- Scotland’s First Minister has insisted he is “very proud” of new hate crimes laws which have just come into force, as author JK Rowling warned the legislation is “wide open to abuse”.
The Harry Potter author, who has become a fierce critic of the Scottish Government’s stance on transgender rights, has been one of the highest profile critics of the legislation.
The Hate Crime and Public Order (Scotland) Act came into effect on Monday, consolidating existing hate crime legislation and creating a new offence of stirring up hatred against protected characteristics.
However, women have not been given protection under the law, with the Scottish Government instead promising to bring forward legislation to tackle misogyny.
Director of Advocacy at Sex Matters, Helen Joyce, joins TalkTV Julia-Hartley Brewer to discuss this further.

But as far as I'm concerned from now on a man is an adult human with a Y chomosome and a woman is an adult human without a Y chromosome. I used to politely refer the only two trans women I ever came across (both middle aged and unconvincing as females) as she - but criminalising a refusal to do that has got my back up!

I've cancelled my Green Party membership and written to the party to explain that it is being too gung-ho on this issue that's put me off. I've been misgendered most of my adult life. I have a deep voice and don't have the curves in all the right places as most women do. I'm a woman, born a woman, given birth to 4 children and will die a women. It seems I could get many people arrested under this new law, because I live in Scotland. I could get airport workers arrested, taxi drivers, shop workers, you name it I'm misgendered whenever I go anywhere. Yes it's annoying but it's not the end of the world and I wouldn't dream of pursuing criminal charges but some people will.

I’m a teacher of 20 or so years experience and I am worried. There is no plurality of thought in our education system. We must guide the young towards critical thinking and not push one ideology.

They won't. It may not even come to a single case in court. But after each investigation the person who has been investigated will go on a list. She is standing up for women like me. In my job at a major supermarket, I can not mis gender a man, he can come into the ladies loo and I can't tell him to get out, or I will be sacked. I need my job so I have to keep quiet and avoid these men who pretend to be women.
