Students Want A National Hate Speech Law...But Can't Define Hate Speech

  • A member of former Vice President Joe Biden's transition team wrote an op-ed in 2019 calling for America to consider enacting "hate speech" laws.
The news comes after several polls have shown a growing number of Americans, particularly young Americans, support a "hate speech" exception to the First Amendment. In light of this, Campus Reform went to the University of Florida to get students' thoughts on a potential national hate speech law, and whether they could define what constitutes "hate speech."

It's also a commonly misunderstood quote. Look into the context of it. I don't think he would disagree with the current application of it, but it isn't what he meant when he said it. The PA state legislature was in a bit of an argument with the Penn family. They needed money to defend the state during the French and Indian War and the Penn family was effectively extorting them for the money by saying something along the lines of "Okay, we'll give you money, but you have to admit that you don't actually have the authority to take our money." The quote came from a letter from Franklin I believe to the PA governor at the time.

Just once I’d like to have a student answer the question like this; that question was decided in 1969 by the Supreme Court in response to Brandenburg v. Ohio by the count 9-0 that any speech no matter how vile is protected by the 1st Amendment to the Constitution. Oliver Wendell Holmes wrote the position. Mr. Brandenburg was a member of the KKK and was the very definition of vile racist, however his speech is protected as long as it does not incite violence. (Now known as the Brandenburg Test). It’s argued now most commonly “what is the definition of violence?”

The issue is that we don't teach how to distinguish the fallacy from a logical progression properly. If you have direct evidence of the slippery slope existing in the context you're discussing (such as a group pushing for hate speech laws that keep continually redefining what 'hate speech' actually MEANS), then it's not a fallacy.
