DOT used to sit outside the driveway of a truck stop in Bemidji, Minnesota Harassing all their regular drivers, and the drivers started not stopping anymore, so the owner of the truck stop and restaurant told the DOT officers if they kept it up that they would no longer be welcomed on the property. The owner called someone high enough up in the state and told them that it was affecting their businesses as the regular drivers we're no longer stopping to get fuel or eat at the restaurant and the DOT officers got told they could no longer do roadside inspections out in front of the truck stop and they had to sit about 2 miles away from the truck stop before they could conduct any roadside inspections.
I was in a rest area parked legally. Cop was knocking on my door. I did not open the door my door was lock. The cop knocked on my door for about 20 min. Then he left. I waited 10 min and left went somewhere else to sleep.
I have had cops tell me to wake up and do an inspection. I told him I’m on a 10 hours off and I’m not going to aid him in inspection. He was not happy about it.

Hey, brother Just to let you know if the truck stop has signs put up that say private property or no trespassing if not conducting business. State troopers and DOT can not randomly enter to conduct inspections! We went to court and won that case!

The district attorney tried to push that it was business but the judge didn't buy that! The the officer was more on fishing expedition.
I would guess most of the time you're right, but I've already seen them break into a sleeping driver's truck to do a 'welfare check' because he wouldn't answer them. I wouldn't put it past them.
According to the CVSA, (Policy creators of the Canadian and American trucking industry.) "If any driver is safely and legally parked any DOT agency or officer/agent is NOT TO DISTURB "off-duty" and/or "sleeper-berth" time." To do so criminally violates the Drivers protected rights. Officials can be sued as well face criminal charges.
The key word is legally parked.. when the lot is full, and people start making their own spots, schools out.. In this video, the driver was clearly not legally parked. Wouldn’t surprise me if another driver called him in. If the flip flopper was behind the wheel, get ready…😉
Didn't they tell you at super trucker school that the moment you sign the back of your commercial drivers license you are no longer a private citizen. You are subject to the rules and regulations of the Department of Transportation's Federal Motor Carriers Safety Administration.
May I add, You may have rights but soon as you turn on that key and start that truck and take off you are probable cause. You fill out a form log book now computerized. They know where you are at 24 hours a day. It's almost get to the point that drivers need to have body cams on them every time they get pulled over by a inspection officer. I would almost make it mandatory to have cameras facing out to protect you from lawsuits. I've never ever been a proponent of the cameras but outward-facing to protect your ass yeah too many people are lying fools these days and will try to do anything even if it's fictitious to get ahead.
My last Ohio ticket consisted of being weighed, I was legal and I had 1 over head running light not lit, gave me the ticket, I climbed up over the fender onto the hood, smacked the light and it came on. He saw it and I went wtf? He said it didn't matter, it was 400 pm and Sunny. True story.

I park overnight at the scales because I know, usually I’ll find a spot. If they inspect me, they inspect me, no big deal if you do good about keeping up on your maintenance. The only time one woke me up was in a RA/scale in VA back in the 90s. I pulled in during the wee hours of the night and parked behind a couple of other trucks; the one in front was parked in front of the scale. I passed though. I’m guessing the same for the other trucks as well.
Three days back we were pulling into a truck stop in New Mexico off I-40. Two trooper cars were parked and issuing tickets to truckers entering the truck stop. I asked the employee if it’s common and he said yes they issue tickets for trucks with cracked windows, light out on trucks or trailers etc, etc; They’re off of the trucking property so legally they can do it. I shook my head.
Its illegal for them to interrupt your break time. They have to sign your book and put you back in service. Once your back in service you are eligible to drive by waver of D.O.T. I had it happen in Texas rest area. When asked him to sign my logs, he refused. I then told him to come back after 8 hrs. If you dont stand up your rights. Only in an emergency can they wake you from your break. An inspection is not an emergency, therefore they have to put you back in service.
Makes you wonder, if you get run into at a truckstop the cops say it's private property and they won't make a report, but they think they are entitled to wake someone up for a inspection 🤔
I know this area in Texas. I’m based out of there. They always pulling trucks over and doing dot inspections. Even if you are taking a break. They focus on intermodal and tankers most of the time. So watch out drivers
I’ve seen it done in Arkansas and Ohio, at rest areas and truck stops. I would just tell them I’m off duty and if I’m doing my ten ain’t no way in hell I’d go on duty for them because that’s the law. Have to be on duty for an inspection. By Al means they could do a level 5 if they want but they can’t check logs or paperwork or anything of that sort if they do.
The regulations used to be If they roll up on you and you are sitting in the drivers seat, break or no break, you are supposed to be on duty not driving and they can start with that. I haven’t heard that anything has changed with that.
When I was still driving, I would never answer my door if they knocked on my door and said they wanted to do an inspection. You have to be "ON DUTY" to do an inspection. If you are "OFF DUTY" or in "SLEEPER BIRTH" then you would have to break the law in order to preform that inspection. On I-71 in Ohio just south of Cleveland there are rest areas that the DOT and HIGHWAY POTROL will sit and wait for drivers. Then they will do inspection. They will even wake you up if you are sleeping. If happened to me years ago I told the DOT MAN that I was off duty and that he was going to have to wait for me to go back on duty. He said that he didn't have "TIME" for that. When I woke up there was a BOOT on my truck and a 24 hour impound notice. I called my wife to come get me. I only live 35 miles away. I ended up doing a 34 hour reset. When I went back, the boot was gone. I called my attorney, took the ticket to him and the DOT MAN was suspended for 6 months but they are still doing the same crap to this day.
They do it in riviera tx. When you stop for food or gas at the stripes. They wait for you to sart moving and before you exit, they put the light. They are money hungry. It's sad when they get you while you stop for rest or food.

Dot can't go on private property and do a inspection on your truck unless he has the promistion of the owner. But he can request for you to go to the truck stop for both of you to be safe
I had a New Jersey state trooper banging on my truck at 3:00 a.m. when I was parked in the TA truck stop on Route 78 I just never answered stayed in my sleeper and went back to sleep
Truck stops are supposed to be our safe haven & should never be harassed while in these places. We should also never be put in harms way by being inspected on the road side due to the dangers involved for everyone, thats why we have weigh stations & inspection areas for such. It should also be a violation on the officer to wake up a driver & harass him for an inspection or any other reason while driver is off duty!! Total bullshit.
I do know that if you have an accident in a truck stop, cops cannot do anything. It's private property. So I don't think they should be allowed to inspect you while you are on private property.
The locals were doing this 20 yrs ago in Effingham IL and the fedral court said they could not do so if you are sleeping/parked curtains closed. This is especially heinous if you are taking your ten, but if an offer sees something that gives him a reason you're screwed. Should not be allowed to do this at truck stops
Ive had 1 cop in VA knock on my foor because i was parked on the off ramp just like he woke me up he did everyone else and asked us to go to the truckstop he even said i drove by there and they havea lot of empty free spots
If Your Parked in a Parking Spot, Do not get into Driver’s Seat, and Crack Window, and Tell Them to come back when Your Break is Over. When break is over, Log Off Duty, and You get Out on Passenger side, and Go inside Building, and Take Your Time. If Officers are There, and Try to Stop You, Tell them Your “Off Duty”. Remember Your 5th. Amendment Right. If You take a 10h., or 72hr. Break You can Extend it if You Choose. “They Can Not Force You Back To Work”. Also keep up with Your time From Start to Finish, if They Detain You, You’ll need it for Your Lawsuit.
A truckstop is private. Cops cannot come onto the property and pull you over even if you are not parked right on the property. It would have to be the owner of the property to call the police and tell the police that somebody is not parked correctly and they would like them to be removed from the property. If cops come on the property and harass, the people that are on that property that are currently doing business with that property without consent of the odor of that property. The property odor should be able to sue the cops for disruption of business. It is the same thing as a cop that is sitting out in front of a Bar, waiting for people to leave the bar so they can pull them over. It is against the law for them to do it.
Same thing. If im off duty im not signing on for inspection as you must be logged in during inspection. If they ask are you refusing inspection, you say no. My time rolls over in 10 hrs and id be happy to do one then.
I was pulled over once heading onto an exit. State trooper said where I’m headed, I told him to the truck stop for a 10 hour break and I only see 1 or 2 spots left . He told me to pull into a spot so I get one for my 10 hour break and I’ll inspect you there. Most cops are cool with truckers if we have a great attitude
The only reason I was usually bothered by the police or highway patrol was when I was questionably parked and then they would direct me to a safer parking spot never got inspected while off duty and other truck drivers would tell me that I haven't met the right officer yet
The law is Clear If an officer observes you breaking the Law ON THE ROADWAYS then he can pull you over and do an inspection on a CMV but they MUST have a legal reason for the Traffic Stop. The officer CANNOT just pull you over for the sole reason for doing an Inspection. This is Illegal and is not allowed. Can they (State Troopers) or DOT just knock on your door on Private Property just to give you a DOT inspection ?? NO they can't. Private Property is your safe haven from officers as long as you are Parked in a TruckStop taking your Break.
If I'm off duty, and don't have any more time on my clock, they will have to wait until my 10hr break is completed. I have to be on duty for an inspection
Simple, keep your curtains pulled and ignore the knock. Just like at home, just because someone rings your doorbell it doesn’t obligate you to answer the door and if you do, it certainly doesn’t obligate you to help while on your break.
DOT should leave Truck Drivers alone at Truck Stops. It must be rare! I retired after 25 years OTR and DOT never bothered me at Truck Stops or Rest Areas. I drove for a Fortune 500 company the last 15 years and DOT told me several times that they were using me to train their new guy. I hated it because it happened a couple times a year but I was polite and helpful. It was over in 15 to 30 minutes.
I owned a small trucking company. Never had a problem with the DOT. Always had all truck information organized and easy to get to. Always had all DOT inspection done annually on the trucks, any maintenance or anything the trucks needed was always done. Officers were always polite and really just doing their job. Run legally, do proper maintenance, and Guess what you will never have a problem. I never had any violations or trucks detained!!!
If the driver is off duty taking their 10 break it should be a violation against law enforcement because that means the driver has to be on duty not driving during inspection 😮
What they do to truckers is exactly the same that happens to home and land owners. Think about that one. I can't stand breaking the laws. Way to much stress. Yet. My camera's are not because of the public. That's how many times I have been accused of false charges. My camera's are for the illegal law enforcement. Here. I have been to court under 5 false charges and lost all 5 court cases. Just here. It's extremely worse being a vet than a trucker. That was my job in the Army. A trucker. Same exact thing you're all doing. Hauling loads.
If you are in an Off Duty status, in a legal parking space, go to the passenger side of your truck and inform the Officer that you are on your Federally Mandated 10 hr break and will not comply with his inspection personally, but that he is welcome to inspect the truck where it does not require your participation, including any further communication. Hell, get dressed and go to the store or whatever you want. You're Off Duty. If you are in Sleeper Birth, if you are in a legal parking spot, it is actually against the Law for them to interrupt your break unless there is a life threatening emergency.
Before driving OTR I drove a dump truck for a ready mix plant and had the Dot officer stopped me at the plant and checked the weight ticket for the load.
What I've noticed is they give nothing but warnings rarely any tickets I think they are trying to put the smaller companies out of business they don't care about safety and they do the truck stop thing in San Antonio too

If your off duty you can’t participate in the inspection per there own regulations they imposed.

The regulations used to be If they roll up on you and you are sitting in the drivers seat, break or no break, you are supposed to be on duty not driving and they can start with that. I haven’t heard that anything has changed with that.
When I was still driving, I would never answer my door if they knocked on my door and said they wanted to do an inspection. You have to be "ON DUTY" to do an inspection. If you are "OFF DUTY" or in "SLEEPER BIRTH" then you would have to break the law in order to preform that inspection. On I-71 in Ohio just south of Cleveland there are rest areas that the DOT and HIGHWAY POTROL will sit and wait for drivers. Then they will do inspection. They will even wake you up if you are sleeping. If happened to me years ago I told the DOT MAN that I was off duty and that he was going to have to wait for me to go back on duty. He said that he didn't have "TIME" for that. When I woke up there was a BOOT on my truck and a 24 hour impound notice. I called my wife to come get me. I only live 35 miles away. I ended up doing a 34 hour reset. When I went back, the boot was gone. I called my attorney, took the ticket to him and the DOT MAN was suspended for 6 months but they are still doing the same crap to this day.
They do it in riviera tx. When you stop for food or gas at the stripes. They wait for you to sart moving and before you exit, they put the light. They are money hungry. It's sad when they get you while you stop for rest or food.

Dot can't go on private property and do a inspection on your truck unless he has the promistion of the owner. But he can request for you to go to the truck stop for both of you to be safe

Truck stops are supposed to be our safe haven & should never be harassed while in these places. We should also never be put in harms way by being inspected on the road side due to the dangers involved for everyone, thats why we have weigh stations & inspection areas for such. It should also be a violation on the officer to wake up a driver & harass him for an inspection or any other reason while driver is off duty!! Total bullshit.

I do know that if you have an accident in a truck stop, cops cannot do anything. It's private property. So I don't think they should be allowed to inspect you while you are on private property.

The locals were doing this 20 yrs ago in Effingham IL and the fedral court said they could not do so if you are sleeping/parked curtains closed. This is especially heinous if you are taking your ten, but if an offer sees something that gives him a reason you're screwed. Should not be allowed to do this at truck stops
Ive had 1 cop in VA knock on my foor because i was parked on the off ramp just like he woke me up he did everyone else and asked us to go to the truckstop he even said i drove by there and they havea lot of empty free spots

If Your Parked in a Parking Spot, Do not get into Driver’s Seat, and Crack Window, and Tell Them to come back when Your Break is Over. When break is over, Log Off Duty, and You get Out on Passenger side, and Go inside Building, and Take Your Time. If Officers are There, and Try to Stop You, Tell them Your “Off Duty”. Remember Your 5th. Amendment Right. If You take a 10h., or 72hr. Break You can Extend it if You Choose. “They Can Not Force You Back To Work”. Also keep up with Your time From Start to Finish, if They Detain You, You’ll need it for Your Lawsuit.

A truckstop is private. Cops cannot come onto the property and pull you over even if you are not parked right on the property. It would have to be the owner of the property to call the police and tell the police that somebody is not parked correctly and they would like them to be removed from the property. If cops come on the property and harass, the people that are on that property that are currently doing business with that property without consent of the odor of that property. The property odor should be able to sue the cops for disruption of business. It is the same thing as a cop that is sitting out in front of a Bar, waiting for people to leave the bar so they can pull them over. It is against the law for them to do it.

I was pulled over once heading onto an exit. State trooper said where I’m headed, I told him to the truck stop for a 10 hour break and I only see 1 or 2 spots left . He told me to pull into a spot so I get one for my 10 hour break and I’ll inspect you there. Most cops are cool with truckers if we have a great attitude
The only reason I was usually bothered by the police or highway patrol was when I was questionably parked and then they would direct me to a safer parking spot never got inspected while off duty and other truck drivers would tell me that I haven't met the right officer yet

If an officer observes you breaking the Law ON THE ROADWAYS then he can pull you over and do an inspection on a CMV but they MUST have a legal reason for the Traffic Stop.
The officer CANNOT just pull you over for the sole reason for doing an Inspection. This is Illegal and is not allowed.

Simple, keep your curtains pulled and ignore the knock. Just like at home, just because someone rings your doorbell it doesn’t obligate you to answer the door and if you do, it certainly doesn’t obligate you to help while on your break.

A periodic inspection that’s required ever !2 months is not done by a dot officer. It’s done usually by the company shop or other authorized shops.

DOT should leave Truck Drivers alone at Truck Stops. It must be rare! I retired after 25 years OTR and DOT never bothered me at Truck Stops or Rest Areas. I drove for a Fortune 500 company the last 15 years and DOT told me several times that they were using me to train their new guy. I hated it because it happened a couple times a year but I was polite and helpful. It was over in 15 to 30 minutes.

I owned a small trucking company. Never had a problem with the DOT. Always had all truck information organized and easy to get to. Always had all DOT inspection done annually on the trucks, any maintenance or anything the trucks needed was always done. Officers were always polite and really just doing their job. Run legally, do proper maintenance, and Guess what you will never have a problem. I never had any violations or trucks detained!!!

What they do to truckers is exactly the same that happens to home and land owners. Think about that one. I can't stand breaking the laws. Way to much stress. Yet. My camera's are not because of the public. That's how many times I have been accused of false charges. My camera's are for the illegal law enforcement. Here. I have been to court under 5 false charges and lost all 5 court cases. Just here. It's extremely worse being a vet than a trucker. That was my job in the Army. A trucker. Same exact thing you're all doing. Hauling loads.
If you are in an Off Duty status, in a legal parking space, go to the passenger side of your truck and inform the Officer that you are on your Federally Mandated 10 hr break and will not comply with his inspection personally, but that he is welcome to inspect the truck where it does not require your participation, including any further communication. Hell, get dressed and go to the store or whatever you want. You're Off Duty. If you are in Sleeper Birth, if you are in a legal parking spot, it is actually against the Law for them to interrupt your break unless there is a life threatening emergency.

Federal motor carrier act says 10 hours uninterrupted break. Can’t perform a dot inspection other wise dot is breaking a law and can be sued.

Before driving OTR I drove a dump truck for a ready mix plant and had the Dot officer stopped me at the plant and checked the weight ticket for the load.
They've done a level 2 inspection in PA while taking a 30 min break
What I've noticed is they give nothing but warnings rarely any tickets I think they are trying to put the smaller companies out of business they don't care about safety and they do the truck stop thing in San Antonio too
