NOT INVESTMENT, FINANCIAL, LEGAL OR TAX ADVICE
HOAs, or Homeowner Associations, have a clear purpose: oversee assets in of a property or area, run business affairs, enforce and set rules for areas in their jurisdiction, and enforce maintenance and upkeep in their area. That doesn't sound so bad, right? Wrong. Well... at least in my case.
AGREED, HOA's sucks! You know what sucks more? the board members spending your money like they are the government. They want to buy more stuff, here comes a special assessment.
Get this one! A number of years ago we got a letter from the outgoing HOA President who was forced out by the board for reasons unknown to me. He spilled the beans of all the corruption going on from cooked books of employees padding their paychecks but not working the hours to most of the funds collected going to pay for fish to stock the board members private pond that nobody is allowed to fish on but them. They put signs up saying no fishing private pond, no tresspassing etc.. Thousands among thousands of dollars. Makes sense now why all the board members lived on one street that backed up to the private pond. Makes me sick and yet we all get monthly harrassment notices to fix this or that and if we are two days late on payment they have a retained lawyer who sues us and he pads the crap out of the fees. Last time it was over $700 fees for $50 owed. HOA's sucks. If I ever move again I won't buy property if it has HOA.
To be fair, the HOA is just a very localized government.
@@vaskylarkhow are HOAs not deemed unconstitutional? They need to be abolished

HOA should be outlawed
Only citizens could push for that. And I am not seeing anybody caring enough to stop this absurdity of a scam all this is...
@@jermanmonster000the last time Americans tried to stand up for anything was January 6th. Most Americans are spineless.
I agree
Didn't know that HOA was like this, wanted a condo.
SO glad there is no HOA is my ghetto neighborhood!Just a lotta DOA!😳(ba dum psst🥁😉).Almost 25yrs of livin Ghetto fabulous!🤗
I agree with you 100%. I always tell my real estate agent, "I want a home without an Hoa!" You give them $1000's a year and get nothing in return, only to be told what to do on your own property. They're a waste of money.
When you move, they can throw tons of fines on you too. I don't believe for a minute that HOAs don't profit.
Ban HOA's
I refuse to buy a home in an HOA. Just say "no".
Admen to that!!!
Unfortunately most to all new neighborhoods are with HOA’s, and they tend to be the most affordable. It’s getting harder and harder to get away from them so it is time to get legislators to bring them to yield, getting them to do what they are supposed to and not allow them to do what they shouldn’t.
HOA ignores when there’s an actiual issue but the second they see a doormat that’s not beige aesthetic outside the residence, they attack
lmaooo 😭
They have to keep the homeowners off balance and in defensive mode, so people don't get suspicious about the big fees they pay every month.
I succeeded in shutting down the Sweetwater Oaks HOA in Lawrenceville GA. It took a lot of work and the HOA fought back. They even attempted to get a restraining order against me. The crooked management company exited the business and the owner joined the Atlanta Fire Department.
Good for you man. Seriously .
Thank you for your great effort and being brave👍
The owner had only one HOA client?
HOA's are USELESS, and usually mismanaged to say the least
Disbanding the HOA is like trying to get rid of ticks off a dog.
Hoa should just be made illegal
HOA is like a mini government.

I think they are more like Nazis!
It’s more like a Feifdom.
They are the Lords and you are their peasants.
Hi Monkey D Lufi
Worse.
HOA's exist to make lawyers money!
I hear a lot of pro-HOA people saying "Don't infringe on my right to associate." But here's the thing. HOAs are not typically created by homeowners. They are created by the development company who builds and sells the homes, and the development company will not sell unless the buyer joins the HOA and signs the contract to abide by the CCRs. So while an outright ban on HOAs would infringe on your right to associate, a ban on forcing people to join and remain in the association in order to buy a house would not.

Lord ! Good thing I didn’t sign any contract with HOA. Everywhere I turn is always something negative about that association. It’s horrible what they do to homeowners!.
I thought usually the homeowners don't have a choice?
Too many HOAs don’t do anything except harass property owners about having a plant on their property or whatever. Meanwhile the guy with the destructive and dangerous dog gets to keep on letting his dog bark all day.
Once you buy into a HOA it’s difficult to disband the HOA
Please write to your local city, county, and federal congressional representatives. We need to get a movement going against what they are doing . The HOAs can actually evict you from your house and sell it out from under you with out telling you and your paying your mortgage payments.
But not impossible. Two choices: either don't buy a home with an HOA or be willing to do the work to remove it. Oh yes, forgot the third option: become a serf.
They are people who were picked on in youth and want an outlet to get back
Dude, thank you sooo much for standing up to HOA. They have really over stepped their bounds. I have heard so many complaints about them. There are real estate agents informing the public through TH-cam about how in some states the HOAs will take your property evict you and sell your house while you’re paying the mortgage. And they don’t even have to tell you. That is deeply disturbing and disgusting. I hope the public really pays attention to what you’re saying and really do their homework about HOAs.👍
Agreed! I dealt with a nightmare HOA, Sentry Mgt., based out of Florida. There were horrible! I’ll never own a property in an HOA again. Never again!
How can you have an HOA for commercial real estate property? I thought HOAs are for residential properties only.
I suspect that this is a POA (property owner's association). I would assume that they are providing some services, such as contracting vendors for common area maintenance, etc.
@@rangerrecon If that's the case, then that's what he should call it. Otherwise, it's confusing.
Its a criminal racket
Destroy the HOA
Let's start with the first question. Why would you, or anyone for that matter, buy property that comes with a title provision that puts your property under someone else's control? Why would anyone purchase a property with an HOA attached to begin with?
I mean...the constant search for some feigned security at the cost of freedom is what gets you all into this kind of shit in the first place.
I am just saying. When I am moving, my Real Estate agents are instructed to never even show me properties that are in HOAs. That is why I do not have this problem.
So why am I on TH-cam dealing with this problem anyway? You opened that can. You eat it.
We have commercial property within our HOA. As a homeowner, they don’t pick up my trash as I have to pay the city for that and they don’t take care of my landscaping either. What they do pay for is the landscaping and maintenance along the center median that is on the main thoroughfare through the subdivision. There are 2 classes of voting, commercial and residential, but the commercial has more votes per acre than the residents so the commercial owners can actually dictate how the homeowners can be affected. We are grateful for the commercial fees but also worry about how they can get the bylaws changed that affects us.
Am I missing something? How is an office a part of an HOA?
You heard the man. Surprised me too
Because there are shared spaces that have to be maintained? How exactly is that to be done...
@@judithrees6919 What does the "H" in "HOA" stand for?
Am I missing something? He clearly shows a commercial property. How is that a part of an hoa(home owners association)?
Doesn't make sense to me, either.
Thank you! I have never known or heard of an Hoa for commercial property!
HOA is just a phrase. There are commercial spaces that are supposed to have an HOA-style group that takes care of certain functions; landscaping, garbage, etc... Developers get a lot of wheels greased by local governments this way because it takes the burden of things like garbage removal and road maintenance off their books.
@@tails4944 Makes sense, but then it should be called an appropriate name -- *_not_* something that has the word "home" in it. "Property Owners' Association" (POA), for example.
@Milesco of course, I'm not defending the guy for not knowing the name of the organization that's fucking him over.
I bought my first home as a divorced mom of two little girls.
I had never heard of HOAs and their "rules".
I had abdominal surgery 3 weeks after moving in.. many moving boxes, still unopened were on my screened in back porch. Got a letter from the HOA that my boxes on my porch were an eyesore for my neighbors 👀...give me a break.
I purchased a cobalt blue tarp and hung it on my porch to hide the eyesore from my nosy neighbors.
I got a letter from the HOA.. your blue tarp is an eyesore...
HOA rules say I can't have a clothes line in my yard except between the hours of 9 am and 5 pm, not on holidays and it must not be a permanent clothes line..has to come down end of day.
I immediately strung a line across my backyard and hung bras, thongs, men's boxers with white polka dots I created using bleach... put it up everyday with same items for close to two weeks.
Didn't hear a word, I felt silent revenge satisfaction.
WE HAVE 300 TO 400 PLUS PER MONTH I AM PAYING AND THE TRASH PEOPLE ONLY COMES ONCE AND THEY DONT DO NOTHING IN MY COMMUNITY NO POOL OR ANYTHING
I went to see a condo recently and the parking lot has pop holes in it roof falling apart hallway spells pissy among other issues HOA SUCKS they don’t do s repairs!!!!! They just keep the money 🤷🏽♀️
Everyone's eating good except the one's actually working.
Never ever ever buy a house or land in a restricted subdivision / hoa if the man who wanted to restrict what i could do with my property had the power to control said piece of property he would still own it
I hear so much about HOA's doing nothing!
I hear you! Let's do it! My case is They bring up the case over 10 years ago that occurred of interest n their fee when the Judge rule after our appearance; the matter is taken off the calendar. And 5 years ago they did not successfully put my house into foreclosure! The anxiety attack all over again!😢
Someone buys property that they can not control, well that's just stupid!
Now worth about $4.6 million and now your rent is based on today’s value 40k a month rent 🤷🏼♂️👍
🎉
Funny thing is its NOT the value of the property that dictates the price, its the value of the DOLLAR. Properties have risen very little in ACTUAL Intrinsic Value over decades. But your Dollar....well since its inception, todays value is only about 2.7 cents of the Dollars original buying power. So that 400,000 dollar home that someone could have bought for $1000 back in 1910... probably ACTUALLY only worth about $1400.00...yeah, whole damn things a smoke and mirrors game!
@@sheepishmclemmingston5550 thanks for your professional insight. But I just bought my 3rd property in Laguna Beach and based on the price I paid I’m getting $31k per month
One of the advantages to home ownership over apartments is the freedom to renovate and improve your home to your liking. HOAs may prevent eyesores but more often hinder reasonable changes and impose unreasonable restrictions.
so the existence of HOA was not disclosed when purchasing your property?
Some lawyers somewhere thought it was smart to bugger.Everyone in his neighborhood to pay him to keep everyone in line. All you do is pay that lawyer and everybody gets a case of the firehead and nothing gets done
I live in Florida where a huge percentage of property falls under an HOA. You don't see HOAs as much in the rust belt.
Wait, the HOA is supposed to take care of your garbage? I thought they negotiate the sanitation contract, but individual homeowners still have to pay the monthly trash pickup fee. Do HOAs pay for your landscaping too? What about your home maintenance, property insurance and walk your dog too? 🥴
Hope you win everything. 😊
Yes, due diligence would have been good-now you're stuck dealing with the problem. I assume that this is a POA and not an HOA, and I assume that they are performing some services, such as common area maintenance contracting, etc. While I see value in HOAs/POAs, I don't see the value when the number of properties is small. POAs and HOAs typically have a property management company manage the properties, which includes accounts receivable, accounts payable, legal, inspections, accounting/auditing, etc. That's a lot of overhead that is a financial burden to a small number of property owners. When we're talking about several hundred units or thousands of units (large subdivisions, apartment complexes, etc.) then that cost is small compared to the benefits. Here I don't see the value.
I agree with your complaints, but aren't the HOA fees used for common areas like maintaining the parking lot, paying the electric bills for the property, paying taxes, etc.? Somebody trimmed that hedge behind you in the parking lot.
The HOA has to build up the reserve account to pay for expensive repairs in the future.
I hear you, but it's not so clear-cut as you believe.
FYI: I owned a condo in a mid-rise building where the HOA fees were *$580 a month.*
Right on man!!!
Detailed research report on HOA establishments must be submitted to the representatives of each state.
HOA management companies have figured out that they can collect $ while neglecting maintenance & ignoring work orders. What could possibly go wrong giving absolute power combined with protection from legal prosecution? 🤔
what r u taking about ? the hoa is a covenant that runs with the land.
Agreed HOA’s suck. I live in one and see favoritism and even law breaking. They look the other way, even when you point it out to them.
I live in an HOA inherited from my parents who retired here. Have had vandalism, truck damaged so I have practically rebuilt it. Ongoing for 20 years. So I will sell cheap and leave. A resident-ownwd MHP in north county san diego. I have a great view lot on 'the hill' here. It is horrible.
HOA's are excellent. You have a choice, dont take choices away from others.
I'll simply not pay Ho(e)a
Shut it DOWN!👎
I hope you succeed in disbanding the HOA! Standalone detached properties do not need them at all.
HOAs are sneaky.
However, more times than not, it falls on the owners. Not enough band together and fight.
Im lucky to be in a fairly rational HOA, i only ever get letters when i work on my car or my window blinds are being diagonal, never anything like random charges or threats and they actually landscape and take out the garbage.
HOA still suck though
Do diligence would be not signing a HOA and then not having to complain about it.
Its not like they force you to join. 💥 if its commercial property... the clean up and maintenance is part of your Triple net... not your HOA. 🤔
If the paperwork has HOA on it then you run away never buy it.
HOAs should be required to have open books and should be required to allow audits by their members because I'm pretty sure in HOAs is like the one you describe are just pocketing the money
Hoas should not exist at all
I have a better suggestion. Don't join an HOA.
@@dwaynehudspeth2073 In some areas it can be very hard to near impossible for someone to find a home without trying an HOA.( If they don't have the money to go far)
Wow, I had no idea commercial properties also have HOAs 😮
I live in an HOA neighborhood. How does an HOA work with Office Buildings? They aren't Homes??
Why are hoa even legal? Extra fines for nothing
All HOAs need to be abolished and disbanded. It's no one business what you do with your own property.
They've not done anything, they've been just taking my money 😭😭
They do suck
HOA = Association Against Homeowners
😂Yeah try to get out under hoa, require refund for all cash you pay so far
HOA's, where I live, are not such fascist institutions, 'quasi government institutions'.
An homeowners association (HOA) is a legal entity that represents the common interests of apartment owners.
HOAs in the US create a kind of 'gated communities'.
Because the group of residents is often relatively homogeneous, they cause social segregation, which reduces social interaction with people from other social groups.
This is what we see in the USA and reinforces the 'racial'/'social' divide.
Major contradictions, whether it concerns skin color or religion, interference in the private domain. In the USA, almost everything has degenerated into black and white thinking. If you are not for something, you are against it.
People have become blind to the many shades of gray and that for the country that shouts, that they stand for freedom, freedom of speech, freedom of religion, the country of great possibilities.
Provided you fit into the 'straitjacket'.
Be gone Hoa be gone Hoa Be gone Hoa be gone Hoa!!!
Good luck on that pal . They will battle back
That's what HOA do
Get them!
This guy buys a property for over a million dollars and whines about having no money left because he's paying a a couple thousand a year. Keep it real kiddo.
He said he's not getting anything for his money. How did you miss that part? Sounds like you're one of the ones who went for the HOA scam. It's ok, we all make mistakes sometimes
Good for you. May you be successful.
Also, why would a COMMERCIAL property have a HOME OWNERS ASSOCIATION?
That makes no sense
Yeah, I don't get it, either.
The lawyer will get lots of money and you might lose and have to pay the others court costs ,They are tied in somehow to your building
If more people stand up to HOAs things will change .
Never buy property in an HOA.
HOA’s are bad enough, but just wait until you get an additional / special assessment like in my building when everyone got hit for an extra $1500 to update the community BBQ area because we didn’t have enough money in reserves.
All the companies need to be on their own water just ignore them
The core problem is that HOAs attract petty authoritarians. The basic idea is fine, but it fails in the face of human stupidity.
Baldie with the flex at the start
Well if people should stop buying houses in HOA's.
I have yet to see any videos, or hear any stories about an HOA doing anything beneficial for it's members, or anyone involved with an HOA which obviously doesn't include HOA board members using HOA funds for personal gains, cause that's theft.
Defund the HOA
Forced HOA should be illegal
Thank you Troy!!
Is this a low key flex? $1.2mm prop back in 2013, this guy prob already more than doubled his investment regardless of how much HOA is
What happens if you just stop paying the HOA?
If you don't pay the HOA can force you to sell your properly it come down what is in your HOA contract you sign when you moved into the neighborhood
Do you have to join the HOA to move into the neighbourhood?
IMHO, NEVER an HOA, shall I be a part of.
Hoa's shouldnt be illegal. People should have enough sense to live in a community without it.
That's the answer
Yes. There are laws that if their budget is not balanced to the services that you receive or amenities, you can have them disbanded. Where is your money going?
Theyre gonna up your fees if you make them do more stuff. Go to the board meetings if you wanna understand what's going on.
I refuse to live in a HOA.
Property looks nice, parking lot looks clean, trees seem taken care of and bushes have a nice shape. If you cant afford Fl. Move to Alabama. You are complaining about a $500 admin fee "making your pockets empty", you'll never make it here bro, that's a tuesday night dinner for 2
Love your passion!
When you buy a house you want to be the boss of that house. HOA can go to hell.
Gotta do your due diligence bud. Ignorance is not an excuse!
HOA'S are the worst things someone come up with
What about putting the fees into an escrow until they do the maintainance.
