I have hip pain everyday so I could easily go to the hospital and complain about that and have a record made of it. I truly believe that man didn't run into the guy with his car. Why would a witness, who didn't know either party, be saying that they believe the guy threw himself on the ground if he actually didnt do that? What do they have to gain from lying?

The defence lined up with an independent witness and the Police report found that the car had not only not hit him but that the pedestrian had hit the car. Also, the plaintiff said he was wearing earphones and not paying attention to the surrounding area when the event happened meaning he was not doing his part to pervent an accident himself. This was also a preponderance case and the evidence heavily supports the defendant and the case should have been thus ruled. Jerry is a bad judge.

There actually are diagnosis codes for being hit by a motor vehicle that would have been on the discharge summary if it actually occurred. There would have also been prescriptions for wound care; these accidents are normally bloody once you hit the floor. “Hip pain on the sciatic nerve” is a chronic condition that’s more from wear and tear on the body over time. I wish this case got dismissed.
We don't have enough proof whether the Plaintiff was scamming or not. Now if there was video proof from a security camera, or if both men brought in witnesses, that'd be a different story. But as Jerry said, he can ONLY give his verdict on what's been given to him; and that's the medical papers and such! I do agree that this is fishy on the Plaintiff's part though and suggest to the Defendant that he takes action by taking the scammer to another court for fraudulence.

They have to put in a diagnosis of WHY he came in, and a diagnosis of "pain of hip without sciatica" just means he has pain but there's no sign of what caused the pain, they didn't list any bruising, swelling, etc that would have indicated an actual injury, and would have been in the medical summary...
