    Hi DeWayne! I’ve been watching your videos and going through this process now. I won’t be attending my C&P (which I recently received via email), due to having an actionable and sufficient DBQ (3 for increase). I’ve also sent in a VA Fm 21-4138 and stated I want them to use my sufficient DBQs to rate my claim. I will give you an update once this is complete. Thanks for the education you’ve armed me with to fight a good fight!

      Update: I am 100 P&T as of my original ITF!!
      This is how my claim went;
      ITF: 30Jan2023
      Private DBQs completed Jun2023
      Filed increase claim w/ DBQs 31Aug
      -no personal statement, just sufficient and actionable DBQs
      Received email by VES for C&P exam Dec2023, but I sent in a 21-4138 stating I was not attending any further exams due to my sufficient DBQs.
      As soon as I canceled my exams with VES (which were accurate for what I claimed), I asked the VES representative to annotate exactly why I was refusing my C&P. I then conducted a follow up by calling the 1800 number and spoke to them. I explained what I told VES about canceling my exam, and she also annotated that in my record on why I was refusing my C&P exam. That was on 28Nov.
      06Dec - woke up this morning and saw my new rating, notification letter, and my rating letter.
      DeWayne, despite not using your company’s services, your knowledge from these TH-cam videos alone definitely helped me understand the process and I applied it all. I spent countless hours over the past 3 years finding information via 38 cfr and M21 manual reference and you led me on a path. I had a plan, and even had a backup (HLR) if it didn’t go the way it should with what I submitted. I cannot thank you enough!

    if an ace exam was performed for the cause of death and did not include any assessment of the secondary conditions. The examiner only assessed if the in-service injury caused death, rather than determining if the in-service condition led to the secondary conditions that led to death. Can an IMO sufficiently complete with opinions on secondary service-connected condition and opinion on the cause of death win the claim with medical evidence and the in-service event?

    Is there ever a case where a veteran submits an actionable DBQ from a private physician and is still required to attend a VA exam in person? I.e., can they deny you for not going to an exam if you already submitted a valid DBQ?

    I'm so thankful for your videos!!! I've learned so much by watching, and I just submitted my claims for an increase, SC, and secondary. I submitted my claims (19 total) on June 14, 2022 and got my first phone call on June 16, 2022 from QTC (2 days later). I was surprised at how fast my first exam was scheduled...especially because I'm in the Waco, TX region and I know they have a heavy backlog. I remember watching this video beforehand so I specifically asked which exams will I be scheduled to conduct. The QTC rep sent me a link to the QTC portal which had my examiners information and each DBQ for the exams which will be conducted. Just praying for that increase from 60% to 100%!

    Hi Dwayne i just recently back end of April filed a va disability claim for lower back pain, Tinnitus, and hearing loss. About 1 week after filing i got scheduled and went to the hearing test. And regarding my back issues, i have a xray on file and have been seeing a va chiropractor at the va hospital as well. I was told by a person in the call center that a c@p exam was not needed for my back due to enough medical evidence in my file. Is that a good or a bad thing? And how would they know how to rate me with no c@p exam?

      @DewayneKimble can you link the video? And I was looking at my claim status on the my healthy vet website and saw they submitted 4 dbq on my behalf. 2 weeks ago I am going to submit a FOIA request tomorrow at my doctor appointment. But again it makes sense because all the evidence to support my claim is in my doctor notes and my xrays and my chiropractor notes all va doctors I literally would basically say the same thing that's in the notes. So the lady at the call center did say that when they have enough medical evidence that it's not a bad thing if no c@p is required. Because my back condition is on the website as a approved disability and the xray proves it. So why would a exam be needed right?

    Hello. Great info here. Appreciate you providing your first hand experience and expertise! Awesome support!
    I am 86 days into my supplemental claim for depression. I’ve been under treatment through the VHA for a year now and submitted a DBQ done by my private doctor.
    Called the VA for an update as the VA website said my file was being reviewed by a rater. The VA person said they had completed gathering info (including from VHA) and my file was presently in the decision phase. I asked if a c&p would be scheduled. She said likely not because they had the DBQ and my VA treatment record.
    My questions are: Does her statement jibe with your experience? Also, my private doctor wrote the nexus statement in the DBQ remarks section instead of a separate letter. Have you ever seen that before and, if so, was it good to make the DBQ actionable and sufficient. Everything else is good to go.

    • @DewayneKimble
      @DewayneKimble  11 หลายเดือนก่อน +1

      Your welcome. No, the person on the other end is not a rater. I have several videos on what some VA employees are doing when vets submit evidence they can use to rate the case. I have a video on nexus statements in the remarks section. I can't say if the DBQ was sufficient without looking at it. My VSO has a high work load and doesn't communicate well with me. I'm 50% rated for PTSD. We recently appealed and included conditions which my first VSO didn't even include. Since the appeal, I've been to the C&P, I've had a sleep study which determined I have Sleep Apnea. I have an upcoming hearing test for Tinnitus as well as an exam for other conditions. My concern is that I can't trust the VSO to do due diligence. I'm afraid something will get missed like on my first claim. Are there any forms I should be filling out and uploading, such as the form where I state how the Sleep Apnea affects my daily living. I don't want this to turn into a cluster as the process is already complicated enough. Also, how do I get a copy of my C&P exam results? My VSO was supposed to contact me when it came through but it seems like it's been long enough now. 🥴

    Hi dewayne! Your videos are so helpful!
    Question… my husband had a C&P Exam for hearing on January 7, 2021. We have heard nothing nor received a copy of that exam. Today is July18… should he have heard something by now? Is 7 mo after. a C & P Exam normal not to hear one word about a claim that was submitted in sept 2020? My husband is 82 and is near deaf for decades. He never knew he could even apply for any kind of help until some family encouraged him to apply.
    Thank you
