    6:23 Just to be clear about this: even in civil litigation, the plaintiff absolutely can subpoena the unnamed female celebrity (whose name is known to them) to testify to what she has or hasn't seen. The celebrity could plead the fifth, but in a civil trial the jury is usually instructed to interpret the witness taking the fifth as an admission of guilt. The same isn't true in criminal proceedings.

    Well, we all have a problem too.
    We grew up idolizing people that bragged about doing vile things, publicly. We're only now seeing them for real, but they've always implied how morally bankrupt they are.
    I mean if only you take what many of them say in songs literally and seriously, you'll come to the conclusion that they are absolute monsters. But we chose to think "nah they just playing a character". Well, apparently, sometimes they don't.

      It was that easy to get into these parties everyone would have a case. How did she attend the VMAs? Who allowed her to go to the VMAs alone? Out of all the people that attend the VMAs how did he know she would be alone? She has no setup for this situation. SA happens from people how have the time to get acquainted with their victim. You're not getting a celebrity to randomly SA to this extent and they know nothing about you.

      No this is not another way to look at it. MJ settled and the child later said it never happened. Unless there is hard evidence and or an actual admission of guilt an assumption based judgement is extremely ignorant. Especially given precious circumstances where there was a settlement and the truth later came out as innocence. I’ll wait to pass judgement, like a non ignorant non arrogant human being.

In the court of public opinion, Michael settled and with the wrong impression it made, his reputation was forever tarnished. With many people, Michael Jackson remains a pdf file. People would rather believe hearsay than hard evidence, Jay-Z fighting this back despite taking a hit on his reputation is the correct move to keep his and him family's image and legacy clean moving forward.

    A REALLY important thing to note is that for a civil trial, the burden of proof is way lower. For a criminal case, the jury needs to be around 95% sure. For a civil case, the judge/jury only need to be 51% sure. Additionally, the court assumes from the beginning that everything the plaintiff says is true and there is no inherit presumption of innocence

      I just don’t think the story adds up. Because I don’t know too many 13-year-olds that’s trying to sneak into an event going by themselves. Usually they go with a group. Even grown women go to clubs as a group they don’t really go by themself. So how did this girl get to this party and where were her parents? Where did they think she was? Because I highly doubt that a 13-year-old girl could get to this VMA party by herself. So went was along with her.

    Using the MJ case as proof for still taking a major blow despite innocence in this case was actually masterclass. You get to remind people that Michael was innocent, but still show the damage that can be done regardless of verdict.
    IDK allat about Jay-Z, but wherever it goes from here? Won't be a good look for his rep.
    EDIT: Also, sending people to intimidate the opposition is never a good look because that just makes you look even MORE guilty.

    And to chat, keep in mind the trauma, turmoil, and incessant scrutinizing (both via the public and the courts) the plaintiff will have to endure in a criminal case. Mind you she has severe depression from this SA already. The costs needed to keep yourself alive after that? The therapy, hospital visits, and medication ALONE can drown people in debt. I can only imagine what other funds were lost when she’s potentially unable to work because of this (alleged) assault.
    We really need to shift the public perception of “only” asking for financial settlement. The idea of it being a false flag only benefits the rich and powerful…

      I don't think you know a lot about the criminal system. She would have more rights and protection under a criminal prosecution than a civil suit, and could still get automatic damages (including lawyers fees and mental Healthcare costs) from a criminal restitution order. You're much more exposed in a civil lawsuit and she has far less protections as a plaintiff than she would as a victim in a criminal case. Rape shield laws, for example, are typically only in criminal case.

    While theres logic to the idea that the lawyer is just doing it for the money, theres also the fact that the rich and famous rarely ever actually serve any punishment even in prison (They always know a guy who knows a guy who can get them to live comfortably). The wallet is usually the best and easiest thing to target because you have to prove less and thus a higher chance of winning a settlement.
    You could say that its suspcious as hell and to an extent I can see the perspective but if you were in that same situation, you would more than likely not succeed if you tried to get Jay Z arrested.
    Its a weird situation because Jay Z has every reason to fight against it, but so does the supposed victim. It could simply be described as a fault in the system but I would argue that the system is not responsible for how the public reacts to such a case.

    You covered a lot of the points - I feel like its worth mentioning though that in a way, the way the pubilc reactions feed directly into why celebs hide so much shit. Because, as you said, whether its true or not, there's a hit to their reputation - even though you were careful to be objective and show the case as unresolved, comment sections everywhere (not just this video) have a lot of people speaking as if he's already been convicted of a crime. And then the usual suspects are in the other extreme camp being predictable. Point is, people in general are ass at suspending their narratives and patiently waiting it out. We really can hold both cynicism and an open mind.

    4:48 Correction: Buzbee actually did not ask for a settlement from Jay Z. His client requested that Jay Z sit down with her to mediate the issue together so the case did not go to trial. No money was requested by the client. The fact that Jay Z refused that while it was still anonymous is insane. It reminds me of when he refused to get a DNA test to disprove paternity with the young man who claims he is his son, which only created a bigger media frenzy. The ego clouds judgment.

    Great video Xevi, thank you for being so thorough and thoughtful with such a serious matter. And THANK YOU for pointing out the burden of proof is lower for civil cases. SA cases are already known to be astronomically hard for victims to win. When I went after my assaulter legally, that's exactly why they recommended a civil case. They basically said there's no way in hell you're going to get to trial if it's a criminal case, even if you have physical proof and eye witnesses. The fact that they went this route and Jay Z (supposedly a very calculated man) had such an immediate emotional reaction, allegedly intimidated them, and is associated with all these different eyebrow raising people tells us all we need to know.

    6:15, why tho? A testimony is not enough evidence to find someone guilty without phisical evidence isn't it? Someone could be paid or just lie "my word against yours"

    Out of that whole story u told what stands out to me is that the limousine driver took this under aged girl to diddy.. but whats more confusing then that this 13 year old girl was by herself no friends so she snuck out to go to a party by herself.... thats crazy..
