When will people learn that when you put down a deposit and change your mind, you lose that deposit. That's why you never put down a huge deposit if your not completely sure. A 10% deposit is usually sufficient for a seller to hold an item.

Googled what a 1998 Fleetwood motorhome is worth and saw some ads. No idea what exact model the defendant was selling but most of the ones I saw go up to $30k. $8K will get you a trailer type camper you pull behind your truck but not a motorhome. If at the time of this episode and less than 50k miles (would suggest it wasn't the type you pull behind your truck) that was a steal of a deal, plaintiff was nuts for not finding a way to complete that deal.

The judge should have made the defendant submit the bill of sale. If she indeed only received $4500 then the plaintiff is out of gas. But if she got paid an additional $8k then he should get his money back.
Even if she sold it for way more, the deposit is hers to keep. The "bonanza" thing doesn't apply to this. If she were suing him for breaching the contract then she'd have to prove her loss.

I think the judge's decision was correct under the law, however, I kind of feel like the defendant should have at least given part of the money back but not all. She was patient and waited more than she should have, but if they were such good friends I would think she would want to give at least a little back maybe half.
The defendant is a liar she sold that motorhome for 8000.00 to bad the plaintiff didn't get a copy of the bill of sale from the DMV to prove she was untruthful. Sadly for the plaintiff she made out on that deal.
