Fixed gear does not always mean that you are riding without brakes. Most fixed gear riders have at the least a front brake, I rode with both sets of brakes when I rode fixed. With that said, even if you're brakeless you can still control the bike safely if the topography isn't too crazy.

It's not about assigning blame, it's about common sense. People make mistakes and it's not worth it to pay for those mistakes with broken bones and permanent brain damage.
Idk man, you can make a great recovery from head trauma, but I personally (suffering from head trauma more than a year ago) still deal with a lot of problems from it. Memory, deja vu sensations, irritability, and permanent hearing loss. I have no idea if the other problems will eventually go away, but regardless, a lot people deal with some sort of post trauma issue. Just my two cents to say at least wear a helmet. You look a lot less silly with a helmet on compared to laid up in ICU.
