“No Faith Should Have Greater Status!” Muslim Pupil Loses High Court Challenge Against Prayer Ban

  • A Muslim pupil has lost a High Court challenge against a ban on prayer rituals at a high-achieving north London school previously dubbed Britain’s strictest.
    The student, who cannot be named, took legal action against Michaela Community School in Brent, claiming the policy was discriminatory and “uniquely” affected her faith due to its ritualised nature.
    She argued the school’s stance on prayer - one of the five pillars of Islam - unlawfully breached her right to religious freedom and was “the kind of discrimination which makes religious minorities feel alienated from society”.
    The school, founded and led by headteacher Katharine Birbalsingh, a former government social mobility tsar, argued its prayer policy was justified after it faced death and bomb threats linked to religious observance on site.
    In a written ruling on Tuesday, Mr Justice Linden dismissed the pupil’s arguments against the prayer rituals ban.

    Schools are where pupils come together to learn. This is a decision based on common sense and if the Muslim pupils and families don't agree then I suggest they look for a school that accommodates them and their beliefs. This is the UK not a Muslim country and they should respect that - or leave.

    Great news! Let's hope this is the start of a pushback against those who try to impose their religion on our Christian country.

    Coming from an Asian, finally Britain is getting her senses back. No dedicated teacher should have been put through the hell this teacher went through. I applaud the courage of the way this amazing woman who was firm and refused to back down from the bullying tactics of a race and culture people of her subcontinent of origin know so well. The Punjabi's are a courageous race - both women and men are known for this - the Punjabis just like the others from the Indian subcontinent are familiar with the Islamic Pakistani tactics of their geographic neighbours The terrorist tactics were becoming evident in this so called wanting to pray 5 times a day religon with their bomb threats and other threats.. A white British male or female teacher would not have had the courage to stand up to these bullies for fear of being accused Islamophobic or racist. The so called Imam says the judiciary decision disadvantages one religon " affecting it's identity of praying 5 times a day ( among a host of other thing, next thing it will be demanding the students to use Burka because that is also part of their identity). It is part of my culture to have the Blessed sacrament in front of me and rosary when I pray. So can I and all my Catholic classmates please have a prayer room with the Blessed Sacrament installed in please. It's a numbers game isn't it for this entitled lot - "well we are so many now therefore we need to be given certain privileges- and the Hindus, Buddhists, Catholics and Non-beleivers can just fluff off to whatever it is that they do because they don't breed as much as we entitled lot do to be able to dominate and shout our entitlement to the forreign lands who are hosting us. Before they know it they are now embracing our culture- you know the hosting countries give us an inch but we take a yard or more."

    Yes, this is how it should be. I had personally encountered similar demand by a student representative in my faculty who happens to be a Muslim. I was his junior doing my PhD at the University of Southampton. Our faculty has a small room dedicated for First Aid (emergency), and that's the room targeted by this Muslim student rep to use it as a prayer room for the Muslims, when in fact there's huge Faith Hall for all at the main campus just less than 10 minutes walk from our campus. As a student rep myself, I question why the need to sacrifice the first aid room which meant for all to satisfy a handful of Muslim students who already have a prayer room at the main campus, and I won! As a Hindu and my Christian friends we do our prayers too, but we don't show off to others that we're praying, it's weird why the Muslims need to have an upper hand as if they're superior to others, when every human are the same.

    Today's fashion is minority ruling over majority. This is a Christian country and it should stay that way. I'm catholic and my kids practice two religions because of their dad and we don't see any problems with that. In fact all of my friends are English protestants and so freaking what.

    I attended a private secondary school in Nigeria owned by a Muslim. I am Christain. We all wore berets. Christians had fellowship on Friday. There is a Mosque and it held prayers during school hours but classes didn't stop, except for the 2pm break which is a general break time across schools. My Muslim friends were allowed to go to the Mosque and return in between classes.

    Congratulations!!!! Schools are for learning, not for praying, and certainly not for telling others how to behave according to a certain religion.
    I am Catholic and believe that no religion shuold have privileges over any others.
    If you don't like the policies of a school look for one you like, but don't try to impose your personal views over everyone else.
    To leave in a balanced society everyone has to adapt and not expect everyone to adapt to you. If Muslims don't like that way of living they shuold move to a Muslim country.

    I'm genuinely surprised that the judge sided with the school. You don't need to be a legal expert to recognise the legal error here. In the interest of justice, I hope they appeal this decision to the Supreme Court.

Even now, neither has suggested that the girl has any desire to leave the school and attend another where she would be allowed to pray, indicating that they don’t actually feel that the child is being in any way disadvantaged by not being allowed to pray on the premises. The desire to do something should not be taken as an absolute entitlement, after all…

    Some have said this girl should be turfed out of the school and I agree. I also agree her sister shouldn't be allowed into the school. This particular family knew the rules going in, were determined to make trouble, did so and will continue to agitate and make problems down the line while taking time, energy and money away from the excellent education at Michaela School for all the students.       The girl and her mother knew there were no prayer rooms before they began, a lot of other things were made clear so it's a fair ruling and finally sets the precedent that schools don't need to bow to religious demands.
      In terms of islamic prayer additionally outside of a Friday they don't have to pray at school, they can move their prayers and those who are extremely religious have faith schools they can go to if it's that much of an issue.

The mother should not have placed their child in that school if they are aware that their policies don’t respect religious obligations and diversity of multi-faiths and cultures. However, many families in the UK are in low income households which drastically reduce their options when it comes to selecting a school. Maybe the UK should prioritise their citizens rather than their own pockets for a change so these issues can be dealt with.
      Prayers can’t be moved. I’m sure every person of faith knows prayers can’t be moved. Muslim 5 daily prayers can’t be moved just the way Sunday church cannot be changed to another day. Faith is a persons identity. It is prioritised over worldly ideologies.

      Christmas is far more secular and non Christians celebrate it. Its been a Christian country for a couple thousand of years. No other religious group makes so many demands to change the country to their religious way. You demand prayer rooms in schools, Animals have to be cruelly butchered in a specific religious way, halal food in stores and restaurants, you want your own banking system because you don't take out mortgages, you have your own separate court system with your own religious sharia separate from the laws of the country and contradict the countries laws. Jews, Hindus, Sikhs and other religious and non religious groups do not make such and so many demands that must be complied with. If you come to a country you accept, embrace and blend in to all of the culture not demand it to be changed to your way.
