Both parties were scammed. I really don't understand why the plaintiff is so convinced that the defendant is the culprit when BOTH parties were taken in.
It’s obvious to us but it’s hard for someone to have gotten scammed to see clearly when they cannot find anyone to blame.

He evaded the question that JJ asked. She asked him when he got out of prison, and he replied he has been sober for 32 years. That is not an answer to the question. Maybe he was in prison for something besides alcohol.

@@elisafernandes9703 I am pretty sure that defamation laws do not apply in courtroom scenarios. Once you step out of the courtroom there is no longer any immunity though, However perjury laws do apply.

Both parties were scammed, and the scammer duped the plaintiff even more by throwing her off the trail using the defendant's info as a buffer. Just because she has the defendant's info, doesn't mean that the defendant had any part in perpetrating the fraud.

They both should have been suspicious of the price. It was a 2015 Subaru and this was in 2019. No way are you getting a 4-year-old Subaru for $5k or $7k. That should have been the first red flag. Then no title? This would scream scam to most people. It sucks that they got taken, but you got to be a little smarter than that.

Yeah, that price was way too low. I just checked now, as of this comment in 2024, 2013-2015 Subaru Crosstreks are between $10k-15k, some have pretty high mileage as well. I really do feel bad for the defendant, the plaintiff almost seems to have paranoia or something to be this convinced that the defendant would do something like that even with all of that evidence that he presented.

I love how the defendant just looks at them confused, he doesn't argue or scream back at them while they conjure up the whole story. The plaintiff and her boyfriend have turned private detectives and are out of their depth.. I'm with JJ on this one, defendant doesn't seem like he's in on any of it and he just got scammed himself. Poor guy had to get sued on top of it all :D
Yeah, they must have spent weeks researching. Including citing over and over about what some San Diego police officer said, even when JJ keeps saying that's hearsay. "But he said you could still report a car stolen even without a clean title so it couldn't possibly be what another police officer told him."

$5000 or even $7000 for a 2015 Subaru in 2019 is a steal, too good to be true. The price is too low, I wouldn't purchase this car without ALL the proper documentation.

I think the defendant should get a restraining order as they aren't going to back down. It is clear how the scam occurred, yet they are trying to convince a JUDGE to call the police to explain what is law. He needs to protect himself as they believe they know more than everyone else

Least the defendant is taking this as a lesson and owns up to being scammed, the plaintiff is so stubborn and ignorant she's determined to get her money back even if its from the wrong person.

Such a whiny, self-important tone to take with a judge. She understands the law. She is seeing the bigger picture -- you can't find tiny threads of information and use it to suggest someone is corrupt. When there is a logical explanation for things and that's what JJ's job is, to deduce the situation without bias.
They both got scammed and she is upset she has no idea who that Charles guy is and can't get her money back.
She had this guy's name/number, he didn't return her calls (she never mentioned what it was regarding because the scam artist told her he was waiting for her call.... so he ignored them), thought him ignoring her was proof he had scammed her, never thought the scam artist had sent her his info to get her off his trail and has spent weeks/months dreaming up that this person was behind it all. The new information (he gave his ID to the actual scam artist, the scam artist had all his info from the previous sale, his car was stolen and then resold -- couldn't report it stolen because it wasn't in his name, per the scam, etc.) she just wrote off as lies 'cause she's spent a month preparing for this case, dreaming up more and more ideas with her boyfriend about this third party being behind it all. So they're going to give all their "ideas" but don't realize they were led astray by the real criminal and never counter-corrected.

It's not a hard case. The defendant was scammed, and the con man found a chance to steal the car back (with the extra keys, which the defendant stated he was supposed to deliver), and then found the plaintiff (sucker #2).
The only way she can recover the money from the defendant is if he's part of a criminal conspiracy, with the person she handed the money to acting as his agent as a part of that conspiracy. She can't do it, because I'd give heavy odds that there was no such conspiracy. She's just another victim in what might be a long line of victims, which includes the defendant.
Even if there WAS a conspiracy, she provided no proof. I bet the con man got his jollies sending her the name of his last victim while he's off sipping Mai Tais on a Caribbean beach somewhere, and is laughing his head off at this episode.
Price of the car should've been a red flag. Too low and no title.

I trust this total stranger who now has all my cash to bring me back the title later on at his convenience.

We had a guy try to pull that on us about 25 years ago when we were looking for a car. He said, “We just moved here, and the title is packed, but I’ll mail it to you.” Nope. Call when you have the title and we’ll talk. But, but, but he took time out of his busy life to come show us the car! Well, if you don’t have the title, you obviously weren’t ready to sell the car. You could have said that on the phone and nobody’s time would have been wasted.
Super low price plus no title equals scam. The defendant said the scammer had the car for sale on the Tijuana Craigslist as well!
I think it was the part where the defendant didn't report the car stolen is what she's holding on to as her proof, even though the defendant did explain that he couldn't because it wasn't under his name. She also mentioned that in their state they could report it or something to that affect before JJ stopped her because it was hearsay.
@gary-gt-tsang - Exactly. And what the plaintiff doesn't realize is that regardless of whether the defendant still had the car, the plaintiff can't prove that she gave the defendant any money. She gave SOMEONE money, but she can't link the defendant to it.
This young lady learned an expensive lesson. Without the title, you own nothing. And don't trust people on Craigslist!

1) I agree with JJ's decision. 2) Respect for the defendant. If the facts are correct, and he hasn't been in any trouble with the law after 32 years when he got out of prison, it shows you every now and then, some people can turn their life around
The same thing was going to happen to my son through marketplace. My son has a TBI. He wanted me to buy the vehicle for him and I said no. People are awful and try to take advantage of trusting people simply for a few bucks.

There was a similar case in my village many years ago.
A person steals a cow and sold it to 4 different people in surrounding villages over a period of one month.
Seems as if the guy scammed both of them and because she can’t find him, she’s going after the defendant. Then she brings the TH-cam lawyer with her that has no idea what he’s talking about.

I bought a car and was given the title. It was signed over to me, but I hadn't gotten the title in my name yet because it was the weekend when I got it and DMV was closed. The people that sold it to me had extra keys and stole it out of my driveway. The police said it was a civil matter and could not report it stolen because of that, just like the defendant was told here. I was PO'd and went hunting for that car. All over the city I went hunting. I found 2 dudes driving it, all emblems and identifying stickers 4:48 were removed. I followed them and called the police. I was driving a tinted white Crown Vic at the time and I think they thought I was a cop following them because they hauled ass into a neighborhood and when I finally caught up the dudes were gone, doors were open, car was running.... Cops everywhere and a helicopter circling. It was crazy, but I got my car back!!! That was a good feeling. Point is, that story the defendant told is how it works. The laws should be changed, but we all know how that is....

The plaintiff should seek remedy by building her case with the defendant through the bureau he mentioned. More than one claim would be stronger against the real scammers.
He made $3000 did he? She said he bought it for $5,000 and sold it for $7,000. That would be $2,000.
Unfortunately, she’s got it in her mind that he’s the culprit despite evidence to the contrary.

Another scam to watch out for: You're selling something for $500. A person contacts you, says they want to buy it. They send you a check for $1,500. You call them back, saying they've overpaid. They apologize, saying it's been a long day, etc. and ask you to please return the $1,000, which you do, only to find out after the fact, that their check was no good, and now you're out $1,000 (plus the item you sold). ALWAYS wait for their check to clear first!!!

Plaintiff's are SO butt hurt that they got scammed that they're willing to put the onus on to whomever they think it might stick... even the defendant who ALSO was scammed.
PREVENT CAR SCAM: If you are ever buying or selling a used car: meet the person at the DMV and get the seller's name off of the title and get the buyer's name on the new title. It seems like an unnecessary step, but it prevents so much drama and this exact SCAM situation. As the seller you want your name off the title immediately, just in case the car is impounded, in a wreck, racking up toll charges, used in a crime, etc... (In Texas, you can provide notice that you've sold the car online or in person at the DMV).
Cuz she knew she was scammed, paying money to the scammer (third party), losing money. So she desperately blamed it all to the defendant who's also a victim of the same scammer of online deals in hope to get her money back from the scammer. 🤣🙄
She should work with the cops to investigate the case to catch the scammer.

Those kids really should have learned something about how the legal system works before trying to sue someone. They have no evidence against the defendant, nothing, nada, absolutely zero.

This girl and her friend are so stupid. It is clear that the defendant was scammed too. The original seller turned up with his spare key, took the car and sold it again, it was clear as day.

@chy-araabdoel9187 wouldn't be hard for the scammer to hang around nearby reading a newspaper and wait for someone to come out of the gate. He slips in while it's open and gets the car. If he acted like he belonged there and didn't look suspicious no one would have even noticed him. Then he drives right out with the car, which he relisted and sold again. Clever really. The girl said he had it listed in Mexico too. He's been doing this a while.

She believes he was scammed but can’t wrap her brain around the thought that the person who scammed him would then have all his info to use in the next scam. Plus she thinks that just by saying something is possible makes it evidence that he scammed her. That’s not evidence, that’s just her opinion.

I think she just spent so long conjuring up a case against this man, she never realized she had been duped by the guy who she actually knew, not the stranger who wouldn't return her calls (because she assumed he was expecting her to call, as the scam artist lied and told her, so she never explained who she was.)

can't report a car you don't own as stolen. cops who answer phones don't know what they're talking about, they just want to get off the phone. you'd have to go speak to a sergeant, which he tried, and the sergeant would tell you that you don't own the car, so you can't report it. never exchange money without getting a title.
They were both scammed. Get a grip lady.
