  • DOHA has released further information demonstrating their determination to remove access to international students who are over 35 to the 485 Graduate Skilled visa. So far, they have refused to offer transitional arrangements for students who have already started their courses. This exposes the Big Lie to International students and their ability to have access to the 485 visa when they complete their two years of study here.

To date, my friend has spent 3.5 years on his PhD and paid 85K AUD as a tuition fee, and now they are saying no 485 PSW visa because he started PhD at 33 years of age. This country seems like a privately owned company. Shame on them.

So the people who helped them during the pandemic were mostly migrants who worked in retail, aged care etc. were the experienced ones. That is, they are at such an age that most will be removed from the system. Other countries celebrated them and gave a solution to their state but here in Australia we are deprived of hope. Great just great. We contribute in the economy too and to the workforce. Don’t treat us as if we are nothing.

It's ridiculous. When I started my Masters degree, it was supposed to be 3 years. They then extended it to 5 years, and now they're talking about reducing it to 2 years. What the hell? In a period of less than a year, they changed it twice. They should at least honour students who have started their course BEFORE this announcement. A 5 year work visa gives employers more confidence to hire on yearly contracts as compared to 2 years!

have you thought about the possibility that they are doing this deliberately?
I mean, who would benefit the most, if there were fewer candidates seeking jobs with dozens of years of relative experience overseas?
who would be getting those jobs instead?
and would they have incentives to vote for those who can make more policies like this?

Hi Karl. People above 35 are the ones who have family resposibilities and take the risk of quitting well paying jobs and try to fulfill their dream of educating themselves hoping to gain some Australian experience , not giving them 485 when its clearly mentioned on the immi website based on which they took the decision is great injustice.
They need to 1st fix the website saying anyone coming on student visa after this particular date turs 35 cannot apply for 485 ,so they can take right decision.

The department of home affairs has no idea what they are doing, kicking out researchers after giving away tons of free covid visas, It is so contradictory. I won't even have time to do a skill assessment without a post-study visa, so 'offering' other pathways is indeed an insult. Thanks Karl for taking up this issue and bringing out their plan. I hope they give age limit exemptions to those who already got their student visas granted as they would not hv applied for student visa had they knew this age change for 485 upfront.
Don't know why dept is running up and down, just like a head cut chicken. They give extensions and then after six months they are saying extensions will be stopped, they have invited 2 years worth of 189/190/491 visas last year and this year and then it's all got dried up (wa closed their program yesterday). 476 is another U turn. 191 salary was a big confusion that you have taken it up and sorted out. Why are they unable to decide firmly and decisively, what is the right thing to do considering the country, economy, migration, education sector and students? It's full of chaos.

They should’ve just raise the age limit from 35 to 40, since most skilled visas require applicant to be under 45 to be eligible. Then, tie the student visa to 485 and set a yearly cap, just like Canada capping their own student visa grants.

I came to Australia in 2019 for masters program in IT, studied full time paid all the fees to the university completed the course in timely manner even though there were covid crisis across the world. Worked as an essential service employee for one of the Australia's largest fmcg companies paid all the taxes on time while being a student visa. After course completion Worked for 2 government agencies while being on 485 visa as a Business analyst but still Australian immi and government doesn't recognises the skill and hard work done by me. I have put my eoi in 2023, wa government kept changing the rules and regulations hence no pr till now.
Some of the suggestions irrespective of whosoever is in the power (labor or liberal)
    1. Government should have adopted single window policy by giving direct PR to all the candidates who did courses and paid taxes during 2019-2021 during Covid crisis especially onshore ones should have been the high priority.
    2. If we trace back to 2021 Canada and New Zealand gave direct pr to all the people who were working and helping during Covid crisis.
Whereas Australia had closed had shut the doors and were sitting ideal doing nothing.
Not only me Many of my friends are also stuck in the same boat since 2021 waiting for pr.

@@ailsaustralia Yes it would have been really easy to clarify that this is for existing student visa holders as well and the cynic in me tells me that this could be to enrol students that would be effected before they can withdraw but maybe just because they know it’s wrong to move the goal posts whenever you like. It wouldn’t have mattered anyway as the perception is clear now that they simply can’t be trusted moving forward and it undermines the whole integrity of the process. Hey Karl,
I'm a PhD research student in Mechanical Engineering. I would like to share with you my perspective on reducing the eligibility age to 35 for the Graduate Visa 485 concerning research degrees like a PhD. The global ranking of Australian universities plays a crucial role in attracting all the international students to the country. Research impact is one of the key factors driving these rankings and relies significantly on the contributions of international students, particularly those pursuing Master's by Research or PhD programs.
The Australian Research Council (ARC) report states that the average age for starting a PhD falls between 31 and 35. If the age requirement for the 485 visa is lowered to 35, it could potentially impact the preferences of international research students considering Australia as their preferred research destination. This change may not only influence individual preferences but could also have broader implications for the overall ranking of Australian universities in the near future. It may also affect the profit margin of these Australian institutions. You might observe this trend in the upcoming two-year cycle if my assessment is correct.
Thank you, and please keep up your exceptional work.

An excellent video Karl - I had been telling clients that from a legal perspective, generally a new law can't take away a right already obtained, and changes like this are usually grandfathered or transitioned to allow those already in a pipeline to continue. This news is very disturbing (and as you say the PhD students are worst affected - they are more likely to be closer to 35 or past it ) by the time they finish their PhD. So kicking those we most need the hardest (meanwhile the dodgy college Advanced Diploma in Hairdressing and Beautician sneaks through). I'm exaggerating of course but its very annoying - Owen HARRIS - Accredited Specialist in Immigration Law.

Thanks for your video Karl. What I’m failing to understand is how the government can legally implement this age change onto existing student visa holders when the current 485 visa application page states: “temporary visa that allows international students to live, study and work after you have finished your studies”. And then goes to mention eligibility up to 50 years underneath. Surely there must be legal repercussions for stating that word “allows” and then taking it away from students that signed up based on that condition? Thanks so much for all your help.

If 35 years above is considered a debt then these sort of decisions also should not be given by the same age group people because it seems they are not capable of a rational decision either. And ofcourse as the title says This is A Big Lie by the ministers and the Govt.

Thank you, Karl for this. This repositions Australia's student and post student visa program as a visa of the Banana republic, and not early career professionals.
Anyways do you think we have any legal recourse? Perhaps all the aggrieved students can come together and the demand a refund from this here-today-gone-tomorrow system.

I am curious about how with the current high rejection rates for student visas we can justify charging such high processing fees (and also the insitutional application fees) when the criteria for how they will be evaluated are not made public. Instead of wasting their time and money shouldn't students be advised up front whether they have a realsitic prospect of approval and within a reasonable/fixed time..?

If they even care, back in mid 2022 until early 2023, they would’ve been more upfront about PYP validity sudden changes (from 4 years after completion to 4 years after commencement). DOHA did backtrack in early Feb 2023 but so many otherwise eligible 189/190/491 applicants received their refusal letter because of that and DOHA shrugs off like nothing happens, not to mention lengthy AAT hearing waiting time and years of uncertainty.
Another egregious example would be the 191 visa income requirement uncertainty. Announced back in Sep 2019 the income level would be tied to the TSMIT, but had no legislative instrument to back it up and still there isn’t today, meaning the TSMIT hike happened back in July 2023 would potentially invalidate many 491 holders chance to get their 191 PR visa, noting that 491 is only a temporary visa with 5 year validity, and income requirement must be met for 3 out of 5 years. DOHA did announce later that the income level used to satisfy 191.222 is $0 (meaning any income), but that leaves a sour taste on many 491 visa holders who are draining themselves to satisfy an income level that’s completely unnecessary.
Karl did in-depth videos on the above two.

    • @estellebright2579
      @estellebright2579 5 หลายเดือนก่อน +1

Unfortunately, DOHA is still DOHA and providing certainty seems to not be in their code of conduct in practice. They have no competition and no practical oversight so they just do however they feel like it. All visa applicants will have to suffer.
On top of all this, in the migration regulation, section 91 clearly says DOHA can choose the order in which the visa application will be processed at will for visas subject to limits on how many would be finalised each financial year.
(Things aren’t much better in US, Canada and UK nowadays for international students however)

Thank you for your effort and the great work you are doing for the students! Post work visa was part of our study package and it should be honoured. If anyone applies knowingly afther the rule is implemented, then it is the individual student's choice and its his/her fault and the Australia governemnt can enforce. But those who have come here before the announcement of the new rule with age limit, they did not have a choice and its not their fault that they chose to study in Australia. So, the new rule must only apply (if at all) to those who apply for studies after the new rule comes into effect in mid 2024. In my experience, age limit is bad especially for the PhD applicants as people with solid field experience applying to PhD would be mid to late 30's and therefore Australia will loose out on many skilled and experienced PhD candidates.

What’s even worse is that anyone currently on the 485 visa over the age of 45 is unable to get Permanent Residency. There are no pathways to PR after getting this visa and worse is that you can’t even get a decent high paying job on this visa anyway. If you do your research most people on this visa are in low paying jobs after paying over $150,000 for a degree biggest disappointment.

    Hi Karl,
This is Vinayak from India. I have been following your TH-cam videos from few months and I got lot of knowledge/information. I really appreciate your efforts.
I have some queries, I hope you will clarify it.
I'm a toolmaker and having 80 points for 491 visa & 70 points for 190 visa including state points. As of now, I lodged EOI for South Australia on 17th October 2023 as a Offshore for 491 Visa. Still I didn't get any response from the SA state. Do you advise me to wait or want me to lodge one more new EOI & ROI for Victoria state as it's open for my occupation and I too interested to work over there ?
Why I have been selected SA and waiting till today is because that they may invite early because it's a regional area. Please correct me if I'm wrong.
I would really appreciate your help on this! Please respond!
    Thanks,
    Vinayak

Sorry Eddi that is hard to say. In general I think they are just trying to slow the visitor intake for now

Karl - does this mean there will essentially be a Grandfather clause for those who begin their studies in Australia before the new age limit is put in place?
I started last month on January 29th. 😮

    • @ailsaustralia
      @ailsaustralia  5 หลายเดือนก่อน +1

No at the moment they are saying their will be no grandfather clause or transition period.

@@ailsaustralia That is truly unfortunate and may I say, Devestating.
Is there a chance things change or age limit increases again within the next 18-22 months?
Since they've flip flopped so much already?
      Thank you for the replies.

@@jamie.norris if 191 backflip and PYP backflip is anything to go by, the only hope visa applicants can have is making a lot of noises on as many channels as they can, including media such as ABC or 9News.

This is just embarrassing... I have been defending the country and their politics and politicians as much better than any others around the world (I'm Spanish) and what they've done is closer to any corrupted Gov than what I thought they were... it makes me even question why the h! I want to stay here, after staying and working through COVID on student visa first and then 408, helping the country keep the track, working what they didn't want to work... They need you but then they kick you out. Great. Great job

since 2021 and 2022, we have submitted our files to the Liberal Party and have been waiting for approximately 31 months without receiving any response. the Labor Party promised to clear the backlog of all visas, including the 188 visa (Innovation Stream), but it has not been addressed until now. We are educated entrepreneurs with skills in our businesses, ready to contribute to the Australian economy by injecting capital.
