      Hi, MeTime,
      Excellent! Was this for a naturalization interview that was missed? Or an adjustment of status?

    Hello! First of all thank you for this video! I was scheduled for an interview for naturalization this July 2023 and USCIS cancelled it due to unforeseen circumstances. They then gave me a new interview date but I had already scheduled a trip out of state for an important family matter that I couldn’t cancel. I called USCIS and told them about this and they opened and inquiry for me (I have the email confirmation). I never heard anything back after that so I called twice and they said I just have to wait for an update. My appointment lapsed and I got a notice saying I have to explained why I missed my interview. I then called saying I already made an inquiry and I have documented all the times I called and spoke to an agent for an update. The agent told me I did all the things I could do and that it
    is documented I opened an inquiry. I came across your video and I didn’t realize that I have to mail them a letter with the needed documents and my 30 days from my notice had already lapsed. Is it still worth it to send them a letter of explanation anyways? Sorry for the long comment. I hope you could send some hope my way. Just feeling anxious and defeated. Thank you again!

      Hi, Faith,
      This sounds frustrating - but not unusual at all. We do recommend sending a letter to the USCIS office where you were scheduled to appear and address it to the Naturalization Unit Chief so that, hopefully, they can assist in getting you back onto the calendar. If we can assist any further, please don't hesitate to reach out.

      Hello,
      In this case, we would recommend sending a letter to the USCIS field office where your appointment is scheduled. Your letter should explain the circumstances and request a new appointment date. It would be a good idea to include a print-out of your travel itinerary or other evidence of your prior commitment. I hope that helps! Best of luck with your case.

    Thanks for your video I have a quick question. My mom (97 years old) has dementia and has been staying in bed since the beginning of 2022. She has no ability to walk and sit on the chair. Can she be considered to waive or exempt her biometric? How do I proceed to inform USCIS ASC. What form should I submit to USCIS ASC?

    • @jlw.immigrationlaw
      @jlw.immigrationlaw  11 หลายเดือนก่อน

      Hi, Julie,
      Yes, applicants over the age of 79 years are not required to submit biometrics. If she is scheduled for an appointment by mistake, you will find instructions on the back of the appointment notice for how to contact them. We would recommend submitting a copy of her photo ID with your response so that they are able to cancel her appointment. It would not be a bad idea to submit the same information to USCIS via the online portal so that you also have that record of notification. If we may be of further assistance, please don't hesitate to reach out.

    • @jenniferwalkergates5745
      @jenniferwalkergates5745 2 ปีที่แล้ว

      Hi, Amy,
      In our experience, notices for rescheduled oath ceremonies are usually sent around 30 days after the missed ceremony. In a case like yours, I would ensure that the applicant had set up an online USCIS account and encourage them to check the status of the case through that portal. I would then begin sending inquiries if the ceremony is not rescheduled within two months, and after that time try to schedule an infopass appointment. I hope that helps!

    Hello, what if my mother missed her biometric appointment bc she mixed up the dates with my father biometric appointment , but when we arrived to the office they still too her biometrics and I called and requested a reschedule for my mother and they said they would get back to me in 72 hours by email? What do you think I should do?

    • @jlw.immigrationlaw
      @jlw.immigrationlaw  ปีที่แล้ว

      Hello,
      This kind of mix up is common. If the office already took your mom’s biometrics, there is no need to reschedule her appointment! Simply maintain the copy of the notification that has the stamp showing her biometrics are complete.

      Hi, Vivian,
      Applicants for naturalization can absolutely reschedule the oath ceremony. Until an applicant takes the oath and is given the certificate of naturalization, they remain a permanent resident and travel is permitted. Rescheduling the oath ceremony based on a need for emergency travel will not harm a naturalization case. Safe travels and best of luck with your case.

Can I tell the USCIS officer this situation and ask them to delay my oath ceremony about 2 months from now on? what if USCIS reschedule the time when I am still stuck in Shanghai ? @@vivianjwang9792 Hi, Vivian,
      These are unprecedented times. While I cannot predict for sure what USCIS would do if a person had to reschedule their oath ceremony multiple times, my recommendation would nevertheless be to simply keep USCIS informed about the situation and request whatever you need. Given their extremely long processing times for so many cases, it seems they would be acting very hypocritically if they objected to a two-month delay for a naturalization applicant with an approved application and an emergency. If USCIS denied a case for one of my clients in this situation, and we could show that we had remained in good communication with them and made reasonable requests under the circumstances, I believe we would have a strong case for a federal appeal. I hope that helps!

If you do not receive that in the next two or three weeks, we would recommend calling the USCIS call center to let them know what happened and ask for a status update on the rescheduled oath ceremony.

If you have already missed your appointment, you need to call the National Customer Service Center and request the reschedule. It is possible to request a rescheduled oath ceremony. The notice of oath ceremony contains instructions about how to do that. It is important to always maintain a scan or copy of all correspondence with USCIS so that if delays or complications arise, you have clear evidence on hand of your communications with them. • @jlw.immigrationlaw
      @jlw.immigrationlaw  2 ปีที่แล้ว

      Hello,
      If the “Failure to appear” letter is a denial of the application, then there are typically a few options. One is to submit a Form I-290B motion to reopen the case, along with evidence that the appointment notice was not delivered to you. Another is to re-file the N-400 application (we recommend using an online USCIS account to get electronic delivery of notices and other important information about your case during the process). A third option may be to hire an immigration lawyer who might be able to convince USCIS to reopen your case without Form I-290B and the accompanying fee. I hope that helps, though I recognize that all of these options are expensive, and it’s very frustrating to face this situation.

      @jenniferwalkergates5745 3 ปีที่แล้ว

      Hello,
      The most important moment in the naturalization process is the oath ceremony - it is where an applicant actually finally becomes a citizen. These days, most oath ceremonies are closed to family members anyway because of the pandemic. So long as your wife is able to attend her oath ceremony, there should not be a problem. If she needs to reschedule her oath ceremony, instructions for doing so can be found on the oath ceremony notice.

      Hi, Glory,
      I’m so sorry you’re dealing with this! It is definitely not a lost cause. I would try all forms of communication at this point because USCIS right now doesn’t have a very good streamlined process for communicating with them - send a letter explaining what happened and requesting reopening of your case, call the National Customer Service Center at 800-375-5283 and see if they can help, AND submit an online inquiry if you can. If all else fails, you can submit Form I-290B Motion to Reopen and Reconsider - it has a fee but it would cost less than re-filing your case. You need to file the Form I-290B within 33 days of the date on your denial letter.

    Hello Ma'am, I missed my interview two times, since I went to Afghanistan, last April, the Gov. collapsed and unfortunately I stuck there almost a year, now USCIS closed the Form N-400 and wanted me to write them a written letter that they reopen my case, do I need to go to a lawyer or I should simply write a letter and explain what happened? I appreciate your help.

      Hello, AJ,
      Oh my goodness, I’m sorry you’re having to deal with this on top of everything else you’ve been through. In a case like this, I would recommend hiring a lawyer to help you. However, if you decide to try managing the situation on your own, please make sure to save copies of everything you send to USCIS in case a lawyer needs to step in later to assist. We at WGV would be happy to assist if you decide you would like help!
