Texas Workers' Comp Law: Can You Sue Your Employer For a Work-Related Injury?

  • Did you know that roughly ⅓ of Texas employers do not offer workers’ compensation?
This means that if a Texan is injured on the job in a place like HEB, the path to financial recovery is potentially more complicated.
The good news is that they may have multiple avenues of compensation to pursue.

I am 66 years old being harassed and treated like I did 9/11 or something. I want to file a workman's comp case against my employer. That employer San Joaquin county human service agency. For wrongful termination as an employee after a car wreck that I was not charged with being the cause of.

My wife worked for Office Depot 8 years, had a work slip and fall in a pothole at the entryway to the store while doing a carryout for a customer. All caught on camera. In Texas, so they are nonsubscribers. TERRIBLE. So she had to get a attorney and sue them. Her case is at arbitration now. She was just told the case was moved to a different jurisdiction or something recently. Not sure if that's good or bad. She gets treatment via the Lawyer we hired, at a pain Managment facility in Dallas. She gets plasma injections in her knees and hands. its BEEN GOING ON SINCE JULY 2023. The pothole was there almost 2 years. Even her store manager said very sorry, we thought we had that filled a year ago. THAT seems like negligence, so we are suing them. The manager admitted fault. We have 30k in medical bills with the Lawyers doctors so far. The Lawyer seems to think her case is strong or he wouldn't have taken it. Any idea what we can expect with this arbitration that's currently happening? Shes physically in bad shape and we are in debt. Its been a year nowTY

Care about people including those they work with everyday at work. Tulsa DHS would have never done that to me here in Tulsa where I worked for them doing the same job in March 1998.

Btw the 3rd party adm insurance they have at office depot is being sued to. I won't name them here. But they are global. They were neglegent, slow walking and denying her pain management. It was awful.

I’m at the “MMI” phase of my Tx. W/C 2020 case with the BRC. It’s a Covid-19W/C case; Pulmonologist noes reviewed by a Family PCP?? Shouldn’t W/C utilize a Pulmonologist to review a Pulmonologist’s notes vs Family PCP who does not specialize in Pulmonology? Is it FAIR to the W/C Worker???

I hurt my back at work ( Lumbar strain ) when I was lifting a box of tomatoes, I notified my supervisor and he did a report and I was sent home for the day. The next day they sent me to see their doctor and they did a drug test on me and I tested positive for marijuana. So now the insurance company said that they are denying my claim. Update: I was drug tested 5 times in 7 months of working there and was released by the company 4 months after I was injured. Now I'm unemployed and not receiving benefits anymore and I still feel pain every now and then, depending on what I'm doing.

@@Eatmykitty69 Drugs? I'm a grown ass man and on my Off-Time, I can do whatever I please to do. As long as I am not under the influence at work, that's all that should matter. It was a produce warehouse job and I was not operating any machines or dangerous equipment for the company. Question: So, why all the drug tests? Answer: Because I injured myself while working and they wanted to get rid of me asap.
