Alex, can you tell us what happens when you blow a. 02 and you’re operating a CMV? Because you’re not going to get a DUI but if you do blow a .02 or higher you do get removed from operating for 24 hours cause you’re not supposed to drive that high with a load……… And I’m wondering if you got a ticket that’s not a DUI ticket but still a ticket or if it’s considered a put out of service or just what is it ? Does it go on your record even though it’s a legal limit?…… also, would you be able to operate a CMV if it’s personal conveyance and your higher than .02, but below .04?
Please share accurate DUI/Impaired driving information! Good for the cop to arrest an incapable driver! These tests are arbitrary and not required. The cop was already more than likely going to arrest him before he got him out of the truck. And I mean all the tests. Follow the finger, steps in a line, breathalyzer tests are inaccurate. However, after refusing all of these tests and pleading the 5th, do take the breathalyzer test or blood draw at the station. Call your attorney. Pretty simple.
Every officer should be like this. Very nice and respectful while still doing his job! It sucks for the driver, but actions have consequences. This would’ve happened to him sooner or later. Thankfully no one was a victim of his negligence.

It's very sad. But kudos to the cop for being so patient and professional. Being an alcoholic, who stopped drinking in 1997, I feel for this guy. It's a daily struggle but truthfully he needed this to wake him up. I hope and pray he gets the help he needs. Peace

I feel you mate but it could have been delt with on the forecourt so it wasn’t holding up drivers on a deadline. I’m a truck driver. I once had one shooter of vodka at lunch and waited an hour before driving and still feel guilty about it. It wasn’t a smart choice and what this guy did was ridiculous
I see it like this. I'm off work, at the end of my day, and want a couple beers to relax and help me fall asleep. Same as anyone else out there. The law states 8 hours bottle to throttle. So give yourself enough time to process what you've had and can do your job clear headed. But you can't stop being human. As for a 34? Lol have fun on night one.
At a time where many Truck Operators are being Laid Off and in some cases without warning, this certainly isn't the time for any Operator to display their worst example while on the clock.
Not true at all , it’s called using good judgment, if you’re gonna drink make sure it’s on your 34 , and no alcohol 10hrs b4 your shift , I will say this since I’ve had my CDL I rarely drink alcohol anyway.

Over six times the legal limit for CDL holders. Also important to note that even if you show any trace at all they can park you for 24 hours. It's just not worth it.

I was talking to a guy driving forklift one day and he told me he used to drive LTL so I asked the usual question why, he told me he got a DUI 10 years ago and driving the forklift was the only job he could get.Getting a CDL and also working on getting my pilots license made me give up drinking completely!!!!
That guy was lucky. I worked for a LTL carrier and we had a local driver busted for DUI. Everybody liked this guy, he was young and a hard worker. T/M put him on the dock,and let him fuel trucks and do some yard moves. Until the regional safety Mgr showed up one day and began asking questions. T/M was told he was not permitted to operate any equipment including forklifts, fuel pumps, or vehicles and he shouldn't even be working here. I thought the T/M was gonna get fired! Hard lesson to learn, but I guess it has to be that way.
DUIs don't stay on your record forever. Each state has a different amount of time it's on your license. Most smaller outfits will hire drivers once they are insurable again in a commercial vehicle, which is typically 6+ months after their license has been reinstated. A lot of drivers get DUIs and immediately think their career is over, it's just flat-out not true.

It's terrifying to hear the long pauses in between counting. That's the time difference from braking or stopping at a red light. Nice to see this guy off the streets, as far as big rig goes.

I drive at night. So by the time I get home in the morning, I’m too tired to drink. That’s why I only reserve it for the weekend. Plus, my girlfriend lives with me, so I have a designated driver if I need to go anywhere. I already had 1 DUI (in my personal vehicle) and I’ll be damned if I get another!!

An old timer back in late 90’s told me he used to drive from Northern California to L.A back in the 70’s with a 6 pack sitting between his seats. He knew he was almost there once he was on his last one.
Thank you brother. It's absolutely scary that men and women believe it's ok to party it up before you get behind the wheel of a big rig or any other vehicle at that. This is one of the biggest reasons I came off the road is because it seemed like every single day no matter where I was I was seeing the flat out incompetence of others believing that's okay to drink before you get behind the wheel. Just when you think your ok to drive,step back and test yourself,your balance,your eye sight. If your bold enough to drink,your bold enough to take the day off and sleep it off. Yes and no. It may be an automatic fail as far as being taken of the road and a suspended CDL but it will always be easier to fight in court if you don’t hand the government any evidence. If found not guilty you have a fighting chance to get your CDL back.
SIX TIMES the legal limit for a CDL Holder. When I was over the road, I always avoided alcohol, IF I was going over the road, the next day. I didn’t want to take the chance. This video just reminded me why you don’t want to take the chance.

Thank God for the officers that do their job in regards to this. A regular car or truck (under 26k pounds) driven by a drunk driver is scary enough for me. A tractor trailer over 26k is horrifying to me. I like a drink here and there but, I would never cut it close in the slightest. Civilians don't deserve the carnage that can be caused by a drunk driver. I'm a new commercial driver and I am disappointed in this guy. Major props to the officer. Thank you Sir! One time, I took a nap. Woke up and started driving again. I guess it wasn't long enough of a nap, because I started doing a little weaving out of my lane. Got pulled over because they thought I might have been on drugs. I just told them that I woke up from a nap a little while ago. They did a field sobriety test on me and told me to grab a Red Bull and drive safe 😅
That’s why they do the breath test to confirm…. They do the other tests, which are hard to pass sober if they suspect you drinking. They simply want to know your BAC.
Appreciate this! Those 2 DOT officers are 100% by the book, I've had a few run ins with them. They ticketed me for no seatbelt because I had to back onto the scales again to re weigh and i couldn't see where to stop so I unbuckled and when i came in with my log they had a ticket for me. Also watched them take a truck out of commission because it was 1 3/4" over the max length.
Excellent video Alex, there are way too many drivers driving intoxicated on the daily. One hint of advice, use the mouth wash that contains "zero" alcohol.
It always disturbed me that the question most asked after "is parking spot available " was usually "do they sell beer?" I never ran into any other drivers that drank alcohol while I was driving. But I do know that plenty of them do when they are parked for ten.
Those sobriety tests are designed to make you fail. Once you have taken the breathalyzer test, insist on taking an independent breathalyzer test at a medical facility.
I can barely say my abc forward his biggest mistake was telling the officer he been drinking never at mitt guilt to anything until U get advice from your attorney
@@kendrickburnett2305 here failing to or refusing to provide a breath sample is as good as impaired. Probably easier to defend against in court but you could potentially be stone cold sober and be convicted of impaired if you refuse to blow. Don't know how it is other places this is in Canada

There are several things that could affect you being able to balance on one leg besides being drunk. Having a bad back or even being overweight can cause you problems.

I had to give up my CDL class A 2 yrs ago bc of a heart surgery but when I went to school for it, they never taught us about alcohol limits. I never knew it was .04 for truck drivers. Makes me question what else they didn't teach us
My 17 year old friend was changing a flat on the shoulder and he got hit and killed by a drunk semi truck driver who was already on a suspended license from previous drunk driving charges, he hit him and kept on driving, when they caught up to him later that day he had prescription pills and other drugs in his blood as well as alcohol.
Why blurr it out? I've already watched the full body cam footage someone uploaded on TH-cam. It's all public information and he has no right to privacy in this situation.

Even if it was a 100% clean inspection? He still has no right to privacy. Why coddle a man who was drinking and driving? If he killed your family, would you still expect his face to be blurred out??

If I said it once, I said it 1000 times, if any officer asks you anything potentially incriminating, say, “I don’t answer questions”. Also don’t consent to any searches and never do any field sobriety tests, if they’re gonna make you do FSTs there’s a good chance you’re going to jail anyway. It’s not your job to provide evidence. Make them do their job.
I don't drink at all, and it's a shame this driver has lost his CDL, has no means of making a living, and has risked the lives of others by drinking and operating CMV. Hope he gets the help he needs. I'm so glad they actually identified his condition and got him off the road, preventing a major incident.

Any drunk driver lawyer would tell you to never take that test because once you do you're done. It's better to take the year DL suspension because a lawyer can fight the rest.
As soon as any insurance company finds out why your license was suspended, they will treat that as an admission of guilt and you won't work foe 5-10 yrs. Same goes for open container of alcohol.

@@theodoreskaff1209 that’s not true. I got a DWI in my personal vehicle with a CDL and I am an owner operator. I only had a couple beers celebrating my youngest son’s 21st b-day. I probably would’ve passed the breathalyzer, but didn’t take the risk of a DWI conviction and refused. I got an ALR suspension. Class C for 6 months, and Class A for 1 year. I parked my truck for a year and started back driving the very week my suspension was lifted. Nothing ever went on my driving record, class c or class a, nor did it ever affect my insurance. I put the ALR suspension on every subsequent application that I worked for, and was never denied employment.
HB okay. So if I was a Japanese truck driver and a vital shipment of food or medicine had to be transported, I would tell my boss: tell your photo-breathalyzer to drive the truck. And go and fornicate with the dead emperor's ghost... I'm going home. To have a Sun-Tory Scotch on the rocks.
I don't drink and drive, but I also don't submit to field sobriety tests. They can be too subjective. If I know I'm clean and I would prefer to be released from detention, a breathalyzer would make more sense. It's less bullshit. As for the question of whether you should or shouldn't accept the taking of the breathalyzer, I have a couple of extensible concerns about them in general. In some places you can't decline the breathalyzer without extremely expensive and damaging impacts to your life - which I think is a violation of your due process rights. (Punishment without trial or prosecution.) If you agree to it, while drunk, should that be legal, since you cannot do many things under the influence. (You can't write a will, sign a contract, consent to sex, or get married while legally drunk since it would be coercive or impact your judgment.) It also requires you to ostensibly act as a witness against yourself by producing evidence of guilt against yourself through exhalation. If an officer asks whether you want to take a breath test, I think the appropriate response is to tell the officer that since you've been formally arrested and Marandized, you would like to speak with legal council before making any choices or providing any further information. Then call a defense attorney's answering service and tell him to take his time getting to the jail, so you can spend enough time venting and metabolizing the booze. 🤣

In all my years of trucking I never went out on the road drinking or drunk, that's a big no no, not even in my personal vehicle, and why he subjected his self to these tests to build evidence against his self I don't know, he should have went straight to the breathalyzer and got it over with, alcoholism is a terrible thing.

I was talking to a guy driving forklift one day and he told me he used to drive LTL so I asked the usual question why, he told me he got a DUI 10 years ago and driving the forklift was the only job he could get.Getting a CDL and also working on getting my pilots license made me give up drinking completely!!!!
That guy was lucky. I worked for a LTL carrier and we had a local driver busted for DUI. Everybody liked this guy, he was young and a hard worker. T/M put him on the dock,and let him fuel trucks and do some yard moves. Until the regional safety Mgr showed up one day and began asking questions. T/M was told he was not permitted to operate any equipment including forklifts, fuel pumps, or vehicles and he shouldn't even be working here. I thought the T/M was gonna get fired! Hard lesson to learn, but I guess it has to be that way.

DUIs don't stay on your record forever. Each state has a different amount of time it's on your license. Most smaller outfits will hire drivers once they are insurable again in a commercial vehicle, which is typically 6+ months after their license has been reinstated. A lot of drivers get DUIs and immediately think their career is over, it's just flat-out not true.

I drive at night. So by the time I get home in the morning, I’m too tired to drink. That’s why I only reserve it for the weekend. Plus, my girlfriend lives with me, so I have a designated driver if I need to go anywhere. I already had 1 DUI (in my personal vehicle) and I’ll be damned if I get another!!

Yes and no. It may be an automatic fail as far as being taken of the road and a suspended CDL but it will always be easier to fight in court if you don’t hand the government any evidence. If found not guilty you have a fighting chance to get your CDL back.

Thank God for the officers that do their job in regards to this. A regular car or truck (under 26k pounds) driven by a drunk driver is scary enough for me. A tractor trailer over 26k is horrifying to me. I like a drink here and there but, I would never cut it close in the slightest. Civilians don't deserve the carnage that can be caused by a drunk driver. I'm a new commercial driver and I am disappointed in this guy. Major props to the officer. Thank you Sir! One time, I took a nap. Woke up and started driving again. I guess it wasn't long enough of a nap, because I started doing a little weaving out of my lane. Got pulled over because they thought I might have been on drugs. I just told them that I woke up from a nap a little while ago. They did a field sobriety test on me and told me to grab a Red Bull and drive safe 😅

That’s why they do the breath test to confirm…. They do the other tests, which are hard to pass sober if they suspect you drinking. They simply want to know your BAC.
Appreciate this! Those 2 DOT officers are 100% by the book, I've had a few run ins with them. They ticketed me for no seatbelt because I had to back onto the scales again to re weigh and i couldn't see where to stop so I unbuckled and when i came in with my log they had a ticket for me. Also watched them take a truck out of commission because it was 1 3/4" over the max length.

Excellent video Alex, there are way too many drivers driving intoxicated on the daily. One hint of advice, use the mouth wash that contains "zero" alcohol.
It always disturbed me that the question most asked after "is parking spot available " was usually "do they sell beer?" I never ran into any other drivers that drank alcohol while I was driving. But I do know that plenty of them do when they are parked for ten.
Those sobriety tests are designed to make you fail. Once you have taken the breathalyzer test, insist on taking an independent breathalyzer test at a medical facility.

There are several things that could affect you being able to balance on one leg besides being drunk. Having a bad back or even being overweight can cause you problems.

I had to give up my CDL class A 2 yrs ago bc of a heart surgery but when I went to school for it, they never taught us about alcohol limits. I never knew it was .04 for truck drivers. Makes me question what else they didn't teach us

My 17 year old friend was changing a flat on the shoulder and he got hit and killed by a drunk semi truck driver who was already on a suspended license from previous drunk driving charges, he hit him and kept on driving, when they caught up to him later that day he had prescription pills and other drugs in his blood as well as alcohol.
Why blurr it out? I've already watched the full body cam footage someone uploaded on TH-cam. It's all public information and he has no right to privacy in this situation.

If I said it once, I said it 1000 times, if any officer asks you anything potentially incriminating, say, “I don’t answer questions”. Also don’t consent to any searches and never do any field sobriety tests, if they’re gonna make you do FSTs there’s a good chance you’re going to jail anyway. It’s not your job to provide evidence. Make them do their job.

Any drunk driver lawyer would tell you to never take that test because once you do you're done. It's better to take the year DL suspension because a lawyer can fight the rest.

As soon as any insurance company finds out why your license was suspended, they will treat that as an admission of guilt and you won't work foe 5-10 yrs. Same goes for open container of alcohol.

@@theodoreskaff1209 that’s not true. I got a DWI in my personal vehicle with a CDL and I am an owner operator. I only had a couple beers celebrating my youngest son’s 21st b-day. I probably would’ve passed the breathalyzer, but didn’t take the risk of a DWI conviction and refused. I got an ALR suspension. Class C for 6 months, and Class A for 1 year. I parked my truck for a year and started back driving the very week my suspension was lifted. Nothing ever went on my driving record, class c or class a, nor did it ever affect my insurance. I put the ALR suspension on every subsequent application that I worked for, and was never denied employment.

I don't drink and drive, but I also don't submit to field sobriety tests. They can be too subjective. If I know I'm clean and I would prefer to be released from detention, a breathalyzer would make more sense. It's less bullshit.
As for the question of whether you should or shouldn't accept the taking of the breathalyzer, I have a couple of extensible concerns about them in general. In some places you can't decline the breathalyzer without extremely expensive and damaging impacts to your life - which I think is a violation of your due process rights. (Punishment without trial or prosecution.) If you agree to it, while drunk, should that be legal, since you cannot do many things under the influence. (You can't write a will, sign a contract, consent to sex, or get married while legally drunk since it would be coercive or impact your judgment.) It also requires you to ostensibly act as a witness against yourself by producing evidence of guilt against yourself through exhalation. If an officer asks whether you want to take a breath test, I think the appropriate response is to tell the officer that since you've been formally arrested and Marandized, you would like to speak with legal council before making any choices or providing any further information.
Then call a defense attorney's answering service and tell him to take his time getting to the jail, so you can spend enough time venting and metabolizing the booze. 🤣
