Let's Review the "Ending Telework" for Federal Employee Executive Order

- National Employment lawyer, Morris E. Fischer, reviews the Executive Order signed by President Trump forcing all federal employees to report to physical offices and effectively end their telework agreements. He discusses the constitutionality of this order, it's consistency with applicable law and what federal employees can do about it now. We invite viewers to contact our office (800) 209-2608 or visit our website www.morrisfischerlaw.com for more information.
Speaking as a federal employee who's teleworked long before Covid, I resent the phrase "getting federal employees back to work." If my agency wasn't telework ready during Covid, there wouldn't have been any work done for nearly two years, which would have created an enormous backlog of work and cost to the government. This notion that people aren't working unless they report to a physical office is ludicrous.
@@bastidface agreed!
Couldn't agree more! The misnomer is that people at home aren't working. CMS workers busted their tails during COVID, and I knew of no complaints that the work wasn't getting done. That is why I maintain that it's not really about improving efficiency, but instead about protecting the lease holders and area restaurants.
Well said!
@@bp6877 And federal workers are the pawns in all of this. This is what we get for our hard work and dedication. Makes me ill. Hope everyone brings their lunch to the office.
@@bp6877 Exactly!
The sole reason companies want people to return to the office is because billionaires are losing their fortunes due to empty and decaying corporate real estate / office buildings. Just “passively protest” by not spending any money downtown. Bring your lunch, buy your gas near home, shop locally or virtually etc.
Exactly! Amen!
Absolutely!
Not to mention having to pay extortion rates to park downtown.
You are right except this is a federal order, not a corporate order. The empty buildings are owned by us and is very wasteful if they sit empty. Also, I work remotely and have on and off the last 15 years. It is 100% true that remote workers are not as efficient. We all know it who work remote. When I worked in house, I did get a lot more done.
@@dee2220 Respectfully, your comment speaks more about your work ethic than for the rest of us. The claim that "it's 100% true that remote workers are not as efficient" is an untrue statement. Particularly with the evolution of technology like Zoom and MS Teams, remote worker efficiency has skyrocketed, and not only is this true in my own personal experience, but it's also true from recent data compiled on the issue. Regarding empty buildings, the way to reduce costs to the American taxpayer is to get rid of them, which is exactly what agencies like the Patent Office have done. Other agencies have similarly reduced their footprint. Normally, I would not continue to comment on a TH-cam episode, but it's critically important that this issue is understood correctly and accurately, because the work lives of federal workers are riding on it.
Telework has been around for a couple of decades. The Telework Enhancement Act of 2010 encouraged the use of telework as a recruiting tool to attract workers to the government. Government employees in fields that were able to telework have been doing so for many years long before covid.
I acknowledge that during covid, telework was further expanded.
It's just unfortunate that the Trump admin is trying to unwind telework as if it didn't exist prior to covid.
Exactly! Its objectives were: 1. Greater work life balance; 2. reduce burden on the nation's roads; 3. To enable the government to continue to operate in the event of a national emergency. Obviously, none of these objectives are being met by requiring all workers to return to brick and mortar buildings. One size fits all solutions are awful solutions, but so attractive to politicians, because they're devoid of nuance.
when my office went to virtual status, we were about 15% more effective, AND consider the fact that if the government hadnt done so already, they would not have to pay rent for any building space -- so its a win win. This here with Trump is all about Boomers hating work from home, and protecting the land lords and the local eateries downtown. NOTHING MORE. Ill probably quit and go get a contractor job. 100% virtual still
@@AtlanRau I agree..we were on a hybrid schedule, which worked well and the work was still being done when we had facility and or agency closures. I will only go the contractor route after I secure my retirement. There's also the option of state and local governments, many of who are still on telework and in some instances, have better pay, depending on the field.
For sure..I have a couple of cousins who have since retired from the private sector and they were teleworking back in the late 80s. Of course the technology has come a long way since, but it worked.
I have watched several videos now and no one ever mentions the Telework Enhancement Act of 2010. Read the purpose of the Act. How can the executive order countermand statute? Because he is just going to get away with it unless someone sues?
Ive been a Fed employee for 25 years. Ive been TWing 3-4 days a week since 2009. I dont understand the reasoning behind 'return to work.' DOGE is bragging about saving $420m last week by breaking govt leases on buildings, yet the President wants to fill up empty buildings? Why not break those leases?
There is not a single piece of data that shows any federal agency or administration's performance decreased because of telework.
Many TW so they dont have to spend 10+ hours a week in traffic, wasting time and gas money. This order doesn't just putbodies back in cubicles, it takes money out of our pockets and time away from our families.
I will repeat myself: I just do not understand. What is the difference between me being on Teams and Zoom calls from my home office vs a tiny cubicle?
What savings does this offer the tax payer? Will efficiency from returning to the office be measured? What benefit is expected? Many of us built our lives around TW after the 2010 Telework Act...now it feels as if we are being punished for creating a work/life balance.
update: today, 1/27/2025, i received direction to be in office 5 days a week. effective immediately,no time to adjust at all.
things returning to work does not do: improve efficiency, save tax payer money
things returning to work does do: piss off an entire workforce, take away time from families bc of commutes, takes money out of our pockets for gas, increases mental and physical stress
@@Cornergrip I’m guessing one of the reasons for this is to reduce the federal workforce.
@@vicariousjohnson9823 DING! Instead of reducing size by attrition, or filtering out low performers, or offering a RIF, or eliminating positions which are not necessary, this administration has decided to blanket every federal employee with this, essentially, punishing those people who do work hard and have managed work life balance. TW, a pension, and job security were some of the benefits of being a federal employee. TW and job security are now gone and pension calculations are being challenged, but the govt still wants to recruit the 'best and the brightest.' GOOD LUCK! Wait until they realize the federal workforce is underpaid by 27% when compared to private sector counterparts. Example: What kind of Engineer wants to work for the Federal Govt at a starting salary of $65k/year?
You’ll understand once they make changes to H1B Visas and import the same work at a fraction of the price. They’re forcing people to resign- their solution will be to make that visa more accessible and easier to obtain.
@@DLFitness1 The two have nothing to do with each other. Liberals are fantastic at creating fantasy scenarios that only serve to hurt their own feelings.
With Microsoft Teams, Zoom, and the like, what is the point of going back to the office, other than facilitating micromanagement?
protecting the local area restaurants and bars ...seriously.
@@AtlanRauI bring my very healthy lunch everyday. Who has time to go to lunch. After work, I go home. It is a workday. Who spends any money?
Yeah, I plan on pushing for 100% telework as per my disability!
Unfortunately "while I was on leave, I slipped and fell and hurt my back. Its just totally impossible for me to sit in a car for 1+ hr to commute to work."
Or whatever. Ill find some reason to not go back in. Ive been 100% virtual since 2016!!! Ill never go back into an office full time. NEVER.
@@AtlanRauAnother entitled fed🙄
Looking spiffy, Morris! My interpretation is slightly different: It's the "Agency Head" who makes the call, and the Master Labor Agreement will continue to delineate telework flexibilities. I'm not confident anything will actually happen until April 20th, because that's end of DOGE review period. Return to work is inefficient and burdensome; it's about protecting the financial interests of leaseholders and area restaurants, not improving efficiency.
i hope so but I don't think so as an employee...
Do you really think Trump is concerned about local restaurants?
@@jessegarman7899 Hi, Jesse! Once one realizes that the Return to the Workplace is not really about improving efficiency, saving tax dollars, or otherwise reducing administrative burden, one must ask what the actual incentives are: the best way to do that is to follow the money: Leaseholders want to maintain building leases, and restaurants want to bolster their customer bases; these are far more plausible explanations for requiring federal employees to return to the office; there are political incentives at play here, and when you consider that Trump is both a politician and a businessman, it is not unreasonable he'd be willing to sacrifice federal workers in the interest of rewarding his biggest backers: business owners!
@ So then it comes back to the beginning statement of suck it up or quit. Just like the service members who were told to take the jab or be separated. There is always a choice.
@@bp6877 Hi, bp6877, or whatever your actual name is, I don't buy your arguement. Consider that Trump is looking to move several departments out of DC altogether. INS has already announced that they will be moving to Texas. Agriculture has been told to move to the midwest, where the farmers are. He wants to scrap the Dept. of Education entirely. Yes, Some have been told that they are not moving. But his actions don't suggest to me a motive to help any billionaire restaraunt owners/ office landlords. Reducing the federal workforce through attrition, that I would be more inclined to believe. Some of The private sector has done just that.
You totally overlooked union federal employees and their collective bargaining agreements
The EO says “remote work” which is a separate status from situational or regular telework agreements.
EO does, but memos say telework.
@@isray89So the memos are not in line with the EO?
@terintiaflavius3349 Not as the EO is currently written. The memos say it is all telework, but the EO says only remote work.
I assume it was a poor understanding of the technicalities of federal work classifications that means the intent of the EO is not in line with the wording, but... That's not what the EO says.
there is a new memo coming out tonight..FYI that lumps them both together ~ and specifies its BOTH. ITS BS!
Also, it is not an EO. It is a memorandum.
Doesn't this go against the Telework Enhancement Act of 2010???
Which is a law.
right? LOL. We were in full blown telework mode back in 2016, as a manager I HAD to push telework. We were learning to manage a virtual workforce. We got rid of costly office space for the American tax payer, lowered the bill. Now it's the ruling class with a stake in corporate real estate that is fighting back. They need people in the buildings!!!
Yes, it does!
Ive been a Fed employee for 25 years. Ive been TWing 3-4 days a week since 2009. I dont understand the reasoning behind 'return to work.' Executive orders supersede laws? I am confused. (Law: Telework Enhancement Act of 2010)
Trumpeter re "creative destruction": In the age of automobiles, we do not continue riding horse and buggies, just to keep the buggy manufacturers in business; so too here, we don't go back to brick and mortar buildings after technological advancements like Zoom have made it more efficient and cost effective to work remotely. Exception: The Federal government, which is always striving to break things by creating greater inefficiencies and burdens than less!

Trump wants us to return back to our gov’t offices while he’s out golfing again. Nice.
Yes, get back to work. Should've been back in the office years ago.
Joe’s term is over. You clearly have your presidents confused. Like him or not , Trump is a machine. I don’t think the man sleeps . You are going to have to come up with something else.
@kimmy722 100%.
@@EarlyRiser71I’ve been teleworking since 2016, after I completed my internship. It was less days working from home than before Covid, but I still teleworked. My kids are grown and my home is quieter than my office.
I work hard. I know I am much more effective at home. The office is noisy, if you attend a meeting you are away from your desk, if you do the “teams” meeting-it echo’s around people’s workstations, but you can still get work done during the meeting.
This has actually reduced costs for leasing buildings and other contracting associated cost, reduced traffic, helped reduce gas prices with less demand for gas. I believe some of the national capital region folks get a metro stipend.
I feel like this is more of a - if I can’t work from home, you shouldn’t either issue.
If hes a machine im a pizza pie@kimmy722
Telework will still happen. It's called plugging your laptop into a different wall across town, getting right back on MS Teams. LOL. Do I get a private jet to fly to my "in person" meetings around the country every day? Sound exciting!
Yes, it's ironic: We report to our federal work place, and everyone participates in their respective meetings via Teams and Zoom, just as they would have at home! Folks mandating returning to the workplace shouldn't be permitted to use Zoom or Teams technology; I bet they'd change their tunes if that were the case!
@@bp6877or your job is a phone job but you're sitting in the office on the phone. As if there are no phones at home. Or something like that.
As a remote worker, my home address is my duty station. So by all rights, every day, I report to my duty station of record.
BUT SOMEHOW SINCE IM NOT IN AN OFFICE IN A SUIT AND TIE -- IM NOT GETTING ANYTHING DONE RIGHT!!
It is not an Executive Order, it is a Memorandum. The subject is Remote Work, but that it different than Telework.
I wonder how this plays out for the laws passed recently that was to create more remote jobs for military spouses due to moving frequently. I think that was a good move to help spouses financially and career wise establish work history. Are they going to roll that back for them along with everyone else? That only seems fair
I'm sure they will. It's an all out war on the middle class.
As a federal employee that works for the VA and is entirely remote, I haven’t thought about the military spouse component of this but I love learning something new. I have to be honest, this isn’t a rational decision based on data that shows employees will be more productive if they are in person vs. remote. Numerous studies have shown the exact opposite. More or less, it’s about getting people to quit and encouraging people to spend money in the local economy (which is bullshit).
Spouses are the worst hurt by this I think. Because sometimes military bases are really far away and working remotely is a huge help. Ive been a Fed since 2010 and been virtual since 2016. To suggest that "I dont do my work" because I work from home is ... more offensive than me saying the N and F slur. It's more offensive. Yet politicians have no problem constantly saying we don't do anything, we don't do any work... and then I go into work to get beaten up about doing MORE. And when we do more, we get rewarded by...coming back into the office? Bro Ill go be a contractor, for real. Fuk the feds.
From reading the comments, most agree there is not enough office space to have everyone return to the office. It makes me think new hires will be fired. Then, it sounds like the beginning of a Reduction In Force to trim the government. I see a bumpy ride ahead and this is the time to polish your resume!😮
I think some forget how these were the people that continued to work during C-Vid (when Telework first became full time) yet many others stayed home and got paid to do nothing. Most the news reporting incorrect numbers relating to telework/remote work. The actual metrics showed positive productivity by most Teleworkers but now they are considered a disgrace to the country. Curious how many of the people that want teleworkers back in office are the ones that got paid to stay home and do nothing? If reason to help the economy by spending on gas and food for lunch will it actually help/boost the economy? Lol!
I’m in full support of telework but corporations and cities are arguing that it weakens urban centers. That is absolutely true and a downside of telework for the economy. I’m not sure if there is a happy medium for both bc corporations and cities want to make money Monday through Friday instead of profiting only 2 or 3 days a week.
Well only 10% of the federal workforce is VRTUAL, the rest just telework sometime. So the news always misreports the numbers. 99% of feds arent at the office full time! Then it sounds bad.
I know a widower with a young child whose spouse died during the pandemic. His prior leadership at the highest levels found that a compelling interest to keep the experienced employee, but now faces potentially the end of remote work. And widowhood is not a protected class or disability from what I recall.
and child care isnt a valid reason to stay at home (cause you should be working not caring for your kids) - Im sure he can find a medical reason.
So many different reasons for RA now. For example, im a frequent telworker, but now the gov has dowsized offices to hoteling deaks only for teleworkers. If it's one day a week, fine if it's 5 days a week I need a sit stand desk. How am I going to get a sit stand desk if i dont have an assigned desk.
Well, I know someone whose department’s physical office is under renovation..which is not scheduled to be completed til 2027. The temporary bldg they are to report to can only accommodate 150 people. They have 350 in their department. Also which I don’t think will be taken into account, it is 45mins further away from their original office building. Today is “D” day. This memorandum or order is not written well. Department Heads it appears should really judge the feasibility of this action with a “fine tooth comb”
Even if there is a bargaining agreement negotiated by the Union?
Unions can not supersede the US Constitution, which vests ALL EXECUTIVE POWER in THE PRESIDENT! Besides, The CHINA VIRUS did NOT negotiate new labor contracts, the Fasci-Marxists simply decreed, and the dutiful comrades fell in line. Lower courts, with "Commies in Black Robes" sitting on the bench, will likely side with their comrades. The SCOTUS may or may not have the stones to apply the NYSRPA v Bruen methodology in this instance, only time will tell. SCOTUS has, however, DESTROYED "Chevron deference" and cut deep into the unconstitutional powers asserted by the unelected administrative state recently, so...
Almost none of the bargaining agreements I have read have concrete telework and remote work provisions, with the exception being the patent office that has had remote and telework for decades now.
I think people like Elon and others from industry need to spend time to learn more about how the federal gov't works and the history and regulations behind policies they are trying to change, e.g., telework, separation from gov't, BEFORE trying to change them. They may even find that there are ways to achieve their goal by using the well thought out and detailed processes already in place.
It is going to cause a massive ammount of unnecessary waste. This is beyond asinine.
To make allotments only for disabled people to be able to work from home, is discrimination to all healthy people.
But that requires actual forethought.

My team has worked on site the entire time, while many others left the office and burdened us with their work. They didn't care about us when they left. They didn't care each time their tasks got dropped in our laps. Why should I care about them now? If this does not apply to you then you won't be offended.
you are talking like they left and took naps and watched netflix or something. They were working from home. And if they were not working, why didnt you complain to your supervisor? All workers at home are being monitored so what do you think they were doing?
There is actually a new (wednesday?) OPM memo (or is it a nastygram?) with equally as vague language in it . . . .
Cutting that budget... buy giving away tons of money and getting nothing back of labor for it!

Wow! They have been doing exactly that since Obama
Quite honestly, I only feel bad for the people who have medical conditions that make working in an office difficult or embarrassing. For example, some people have bowel issues. Especially older women who've had a hysterectomy. Many of them have a side-effect called rectocele that can cause involuntary leakage of gas and stools. Working from home is much more beneficial for everybody involved. People with seizure disorders are another example. So I am hoping that *LEGITIMATE, MEDICAL* exemptions can be granted. Everybody else needs to get off the couch and go back to work like everybody else. The tax payers went back to the office three years ago.
Trump has these issues and he wears a diaper to work. No one complains about his stench.
Stop implying people working from home aren’t working. I work harder from home than I do in the office and they will soon discover that
