    I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous. Today I'm taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.     Would love to see a “know your rights” series (as an employee, renter, land owner, etc.). I think it could be both educational and really beneficial to viewers to know what their employer, landlord, etc. can and can’t do legally

    Point of Order: I would like to see something called "Interview A Lawyer," where you interview attorneys with a variety of specialties outside of your own. Civil litigants, patent law, IP law, property law, constitutional law, intelligence law etc. I come from a family with esteemed attorneys in some of these areas and really love the subject matter with a plan to pursue my own degree after my Master's in Electrical Engineering. Devin, if you can interview experts in areas of law, with which you are not as learned (I'm sure you have access to many since you're in DC), the more informed your viewers will become. Thank you, my friend.

      Well, yes and no. I feel like that question would be better directed towards a public defender, which he is not. Gauging by what we've been told, his daily lawyer life isn't full of "damaging evidence on a guy who was caught on camera and with eye witnesses assaulting someone and then pleading not guilty" situations.
      So, he is allowed that rebutle, from a certain point of view

      @@elbruces Actually it would be an incredibly long video if viewed through the scope of the Supreme Courts recent findings. Because not only do you have the fact that Native American people in Oklahoma are now not applicable to state law, but federal and tribal law. The fact that the Black hills are an Indian Reservation, that we put a National Monument in against will of the owners of that land, and then the pipeline that they put in Nebraska, that violated Native American burial rights, and has also flooded into the rivers and streams, of that reservation.
      Native American rights have been trampled time and time again, under the "needs of the government" just look at the opening of Oklahoma for Western Expansion to get some idea of the revoking of Native American rights. The state was promised to be a Native American reserve by congress and President Johnson "as long as the rivers run". Then the reneged on it with about dramatic flair of "just kidding".
      Look also at what we have done in Alaska to the Inuits. We have placed so many of them under state judicial law rather than tribal law, also not okay.
      So how would that be a short video, asking honestly.

      Some personal advice (if I may be so bold): stop comparing yourself to others in terms of professional achievements. I know it is hard to not do that, I did that for quite some time. I had to drop out of university for medical reasons a couple of years ago and was not able to achieve anything one would conventionally perceive as success since. I just try to do better than I did yesterday and set my own goals, rather than comparing myself to widely successfull people, it makes for a happier life :)

      I'm 42 with severe ADHD that wasn't properly treated until recently. As a kid I dreamed big but gradually learned not to make plans because they always fell apart. So I've bounced around doing retail and not counting on long term employment or friendships for most of my adult life.
      Last year I started a business doing something I love and am good at (transcription and captioning) and deliberately set out to provide a quality product without comparing my work to others except for ways I can realistically do it better. It's working, and I'm gonna finally pretty content.
      We've all got some way to contribute to our world. I wouldn't be able to be a parent, for example, but I'm thrilled to see people who do it well.

      @@Pope_Balenciaga Absolutely. I'm a laboratory manager but I still do a ton of patient work, especially with the COVID-19 pandemic. You have to be very neutral with your language because you deal with everyone from every possible background. An offended patient is very difficult to treat. I'm sure lawyers (at least good ones like DJ) operate with a similar line of reasoning.

    On that second question, I'm reminded of a Simpsons quote. "C'mon Homer, people like us can't afford justice." Which always hit close to home. Because as a poor person, if I ever found my way into a bad legal situation, innocent or not I probably won't be able to afford a decent lawyer and would be screwed.
    I think there is a big flaw in the system that needs to be fixed, where rich people can basically get away with anything and the laws only apply to "us peasants".

      I am very conflicted about guilty pleas for the reasons outlined. On one hand the system would collapse without them on the other hand it feeds into inequality and it seems some what perverse try and incentivise people not to use their right to justice and a trial. The argument of 25% discounts on prison sentences for pleas is it shows remorse and or taking reposablity. While sometimes true I think this is as much a fiction so we can deny this morally problematic incentive structure.

      I have feared the same issue.
      There have been times when I've let people take advantage because I didn't have the money to find a lawyer and fight for my rights. I know many other people were hurt by illegal practices, and I can do nothing about it because of not having enough money.
      Lately we had to ask neighbor kids to stop playing in our yard, we can't afford it if they get hurt.
      That being said, in my experience, court appointed lawyers get a bad wrap. The one's I've experienced want the best for their clients, and wish we were better informed of our rights. I'm sure it's discouraging for them to see hopeless client after helplessly hopeless client.

It's really interesting hearing the similarities and differences between our legal systems and even on a small scale can be really eye opening.     Adding to the answer of 'how do i know if i want to be a lawyer?': attend a trial. Seriously. Courthouses are open to the public, and any individual can observe any case they wish for any reason, with the natural exception of closed court proceedings. I studied a year of a paralegal program, and one of my assignments was to go to the local courthouse, observe a case, and write a report about it. It was quite interesting, and you will learn a lot.
    In my case, I obtained a copy of the reason for the decision. The court fees were a bit ridiculous, though. They charged approximately $5 or more a page. A reason for a decision could easily be about 4 pages. A complete transcript of a case, therefore, could easily go in to the hundreds of dollars, at $5 a page.
    Nevertheless, that''s one of the cheapest ways I can think of if you are interested in finding out more about the law. Just walk into a courthouse, take some notes if you want to save money, and you'll have a clearer idea of whether a career in law is good for you.

      Similar in the medical field. Most med schools want to see that you've shadowed a doctor on your CV. I did and it's a big part of why I ended up not going to med a school. Just leave me in my laboratory. I like it there.

    I enjoy the animation and information. Quite often this is just informational entertainment. But as of late Legal Eagle has begun educating in a way that affects the greater good more directly than "lawyer responds."
    I am thankful for people who serve the greater good, and freely disseminate knowledge.
    One of the reasons I could want a lawyer is to tell me what the hell is going on in a way I can understand. Kudos on being good at your job.

    Public defenders are indeed doing a great service to individuals and to their country, and you are doing a great service to the curious people of the world. So I wanted to say both congratulations and thank you to the whole Legal Eagle team, from France where I reside and studied the law. It is always amazing to see how justice works in a totally different legal system and I think your content is really important to help people understand some of the events that are happening right now, especially for people who are not American and not necessarily well informed about American law, but are still eager to understand what's happening in the world. And I would never have thought I would choose to watch something like The Case Of series, being not particularly fond of crime fiction and all that, but I enjoyed it a lot, the animators, voice actors and of course the host all did an amazing job and I hope we'll see more of that very soon!

    Love the discussion about representing the “bad guy,” as a fellow civil defense attorney. Absolutely agree. I’ve never felt like I’m representing the “bad guy,” and when my clients are actually in the wrong, they often settle and it’s just a negotiation of “how much.”

      Yes because something called guilt and another called employability. Semantics and "perspective" are great coping mechanisms for work that is tracked in Win/Losses.

      There is also the fact that at times even if the person did something wrong the punishment should in theory fit the crime and without proper representation the person might get worse sentence then he/she probably should.

    I really liked that you brought up the thing about law and "being legal and being right". We have a saying in German that I don't really know if I can translate correctly, but it's "Recht haben und Recht bekommen (sind zwei verschiedene Dinge)." "Recht haben" is being correct or being (morally) right, "Recht bekommen" is to be right in a legal way, that a judge rules in your favour and that those are two very different things. So whenever there is a decision in court that you really don't understand, because it seems so obvious that a client is right and needs to be legally right (but isn't for whatever reason), it's always like "yeah, well, Recht haben und Recht bekommen, huh".
