Little known fact: Nintendo almost patented the jumping mechanic in video games. They actually invented it. But Miyamoto thought it was too cruel to other developers to do that.

If your brand begins to be used as a general term, its not your brand anymore. And they cant do anything about it. Because their essence is too general. You can say Mario and Zelda and all of that are very specific. Batman Arkham asylum has a very iconic combat system that was stolen instantly by other games. And I’m pretty sure we all know what happens to the dark souls(or should I say demons souls) Mechanics around move sets. Way more iconic things have been stolen way less shamefully, and we just go with it because it’s insane to patent something like the arm of a chair putting wheels on the bottom of your chair or polishing. Palworld came out in January 2024, which is after the patent was granted, but was initially revealed in June 2021, which was before they applied for it. So it could be argued that Nintendo applied for the patent in response to their announcement of Palworld, but I don't think it's that likely Nintendo saw Pocketpair as a serious threat back then

I miss the times when Rare worked for Nintendo. They used to make one influential game after another, constantly innovating, especially when it came to 3D platformers. However, now the company is just a shell of its former self and most of the employees from that 90's - early 2000's era are now at Playtonic.
You can trademark just about anything that isn't already taken. You can't copyright a common term, through, that's the difference. Halo, Battlefield, Medal of Honor, they're all trademarked, but nobody can be sued simply for using the term.
Difference is Nintendo went after the Palworld creators because they can bully them financially to ensure they'd either win or bankrupt them trying. Sony is a different animal altogether, so Nintendo won't touch them, even if they'd have a much stronger case against Sony than against Pocket Pair.

The only difference is the former uses a dialogue system while the latter uses a ball, but the concept is still very similar. If your brand begins to be used as a general term, its not your brand anymore. The fact that people think that harms Nintendo because the things that characterize Nintendo are beginning to be so general that they arent gonna have any right over Nintendo's identity. Astrobot is an example. It clearly is a "Nintendo game". But nothing that they did is illegal, or really patented or anything. Anyone can do that type of game, its not exclusive of Nintendo. So, with each passing year, there are gonna be more and more games like this because videogame industry keeps growing, keeps inspiring new generations, and keeps advancing technologically, and in a decade or two, there are gonna be so many "Nintendo games" that Nintendo isnt gonna be special anymore. And they cant do anything about it. Because their essence is too general. You can say Mario and Zelda and all of that are very specific. But the play styles, the mechanics, those are too general and cant be patented, no matter what Nintendo says. If Nintendo holded absolute power gaming would be patented already, so it doesnt hold absolute power. They are gonna have a reality check with Astrobot when they see they cant do anything

Astro's Playroom was such a strong homage to Playstation's past. Makes a lot of sense for the expansion of that game to also represent so many things that have been done before. This was all on purpose, of course, and it makes a great game.

I miss the times when Rare worked for Nintendo. They used to make one influential game after another, constantly innovating, especially when it came to 3D platformers. However, now the company is just a shell of its former self and most of the employees from that 90's - early 2000's era are now at Playtonic.
You can trademark just about anything that isn't already taken. You can't copyright a common term, through, that's the difference. Halo, Battlefield, Medal of Honor, they're all trademarked, but nobody can be sued simply for using the term.

Difference is Nintendo went after the Palworld creators because they can bully them financially to ensure they'd either win or bankrupt them trying. Sony is a different animal altogether, so Nintendo won't touch them, even if they'd have a much stronger case against Sony than against Pocket Pair.
I imagine a smart lawyer could use that against Nintendo. By finding Nintendo's patents for mechanics seen in Astro Bot, I wonder if you couldn't then argue that Nintendo's lawsuit against Palworld is thus frivolous and targeted. @@smithynoir9980I mean the monster catching idea wasn't even a new concept with Pokemon. Shin Megami Tensai already had a simlar mechanic before Pokemon came out. The only difference is the former uses a dialogue system while the latter uses a ball, but the concept is still very similar. I wouldn't say the a ball catching system is super innovative over the former in any real way, just different.
The difference is, Palworld’s monsters directly copy Nintendo’s Pokemon in terms of design.

This has nothing to do with copyright laws though, patent laws are a different beast to tackle. Copyright = designs, patent laws = in-game mechanics.

So you're saying Sony has a vested interest in making sure Palworld doesn't lose their lawsuit. They already did due to the extended media stuff; but this is another, much larger, reason to make sure Nintendo doesn't win that lawsuit.

They already did, Sony and PocketPair created a new company together called Palworld Entertainment. Sony has had a vested interest in this case since before even the rumors were circulating.
Nintendo is going to win the lawsuit. All that's going to happen though is that Palworld will pay a big fine. Maybe about 20 percent of their profits.
@@thinkhector No, they're not. Nintendo filed their patent after Palworld released. You cannot retroactively apply patent laws. If anything happens at most, the court will ask Palworld to change the ball into another shape.
