. Sabi nila gastos po nila lahat patitulo, covered na lahat sa total amount na bentahan. Magbibigay po ba ako ng share at ano po ba ang gagawin ko Atty para maalis ang memorandum of encumbrances??? Sana po matulungan nyo ako Atty? Salamat po!

I want to ask 1 important question, does ROD have the right or allowed change the title from original to new one without consent of the owner? Kasi po may kilala ako nag loan po sya sa pag ibig original title ang binigay nya sa pag ibig, ngaun nong eclaim nya na ang title kasi finish na nya binabayaran ang loan sa pag ibig housing loan, ang binigay sa kanya bago ng title pero same title number, owners name, at square mtr. Now dumiritso na sya sa ROD for cancellation of mortgage, pero nong pag check sa system naka register po yung old original na una nyang binigay sa pag ibig. tapos accrdg sa ROD may mali raw sa Technical discription , namatay daw yung taga pirma kaya di nila makuha sa vault ang original title, kaya nila pinalitan ng new title, pwedi lang ba yun?     Atty. TY for the very informative video. Question po, my OFW Tita is selling her land due to medical emergency. How can we execute SPA for my other Tita to facilitate the selling. She's separated for more than 15years but the legal separation not yet completed since she's an OFW. Is it sending her the SPA via email and sign then returned the scan signed copy will suffice.     Question po. If property is 8,000 sq m but the annotated encumbrances are 700 and 450 sq m. Does that meam that the remaining can be sold?

      The entire property may be sold but the encumbrance, whatever it is, will be shouldered/transferred to the buyer. If the encumbrance is a prohibition to sell the affected portion of the property, then only the unencumbered portion may be sold.
      Encumbrances on the property may not necessarily be prohibition to sell. So you need to check what exactly is the encumbrance.

    Nakabili ako ng bukirin at naitransfer na din sa pangalan ko ang titulo.
    Half hectare ito.
    Ngunit my memorandum of encumbrances sa 3rd page ng tct saying “ the farm/home lot described in this emancipation patent is encumbered in favor of land bank of the phil. To ensure full payment of its value under pd 27/Loi 705 by the farmer benificiary named herein date feb 18,1987’
    - meaning po ba my utang ako ang lote sa landbank? O di na po ito effective dahil sa mga pagbabago ng laws kung meron man.

    Gudpm. Ask po kung ano dapat gawin. Sa RD npo sana kaso nakita na may memo of encumbrance. Sabi ng RD ay hingi ng clearance sa NHA. Magkano po aabutin pag humingi ng clearance sa NHA? Kasi pagpunta dun ay sabi agad 160k daw pra ayusin at may bibigyan daw sa loob. Ano po dapat gawin. Salamat po. Godbless

    hi po. paano po kung patay n yung pinagsanlaan ni lolo? wala dinpong macontact na kamag anak or anak yung pinagsanlaan? hindi din po sila aware na muntik n makuha ng city hall yung property nmin kasi since 1987 pa po hndi nabayaran amilya. 2019 lang nmin nabayran. buti may amnesty si yorme mejo bumababa po binayaran. pls help. thanks

    Good day atty. Is it safe to assume na if hawak na yung title nong owner, bayad na yung mortgage and hindi lang napa cancel sa RD? Naka annotate pa kase na incumbrance dun sa title. Patay na yung parents na naka pangalan sa title. 1971 pa yung mortgage. Hope you can help us po. Thanks

    Hello Atty,ask ko po sna ano po ibig sbhin ng memorandum of encumbrance and my deed of agreement for road right of way sa title nmin.
    My organization na nagpplan na ipaayos daan,nung nkita nla yun,dna dw nla kailangan ng consent from us,kc sbi nla my encumbrance nmn pla and iba dw nagbigay ng daan.

What if sa 3rd page yung memorandum of encumbrances ang nakalagay po is liabilities under section 4 rule 74 to creditors, heir, etc...... extrajudicially settled for a period of 2years pursuant to section 4 rule 74 dof the rules of the court?     Good pm attorney. Yong bibilhin kong property may naka sangla sa bank at memorandum of encumbrance din. Sabi ni owner pag nag bayad ako tutubusin nya sa bank ang title. Madali lang po ba ying matangal pag si owner nag nag tubos sa bank. Automatic ba yon na matatangal ano annotaion from bank? Safe po ba ito bilhin? Thanks.

    Tanong ko lang po, naka indicate po sa encumbrance ko is sec 7 article 27, naka saad po ang date is feb 2008 pa po tapos 2 yrs hanggang 2 yrs lang daw ung encumbrance na yun. Gusto ko po sana iloan ung title sa pag ibig kaso d nila tinatanggap.
    If mag petition to cancel sa encumbrance, more or less magkano lahat2 ma gagasto sa process na ito? Magkano po average acceptance fee ng isang lawyer sa ganitong case. Thank you.

    Hi Attorney, maaari na po bang maexecute ng deed of absolute sale kahit may annotation pa ang title na "encumbered to Landbank". May certificate of full payment na po pero hindi pa napapacancel ang annotation. Maaari ho bang si buyer na ang magpacancel?

    Hello po atty bagong subscriber nyo po ako., meron po sana akung concern. Paano po kapag ung lupa ay inaplayan sa denr tpos after nmatay Nung nag apply nakansela ung application at nae award ito sa mga tao/sa barangay dhil wla ni isa saga kamag anak ang nag show NG interest sa lupa., then after so many years naging barangay sya ngayon meron na cxa mga permanent building like barangay Hall, health center, elementary school daycare center at barangay gym meron din market site. Composed of more or less 300families nadin cxa., bigla lumutang anak daw NG may ari para e claim ang lupa NG papa nya. Mayron papo ba karapatan ung anak nya sa lupa kahit na pina cancelled na ng denr ang application NG tatay nya dhil na abandoned na ang area. Any advice po attorney salamat po Godbless

    Atty. Good day po. Ask ko lang po, ano po ibig sabihin ng CANCELLED sa Memorandum of Encumbrances. Kasi po napasama po yung annotation ng father ko. May nag petition po kasi ng cancellation of adverse claim. Sino po ang nag cancel ang Registry of Deeds ba o ang nagpetition? Kasi po noong time na nag petition wala po na recieve ang father ko ng notice from the court kasi ang sabi niyo po dapat ikakaso muna. Ano po ibig sabihin sa nakatatak na CANCELLED sa Memorandum of Encumbrances. Salamat po.

      This means that the annotation in your title is no longer effective. It is as if the encumbrance is no longer written in the title. Hope this answers your question.

Pero yung deed of sale po ay nasa kanya pa rin po at naka annotate po doon sa mother title. Paano po na cancel ang adverse claim ng father ko na wala po siyang alam. Pwede po ba ipa cancel ang adverse claim na walang alam ang may ari ng parcel na naka annotate po sa mother title? Bakit po sa local registry sa assessor sa municipal ay nakaka recieve pa rin po ng tax payment notice ang father ko po. Pwede po pa topic ng ganitong case po atty. para sa idea lang po. Salamat

      It depends if you have the complete documents, the work load of your handling lawyer, the docket of the court, etc. so I cannot give you any timeline

      magandang gabi po atty. pwedi po ba kaming makakuha ng decesion sa rtc kasi kailangan daw po sa rd para ma cancela yong encumbrance na nakalagay sa title po namin salamat po.
