    China feeling victim of the trilateral agreement when in fact it keeps harassing smaller countries like Philippines. Trilateral summit is a natural action that will be taken by countries who's actions are detrimental to peace in the region.

      There might be a chance to defeat China in court instead of going to the battle field. That is, we sue China for violating Article 89 of the UNCLOS. The said article says: "No state may validly purport to subject any part of the high seas to its sovereignty." China did exactly that with its 9 dashes claim; the dashes encircled a large part of the High Sea to its sovereignty. China cannot deny such a fact. That is, we are guaranteed a victory. The victory means the 9 dashes are no more. Consequently, China will leave the SCS and thereby all tensions and war cries will disappear.

      WPS is not yet recognized internationally. Its only basis was the administrative order of Noynoy Aquino. To be recognized as "West Philippine Sea," we have to conduct hydrographic surveys put coordinates in its boundaries, NAMRIA has to make the map, then submit those to the UN International Maritime Organization (IMO) and also to the International Hydrographic Organization(IHO).

      For better appreciation and understanding, here's for people who obviously did not read and study the South China Sea Arbitration Award, nor listen to concerned elders on how to manage the conflict in the South China Sea:
      1. Ang Ayungin Shoal ay inaangkin din ng Vietnam at China
      2. Hindi natin ito teritoryo maski na pasok ito sa "200 nautical miles" mula sa ating "coastal baseline"
      3. Hindi ito sakop ng "jurisdiction" ng Arbitral Court dahil nanatili itong "militarized" at disputed ayon sa deskripsyon ng UNCLOS.
      4. Hindi "applicable" ang EEZ sa Ayungin Shoal, dahil paano ka nga naman mangingisda, o magbubutas para alamin kung may langis o gas o kahit anupang yamang dagat sa ilalim ng naturang Shoal kung may nag-gigiriang pwersa ng mga claimants, na sa ngayon ay China ang kumokontrol. At kung igigiit ang "sovereign rights" natin ay gyera ang kahahantungan
      5. Mas maganda at makabubuti kung makipa-usap at daanin sa diplomasya kaysa sundin ang sulsol, buyo at pagtulak sa atin ng kano na makipag-away sa China, dahil sa pangakong nasa likod natin sila.

Tulad ng nangyari sa Ukraine, marami sa atin ang namamatay, mawawasak ang mga bahay natin, mga infrastructures, at kabuhayan natin. Yun pala, sa bandang huli ay mag-uusap din para sa "tigil-putukan" at "peace negotiations!"

      Under the UNCLOS only “Naturally Formed Islands” capable of sustaining human habitation and economic life on its own (for example, Luzon island) can generate maritime entitlement for up to 200 nautical miles (which includes a territorial sea of 12 nautical miles and contiguous zone of 24 nautical miles, and an EEZ of 200 nautical miles). A “Rock” for its part, being incapable of human habitation and economic life on its own, can only generate maritime entitlement of up to 12 nautical miles of territorial sea. Both can be considered as territories therefore and capable of appropriation and territorial dispute. But the Ayungin Shoal, being a mere “Low Tide Elevation” incapable of sustaining human habitation and economic life on its own, and disappears during high tide, cannot generate maritime entitlement under the UNCLOS. However, it is considered by the law, as Continental Shelf. And as correctly ruled by the Arbitral body being a “Low Tide Elevation” it means that 1.) It does not generate maritime entitlement, and CANNOT be considered a territory hence there cannot be a territorial dispute over it (that is why it is UNDISPUTED because it cannot be subject for dispute in the first place), and 2.) It is a continental shelf (because even a low tide elevation has to be attached to the sea bed), and 3.) It is a continental shelf of the Philippines being within 200 nautical miles of the low water mark of the nearest Naturally Formed Island (for example it is within a mere 105 nautical miles from West of Palawan) and hence very well within the EEZ of the Philippines. And as coastal state, Philippine rights therein are enshrined under Arts 55-58 of the UNCLOS. For example the Philippines may and can put up artificial islands, installations and structures. Philippines can explore, exploit, conserve, manage natural resources therein. The Philippines can undergo maritime scientific research therein. And the Philippines has duty and jurisdiction to protect and preserve the maritime environment therein. It is therefore absurd for China to claim territorial ownership of Ayungin Shoal, more so because the basis of its claim, the 9-dash line has been debunked by the Hague. And Ayungin Shoal, being a Low Tide Elevation cannot be subject of a territorial dispute. It cannot be a territory in the first place. But this does not mean, it cannot be part of a coastal state’s EEZ. And the Philippines happens to be that coastal state. With dues respect to China, it has no right to be in said area except for freedom of navigation. And freedom of navigation is NOT akin to a sovereign patrol. China cannot water canon agents of the coastal state therein. The same is not only a very unfriendly act, but also a unilateral one, and frowned upon by generally accepted principles of international law and the family of nations.
      It is wise to study first the UNCLOS when dealing with this case. Rulings are merely interpretations of the law, which happens to be UNCLOS in this case. Let us read the arbitral ruling properly as within the purview of the UNCLOS.
      Also let us observe the “Principle of Land Dominating the Sea.” You cannot own the waters without owning the land. And we must take note of the Continental Shelf.
      Mabuhay ang Pilipinas! Long live the 1987 Philippine Constitution! Mabuhay po tayong lahat! And remember, dual citizenship is allowed by law, dual allegiance is not.

      And West Philippine Sea is West Philippine Sea. We call it such as a matter of sovereign policy. And this policy is based on the Constitution and generally accepted principles of international law. It is advised that we refer to the area as West Philippine Sea so it will become the norm. However, UNCLOS will still be observed as per measurements of EEZ. If China wants to contest the same, they do so before the proper international tribunal. It is 9-dash line that is without basis. The best China should do is to do better business with the Philippines and the world. Using water canons against agents of the coastal state is very unfriendly and shows the world the China should and must not be given the chance to be the world superpower. And I don’t think China wants this to be their image. After all, it is US who is always the villain right? It involves itself in proxy wars against the ISIS and the communists. It earns lots and lots of money in selling weapons and military hardware right? And we are sure China will never be like that right? We are sure China won’t align with Hamas, won’t do money trap. It will even give away its massive military hardware for free right?

    That area is not Disputed islands. China started claiming the area only after possible oil was discovered in 1970. Just because a country suddenly start claiming an area, it does not become Disputed Area.

    The 2nd Thomas (Ayungin) Shoal is NOT DISPUTED anymore. On July 12, 2016, the arbitral tribunal adjudicating the Philippines' case against China in the South China Sea ruled overwhelmingly in favor of the Philippines. Stop saying it's 'disputed'. It's already 2024. C'mon guys!

      The PCA Arbitral Ruling did not rule in favor of the Philippines. Ayungin Shoal is outside of its jurisdiction because it is "quintessentially militarized". See paragraph 1161~1162 of the "hoax arbitration." It was also declared in the ruling that Ayungin shoal is a "low tide elevation" and that even if it is within the 200 nautical miles limit, EEZ is not applicable.

      3. even though Ayungin Shoal is within the 200 nautical miles off palawan, EEZ cannot be applied because the shoal is quintessentially "militarized" according to the Arbitral Court ruling
      3. EEZ is not our territory. we only have "sovereign rights"
      4. "Sovereignty" is different from sovereign rights. pinagbabaligtad ng mga nambubuyo, nagsusulsol at nanggagatong sa mga ignoranteng pilipino ang 2 termino

They declared that they will conduct anti-submarine warfare training, giving Manila the illusion that it can really confront the PLA in the South China Sea. While the four countries are conducting joint exercises under the guise of supporting the Philippines, it is clear who is using whom.

      South China Sea Dispute
      There has been a lot of articles South China Sea (SCS) dispute and China’s 9 Dash Line articles in recent time, with a majority of them twisting facts and trying to claim that China is bullying smaller countries with their growing military might when China is simply trying to reclaim what is rightfully theirs.
      In 1946 at the end of WW2 it was a US Navy battleship that took Chinese soldiers to reclaim all the islands that are currently under dispute in the SCS as China simply lacked capable ship at the time. Thus, the original R.O.C 11 Dash Line was drawn in 1947 after China recovered all the islands, the 11 Dash Line linked all the islands together to clearly mark China territorial waters which was at the time recognized by the American and international community. The 11 Dash Line was only reduced to the 9 Dash Line when China secretly transferred Bach Long Vi in the Gulf of Tonkin from China to Vietnam in 1957 so that the island could host a new radar base to provide an early warning of American planes and to serve as a transitional post for Vietnam incoming war aid material as the Vietnam War escalated. It was a goodwill and war aid material from China to support Vietnam against the US invasion. From this, we can tell how ungrateful and traitorous the Vietnamese are with their current aggressive stances toward China.
      Furthermore, all historical document sign by or involved any of the countries associated with the current disputes didn't lay any claim to any of the island involved in the current SCS dispute. For example:
      - In the 1898 Paris Treaty signed between America and Spain, both countries acknowledged that none of the disputed islands belong to the Philippines as the Philippines territory extends to the east of east meridian 118 while the dispute islands laid west of east Meridian 118.
      - In the 1945 Proclamation Defining Terms for Japanese Surrender contained the following statement: ‘’the Japanese sovereignty shall be limited to the islands of Honshu, Hokkaido, Kyushu, Shikoku, and such minor islands as we determine,” as had been announced in the Cairo Declaration in 1943; which clearly stated it didn't include Diaoyu Islands. In addition, the Cairo Declaration in 1943 also clearly stated all the territories Japan has stolen from the Chinese shall be restored to the Republic of China (that represented China at the time) and these documents were signed with Chinese participation.
      The American recognition of the 11 Dash Line lasted until San Francisco Conference in 1951 when the American specifically excluding China from the conference as the Communist Party in China-controlled most of mainland China at the time and proclaimed the establishment of the People's Republic of China in 1949. At the San Francisco Conference, the American made unilateral arrangement in an attempt to deny Chinese ownership of their islands that was previously international recognised belonging to China and put all these islands into a dispute. However, at the time no one including the current neighbouring claimants bothered to dispute China's claim to these islands and reefs, but China also did not have the ability to consistently enforce its sovereignty to these islands due to lack of military power and internal weakness caused by WW2 and the Civil War. Neighbouring states only started to violate China's claim, occupying certain islands and reefs when it was speculated that the South China Sea might contain oil and gas. For example:
      - During the San Francisco Treaty of 1951 in the absence of China and with the support of the American, the Philippine claim ownership of the disputed island, nevertheless the Philippine did not declare ownership of the disputed islands until late 1970 by self-proclamation.
      - The America took over the administrative duty of Diaoyu Islands at San Francisco Conference from China and promised to relay it to UN which they never did. The American kept the administrative rights until 1971 then transfer the administrative control of the islands to Japan at the opposition of China.
      - The rest of the disputed is laid according to the 1994 United Nation Convention of Law of the Sea (UNCLOS) 200 nautical mile EEZs which didn't come into existence until 47 years after the establishment of dash-lines and International laws generally don't have judicial to things which preceded it. Therefore it shouldn't be applied here in the first place.
      Once again all the dispute was supported by the American and the American even announced that “The United States has a national interest in freedom of navigation, open access to Asia's maritime commons, and respect for international law in the South China Sea”. The United States has also called for unfettered access to the area that China claims as its own, and accused Beijing of adopting an increasingly aggressive stance on the high seas. The American has also frequently sent warships into the disputed area on so call Freedom of Navigation Operations.
      Now if we look at historical evidence we can further assure China claims to these islands and the 9 or 11 Dash Line.
      Diaoyu Islands - China claimed the discovery and ownership of the islands from the 14th century and the first Chinese records of these islands date back to as early as the 15th century when they were referred as Diaoyu Dao. While the Japanese maintained ownership of the islands from 1895 until its surrender at the end of World War II which ownership should have been returned to China according to the Cairo Declaration. In the 1945 Proclamation Defining Terms for Japanese Surrender also contains this statement.
      Spratly and Paracel Islands - The earliest written record of the Spratly Islands can be found in documents dating from the Eastern Han Dynasty 25 AD and The earliest written record of the Paracel islands can be found in historical documents dating from the Song Dynasty 960 AD. The 1887 Chinese-Vietnamese Boundary convention signed between France and China after the Sino-French War states that China was the owner of the Spratly and Paracel islands. The Qing dynasty also sent naval forces on inspection tours in 1902 and 1907 and placed flags and markers on the islands. The Qing dynasty's successor state, the Republic of China, claimed the Spratly and Paracel islands under the jurisdiction of Hainan. The Japanese occupied the Paracels and the Spratlys from February 1939 to August 1945, which was handed back to the Republic of China at the end of WW2 according to the Cairo and Potsdam Declarations.
      In summary, all evidences support China 9 Dash Line historical and sovereignty claim in the South China Sea. However, it has been continuously undermined with the support of the US in their greed and ambition of controlling the world energy resources, world hegemony and containment of China’s rise. International laws and organizations such as the UN are just becoming tools for the US and are no longer performing the traditional roles that they were created for in the first place. If we use the same standard of argument used against China in the SCS then the international community need to do a lot more American occupation and military bases in Guam, Diego Garcia and other Pacific islands.

      "Because the Allies, in particular the United Kingdom and the United States, could not agree on which government represented China, no Chinese delegation participated in the 1951 San Francisco Peace Conference. Therefore the Republic of China (Taiwan) negotiated a separate peace treaty with Japan, signed on 28 April 1952. Article 2 of the text included a reference to the San Francisco treaty: “It is recognized that under Article 2 of the Treaty of Peace with Japan signed in the city of San Francisco in the United States of American on September 8 1951, Japan has renounced all right, title and claim to Taiwan (Formosa) and Penghu (the Pescadores) as well as the Spratly Islands and Paracel Islands”. Republic of China has argued that the explicit reference to the Spratly and Paracel islands in the text of this bilateral treaty implies Japanese recognition of Chinese sovereignty. Samuels and Lu have observed that, unlike the 1951 treaty, the Sino-Japanese text mentions the Spratly and Paracel islands in thesame sentence as Taiwan and the Pescadores islands. The latter are generally recognized as Chinese territories. Moreover, according to the negotiating record Japan insisted that the renunciation article deal only with Chinese territory. This shows that the ROC and Japan viewed the islands of Taiwan, the Pescadores, the Spratlys, and the Paracels as having a similar status - that is, belonging to China"
      US State Dept South China Sea expert Ambassador Chas Freeman who served for decades in the region, regarding China's claim to the SCS:
      "In 1945, in accordance with the Cairo and Potsdam Declarations and with American help, the armed forces of the Republic of China government at Nanjing accepted the surrender of the Japanese garrisons in Taiwan, including the Paracel and Spratly Islands. Nanjing then declared both archipelagoes to be part of Guangdong Province. In 1946 it established garrisons on both Woody (now Yongxing) Island in the Paracels and Taiping Island in the Spratlys."

      The UN Declaration when it was accepted as member and recognizing Taiwan as its province. The US signed such Declaration. Prior to this, the basis of its claim is the San Francisco Treaty. Also the Taiwan Treaty and the Cairo Conference. There are various existing laws governing the region before the UNCLOS became effective in 1994.

      It is still disputed. The Arbitral Tribunal did not rule on "sovereignty" but only on "sovereign rights."
      Ito ang tutoong facts mula sa PCA Arbitral Court Award:
      1. Ayungin Shoal is "militarized" and is outside the jurisdiction of the Tribunal
      3. even though Ayungin Shoal is within the 200 nautical miles off palawan, EEZ cannot be applied because the shoal is quintessentially "militarized" according to the Arbitral Court ruling
      3. EEZ is not our territory. we only have "sovereign rights"
      4. "Sovereignty" is different from sovereign rights. pinagbabaligtad ng mga nambubuyo, nagsusulsol at nanggagatong sa mga ignoranteng pilipino ang 2 termino
      5. hanggang 12 nautical miles lng mula sa ating archipelagic baseline ang ating territorial sea.
